Cette d\u00e9cision intervient dans un litige locatif opposant un bailleur \u00e0 son locataire, ce dernier \u00e9tant en d\u00e9faut de paiement. Le juge a d\u00fb trancher plusieurs questions relatives \u00e0 la dette locative, \u00e0 l&#8217;application d&#8217;une clause r\u00e9solutoire et aux mesures d&#8217;accompagnement. La solution retenue constate la r\u00e9siliation du bail mais en suspend les effets sous conditions, tout en accordant des d\u00e9lais de paiement au locataire pour apurer sa dette.<\/p>\n<p>La mise en \u0153uvre contr\u00f4l\u00e9e de la clause r\u00e9solutoire<\/p>\n<p>Le juge constate tout d&#8217;abord la r\u00e9gularit\u00e9 de la proc\u00e9dure de r\u00e9siliation engag\u00e9e par le bailleur. Il rel\u00e8ve que le bail contient une clause aux termes de laquelle le contrat se trouvera de plein droit r\u00e9sili\u00e9 en cas de d\u00e9faut de paiement, deux mois apr\u00e8s un commandement de payer rest\u00e9 infructueux. L&#8217;examen des pi\u00e8ces d\u00e9montre qu&#8217;un &#171;commandement de payer visant la clause r\u00e9solutoire et les dispositions de l&#8217;article 24 de la loi pr\u00e9cit\u00e9e a \u00e9t\u00e9 r\u00e9guli\u00e8rement signifi\u00e9&#187; au locataire. Le juge en d\u00e9duit logiquement que &#171;les conditions d\u2019acquisition de la clause r\u00e9solutoire sont r\u00e9unies&#187; et que &#171;la r\u00e9siliation du bail est intervenue de plein droit&#187; \u00e0 la date pr\u00e9vue. Cette analyse rappelle le formalisme strict encadrant l&#8217;application des clauses r\u00e9solutoires en mati\u00e8re de baux d&#8217;habitation, visant \u00e0 prot\u00e9ger le locataire contre une rupture brutale.<\/p>\n<p>Toutefois, la d\u00e9cision op\u00e8re un r\u00e9\u00e9quilibrage en faveur du locataire par la suspension conditionnelle des effets de cette r\u00e9siliation. Le juge applique l&#8217;article 24, VII, de la loi de 1989, qui permet une suspension &#171;\u00e0 la condition que celui-ci ait repris le versement int\u00e9gral du loyer courant avant la date de l&#8217;audience&#187;. Il constate que cette condition est remplie, un paiement \u00e9tant intervenu avant l&#8217;audience. Ainsi, &#171;pendant le cours des d\u00e9lais pr\u00e9c\u00e9demment accord\u00e9s, les effets de la clause r\u00e9solutoire seront suspendus&#187;. Cette suspension constitue une mesure de pr\u00e9vention des expulsions, subordonn\u00e9e au strict respect d&#8217;un \u00e9ch\u00e9ancier. Elle illustre la volont\u00e9 du l\u00e9gislateur de privil\u00e9gier le maintien dans les lieux lorsque le locataire fait preuve de bonne foi et de capacit\u00e9s de redressement.<\/p>\n<p>L&#8217;articulation entre condamnation au paiement et mesures d&#8217;accompagnement<\/p>\n<p>La d\u00e9cision \u00e9tablit avec pr\u00e9cision le montant de la cr\u00e9ance locative due par le locataire. Le juge proc\u00e8de \u00e0 un examen critique du d\u00e9compte produit par le bailleur, en retranchant certains frais. Il motive sa d\u00e9cision en indiquant qu'&#187;en l&#8217;absence d&#8217;une stipulation contractuelle, le bailleur ne peut mettre \u00e0 la charge du locataire des frais en cas de rejet du paiement&#187;. Apr\u00e8s cette correction, &#171;la cr\u00e9ance de la soci\u00e9t\u00e9 [bailleur] est \u00e9tablie tant dans son principe que dans son montant&#187;. Le locataire est donc condamn\u00e9 au paiement de l&#8217;arri\u00e9r\u00e9, ce qui constitue le fondement juridique n\u00e9cessaire pour la suite de la d\u00e9cision et pour l&#8217;octroi \u00e9ventuel de d\u00e9lais.<\/p>\n<p>Sur cette base, le juge accorde des d\u00e9lais de paiement au locataire en application de l&#8217;article 24, V, de la loi de 1989. Il rappelle les conditions l\u00e9gales : le locataire doit \u00eatre &#171;en situation de r\u00e9gler sa dette locative&#187; et avoir &#171;repris le versement int\u00e9gral du loyer courant avant la date de l\u2019audience&#187;. Le juge v\u00e9rifie que ces conditions sont remplies, notant que le locataire &#171;est en mesure de s&#8217;acquitter du montant du loyer et des charges courants et de verser en suppl\u00e9ment une somme mensuelle&#187;. Il fixe donc un \u00e9ch\u00e9ancier sur trente-six mois. Cette approche est conforme \u00e0 la jurisprudence r\u00e9cente, comme le montre une d\u00e9cision qui souligne \u00e9galement que le juge peut accorder des d\u00e9lais &#171;\u00e0 la condition que le locataire soit en situation de r\u00e9gler sa dette locative et qu&#8217;il ait repris le versement int\u00e9gral du loyer courant&#187; (Tribunal judiciaire, le 13 novembre 2025, n\u00b025\/00775). La d\u00e9cision comment\u00e9e en pr\u00e9cise les cons\u00e9quences en cas de manquement.<\/p>\n<p>Le dispositif de la d\u00e9cision cr\u00e9e en effet un m\u00e9canisme incitatif et s\u00e9curisant pour les deux parties. La suspension de la r\u00e9siliation et les d\u00e9lais de paiement sont strictement conditionn\u00e9s. Le juge d\u00e9taille les effets d&#8217;un \u00e9ventuel d\u00e9faut de paiement : d\u00e9ch\u00e9ance des d\u00e9lais, exigibilit\u00e9 imm\u00e9diate du reliquat de dette, et ex\u00e9cution de l&#8217;expulsion. Inversement, &#171;si l\u2019int\u00e9gralit\u00e9 de la dette est apur\u00e9e dans ce d\u00e9lai et selon les modalit\u00e9s de paiement pr\u00e9vus, la clause de r\u00e9siliation de plein droit sera r\u00e9put\u00e9e ne pas avoir jou\u00e9&#187;.
