Le bailleur limite volontairement sa demande pour tenir compte de la v\u00e9tust\u00e9 du logement. Cette mod\u00e9ration spontan\u00e9e int\u00e8gre le principe d\u2019usure normale des locaux. Le juge valide cette approche en condamnant la locataire au montant r\u00e9duit. La d\u00e9cision rejoint l\u2019id\u00e9e que le locataire ne doit r\u00e9pondre que de la d\u00e9pr\u00e9ciation anormale. Le juge rappelle que cette faute proc\u00e9durale suppose une sollicitation pr\u00e9alable et une abstention injustifi\u00e9e. Il constate que le bailleur n\u2019a pas mis en demeure la locataire de payer les sommes contest\u00e9es. L\u2019absence de demande formelle emp\u00eache de caract\u00e9riser l\u2019abstention fautive. La d\u00e9cision pr\u00e9cise que &#171;Madame [D] n\u2019a pas pu s\u2019abstenir abusivement en l\u2019absence de demande&#187;. Cette analyse prot\u00e8ge le d\u00e9biteur d\u2019une condamnation sans avertissement pr\u00e9alable sur sa pr\u00e9tendue obligation.<\/p>\n<p>La charge de la preuve incombant au demandeur. Le tribunal applique strictement l\u2019article 9 du code civil sur la charge de la preuve. Le bailleur, qui invoque la r\u00e9sistance abusive, doit d\u00e9montrer avoir exig\u00e9 le paiement. En l\u2019esp\u00e8ce, il \u00e9choue \u00e0 rapporter cette preuve essentielle. La solution souligne que &#171;le bailleur ne d\u00e9montre pas avoir mis en demeure&#187; la locataire.
