Les juges constatent la r\u00e9siliation du bail et ordonnent l&#8217;expulsion du preneur ainsi que le paiement de diverses sommes. La d\u00e9cision illustre l&#8217;articulation d\u00e9licate entre la proc\u00e9dure de r\u00e9f\u00e9r\u00e9 et l&#8217;ex\u00e9cution des clauses contractuelles en mati\u00e8re de bail.<\/p>\n<p>La mise en \u0153uvre acc\u00e9l\u00e9r\u00e9e de la clause r\u00e9solutoire<br \/>\nLa juridiction admet la r\u00e9solution de plein droit du contrat de bail. Cette interpr\u00e9tation confirme la latitude du juge pour pr\u00e9venir un trouble manifeste.<\/p>\n<p>Les cons\u00e9quences p\u00e9cuniaires de la r\u00e9siliation du contrat<br \/>\nLa d\u00e9cision entra\u00eene plusieurs condamnations financi\u00e8res \u00e0 la charge du locataire d\u00e9faillant. Une indemnit\u00e9 provisionnelle est fix\u00e9e \u00e0 valoir sur l&#8217;arri\u00e9r\u00e9 des loyers et charges dus. &#171;L&#8217;indemnit\u00e9 d&#8217;occupation d&#8217;un montant \u00e9gal au loyer est due \u00e0 compter de la r\u00e9siliation du bail&#187; (Motifs). Le preneur doit \u00e9galement supporter les d\u00e9pens et une indemnit\u00e9 au titre de l&#8217;article 700 du code de proc\u00e9dure civile. Ces dispositions visent \u00e0 r\u00e9parer int\u00e9gralement le pr\u00e9judice subi par les bailleurs.<\/p>\n<p>La valeur de cette ordonnance r\u00e9side dans son application pratique des textes. Elle d\u00e9montre l&#8217;efficacit\u00e9 du r\u00e9f\u00e9r\u00e9 pour trancher un litige locatif urgent. La solution aligne la jurisprudence du tribunal judiciaire sur les principes g\u00e9n\u00e9raux. Elle rejoint la position de la Cour de cassation sur l&#8217;examen des exceptions d&#8217;inex\u00e9cution. &#171;Le juge doit en v\u00e9rifier le bien-fond\u00e9, peu important que le locataire n&#8217;ait pas demand\u00e9 en justice des d\u00e9lais de paiement&#187; (Cass.
