Un salari\u00e9, pr\u00e9c\u00e9demment en contrat \u00e0 dur\u00e9e d\u00e9termin\u00e9e, s&#8217;est vu remettre un document intitul\u00e9 promesse d&#8217;embauche pour un CDI. L&#8217;employeur ayant refus\u00e9 d&#8217;honorer cet engagement, le salari\u00e9 saisit les prud&#8217;hommes. La juridiction du fond reconna\u00eet l&#8217;existence d&#8217;un licenciement sans cause r\u00e9elle et s\u00e9rieuse. L&#8217;employeur forme un pourvoi en cassation. La Haute juridiction rejette le pourvoi et confirme la qualification de licenciement, tout en r\u00e9visant le quantum de l&#8217;indemnisation accord\u00e9e.<\/p>\n<p>La qualification contractuelle de la promesse sign\u00e9e<\/p>\n<p>La force probante de l&#8217;\u00e9crit sign\u00e9. La cour fonde sa d\u00e9cision sur l&#8217;existence d&#8217;un document \u00e9crit et sign\u00e9 par les deux parties. Ce document, explicitement intitul\u00e9 promesse d&#8217;embauche, comporte tous les \u00e9l\u00e9ments essentiels du contrat de travail. &#171;Que le document stipule que la collaboration des parties se poursuivrait au-del\u00e0 du contrat de travail \u00e0 dur\u00e9e d\u00e9termin\u00e9e conclu pr\u00e9c\u00e9demment&#187; (Motifs). Il pr\u00e9cise le poste, la r\u00e9mun\u00e9ration et la date d&#8217;effet. La signature conf\u00e8re \u00e0 cet \u00e9crit une force probante d\u00e9cisive, en faisant un engagement contractuel parfait.<\/p>\n<p>L&#8217;\u00e9chec des moyens de preuve contraires. L&#8217;employeur tente de d\u00e9montrer une intention diff\u00e9rente, invoquant des SMS et un t\u00e9moignage. La cour \u00e9carte ces \u00e9l\u00e9ments, jug\u00e9s insuffisants pour renverser la pr\u00e9somption de sinc\u00e9rit\u00e9 de l&#8217;acte \u00e9crit. &#171;Que l&#8217;on ne saurait tirer de cons\u00e9quences du t\u00e9moignage produits par Monsieur [S], dont la sinc\u00e9rit\u00e9 la d\u00e9claration peut \u00eatre mise en cause en raison du lien de subordination&#187; (Motifs). La port\u00e9e de cette analyse est essentielle. Elle r\u00e9affirme la primaut\u00e9 de l&#8217;\u00e9crit sign\u00e9 dans la formation du contrat de travail, prot\u00e9geant ainsi la s\u00e9curit\u00e9 juridique des engagements.<\/p>\n<p>Les cons\u00e9quences de la rupture de la promesse<\/p>\n<p>La requalification en licenciement sans cause. Le refus d&#8217;honorer la promesse d&#8217;embauche est analys\u00e9 comme une rupture du contrat de travail form\u00e9. La cour en d\u00e9duit logiquement un licenciement sans cause r\u00e9elle et s\u00e9rieuse. &#171;Que le refus op\u00e9r\u00e9 par celui-ci est constitutif d&#8217;un licenciement sans cause r\u00e9elle et s\u00e9rieuse ne serait-ce qu&#8217;\u00e0 d\u00e9faut de notification d&#8217;une rupture contractuelle \u00e9crite&#187; (Motifs). Cette solution \u00e9tend la protection du salari\u00e9 \u00e0 la phase pr\u00e9contractuelle concr\u00e9tis\u00e9e par un \u00e9crit sign\u00e9. Elle sanctionne s\u00e9v\u00e8rement la d\u00e9loyaut\u00e9 de l&#8217;employeur qui laisse croire \u00e0 une embauche certaine.<\/p>\n<p>L&#8217;encadrement strict de l&#8217;indemnisation forfaitaire. La cour proc\u00e8de \u00e0 une r\u00e9\u00e9valuation du pr\u00e9judice subi. Elle fixe une indemnit\u00e9 forfaitaire en application de l&#8217;article L. 1235-3 du code du travail. &#171;Pour fixer le pr\u00e9judice \u00e0 1.800 euros, en application des dispositions de l&#8217;article L.1235-3 du code du travail&#187; (Motifs). Elle rejette en revanche les autres demandes indemnitaires, jug\u00e9es sans fondement distinct.
