Le Tribunal judiciaire de Strasbourg, le 25 septembre 2025, a statu\u00e9 sur une demande en r\u00e9solution de vente pour vice cach\u00e9. L’acqu\u00e9reur d’un v\u00e9hicule d’occasion invoquait une surconsommation d’huile moteur. Le tribunal a d\u00e9bout\u00e9 l’acheteur de sa demande, estimant que l’ant\u00e9riorit\u00e9 du vice par rapport \u00e0 la vente n’\u00e9tait pas \u00e9tablie. Il a \u00e9galement rejet\u00e9 la demande de dommages-int\u00e9r\u00eats pour r\u00e9sistance abusive.<\/p>\n

La caract\u00e9risation exigeante du vice cach\u00e9<\/p>\n

Le juge rappelle les conditions l\u00e9gales de la garantie. Le d\u00e9faut doit \u00eatre cach\u00e9, grave et ant\u00e9rieur \u00e0 la vente. «Cette garantie contre les vices cach\u00e9s suppose la d\u00e9monstration par l’acheteur d’un d\u00e9faut inh\u00e9rent \u00e0 la chose vendue, suffisamment grave et compromettant l’usage normal de la chose, qui soit ant\u00e9rieur \u00e0 la vente.» (Motifs, 1\/) L’acheteur ne doit pas avoir pu d\u00e9couvrir le vice par des v\u00e9rifications normales. La charge de la preuve p\u00e8se int\u00e9gralement sur l’acqu\u00e9reur, qui doit d\u00e9montrer chaque \u00e9l\u00e9ment.<\/p>\n

La preuve insuffisante de l’ant\u00e9riorit\u00e9 du vice<\/p>\n

Le tribunal analyse les \u00e9l\u00e9ments produits pour \u00e9tablir l’existence du vice avant la vente. Un d\u00e9faut d’alerte \u00e9tait pr\u00e9sent avant l’acquisition, mais cela ne suffit pas. «il ne peut \u00eatre prouv\u00e9, sur la base de la pr\u00e9sence d’un d\u00e9faut d’alerte de pression d’huile moteur lorsque le v\u00e9hicule avait 72.641km, soit avant la vente du v\u00e9hicule, que ce dernier consommait d\u00e9j\u00e0 une quantit\u00e9 anormale d’huile moteur.» (Motifs, 1\/) La mesure de consommation post\u00e9rieure est jug\u00e9e non probante. Le juge souligne aussi un possible mauvais usage par l’acheteur apr\u00e8s la vente.<\/p>\n

La port\u00e9e de l’exigence probatoire<\/p>\n

Cette d\u00e9cision renforce la rigueur requise pour prouver l’ant\u00e9riorit\u00e9. Un simple indice technique ant\u00e9rieur \u00e0 la vente ne vaut pas preuve du vice all\u00e9gu\u00e9. Elle rejoint une jurisprudence exigeante sur ce point. «Le tribunal a retenu qu’il n’\u00e9tait pas d\u00e9montr\u00e9 que le pulv\u00e9risateur litigieux \u00e9tait affect\u00e9 ant\u00e9rieurement \u00e0 son acquisition de d\u00e9fauts le rendant impropre \u00e0 son usage.» (Cour d’appel de N\u00eemes, le 23 janvier 2025, n\u00b023\/02520) L’acheteur doit rapporter une preuve certaine liant le d\u00e9faut constat\u00e9 \u00e0 un \u00e9tat ant\u00e9rieur \u00e0 la transaction.<\/p>\n

La distinction entre indice et preuve certaine<\/p>\n

L’arr\u00eat op\u00e8re une distinction cruciale entre un sympt\u00f4me et le vice lui-m\u00eame. Un t\u00e9moin d’alerte allum\u00e9 peut avoir diverses causes. Il ne d\u00e9montre pas automatiquement une surconsommation structurelle. La preuve doit \u00eatre directe et sp\u00e9cifique au vice invoqu\u00e9. Une expertise contradictoire aurait pu offrir une force probante sup\u00e9rieure. Le juge refuse de d\u00e9duire l’existence d’un vice cach\u00e9 d’un simple \u00e9l\u00e9ment d’information technique. Cette approche prot\u00e8ge le vendeur de professionnel contre des demandes fond\u00e9es sur des pr\u00e9somptions.<\/p>\n

Le rejet des demandes accessoires<\/p>\n

Concernant la r\u00e9sistance abusive, le tribunal en rejette le principe. «la r\u00e9sistance abusive doit \u00eatre caract\u00e9ris\u00e9e par une faute ou la mauvaise foi et doit causer un pr\u00e9judice distinct.» (Motifs, 2\/) La partie succombante est condamn\u00e9e aux d\u00e9pens et \u00e0 une indemnit\u00e9 au titre de l’article 700 du code de proc\u00e9dure civile. L’ex\u00e9cution provisoire est ordonn\u00e9e, conform\u00e9ment au droit commun.
