La soci\u00e9t\u00e9 bailleresse assigne le locataire apr\u00e8s un commandement de payer demeur\u00e9 infructueux. Le juge examine la recevabilit\u00e9 de l&#8217;action et les conditions de la clause r\u00e9solutoire. Il statue \u00e9galement sur les demandes p\u00e9cuniaires et l&#8217;octroi \u00e9ventuel de d\u00e9lais de paiement. La d\u00e9cision accueille les demandes principales de la bailleuse et rejette l&#8217;octroi de d\u00e9lais au locataire.<\/p>\n<p>La mise en \u0153uvre encadr\u00e9e de la clause r\u00e9solutoire<\/p>\n<p>Le juge v\u00e9rifie scrupuleusement le respect des formalit\u00e9s proc\u00e9durales pr\u00e9alables \u00e0 l&#8217;action. Il constate que la copie de l&#8217;assignation a \u00e9t\u00e9 notifi\u00e9e \u00e0 la pr\u00e9fecture plus de six semaines avant l&#8217;audience. La saisine de la commission d\u00e9partementale de conciliation est \u00e9galement intervenue dans les d\u00e9lais requis. Ces v\u00e9rifications garantissent le strict respect des r\u00e8gles de protection du locataire avant toute action en justice. L&#8217;action est donc d\u00e9clar\u00e9e recevable, ouvrant la voie \u00e0 l&#8217;examen du fond.<\/p>\n<p>Le c\u0153ur de l&#8217;analyse concerne l&#8217;acquisition des effets de la clause contractuelle. Le juge rappelle le principe l\u00e9gal issu de l&#8217;article 24 I de la loi de 1989. &#171;toute clause pr\u00e9voyant la r\u00e9siliation de plein droit du contrat de location pour d\u00e9faut de paiement du loyer ou des charges aux termes convenus ou pour non-versement du d\u00e9p\u00f4t de garantie ne produit effet que deux mois apr\u00e8s un commandement de payer demeur\u00e9 infructueux&#187; (I. Sur l&#8217;acquisition des effets la clause r\u00e9solutoire). En l&#8217;esp\u00e8ce, le commandement d\u00e9livr\u00e9 en janvier 2024 est rest\u00e9 sans effet. Le juge en d\u00e9duit que la condition r\u00e9solutoire est acquise deux mois apr\u00e8s, soit le 4 mars 2024. Cette application stricte rejoint la solution d&#8217;une cour d&#8217;appel qui a jug\u00e9 que &#171;le commandement de payer visant la clause r\u00e9solutoire, d\u00e9livr\u00e9 le 16 d\u00e9cembre 2019, est demeur\u00e9 infructueux pendant plus de 2 mois (&#8230;) La condition r\u00e9solutoire est donc acquise&#187; (Cour d&#8217;appel de Paris, le 16 f\u00e9vrier 2023, n\u00b020\/17258). La port\u00e9e de ce point est essentielle, car elle conditionne la date de r\u00e9siliation du contrat et le basculement des sommes dues en indemnit\u00e9 d&#8217;occupation.<\/p>\n<p>Les cons\u00e9quences p\u00e9cuniaires de la r\u00e9siliation et le refus des d\u00e9lais<\/p>\n<p>La r\u00e9siliation du bail entra\u00eene une double condamnation p\u00e9cuniaire \u00e0 la charge du locataire. Le juge ordonne d&#8217;abord le paiement des arri\u00e9r\u00e9s de loyer et charges jusqu&#8217;\u00e0 la date de r\u00e9siliation. Il condamne ensuite au paiement d&#8217;une indemnit\u00e9 d&#8217;occupation pour la p\u00e9riode post\u00e9rieure \u00e0 cette date. Cette indemnit\u00e9 est fix\u00e9e au montant du loyer qui aurait \u00e9t\u00e9 d\u00fb, afin de r\u00e9parer le pr\u00e9judice de l&#8217;occupation sans titre. Le juge pr\u00e9cise que cette condamnation, de nature \u00e0 r\u00e9parer le pr\u00e9judice, rend inutile le prononc\u00e9 d&#8217;une astreinte. Cette solution assure une compensation int\u00e9grale pour la bailleuse tout en \u00e9vitant une sanction cumulative.<\/p>\n<p>Le juge \u00e9carte fermement la possibilit\u00e9 d&#8217;accorder des d\u00e9lais de paiement au locataire. Il se fonde sur l&#8217;article 24 V de la loi de 1989 qui subordonne cet octroi \u00e0 une situation de r\u00e9gularisation. &#171;Compte tenu de l&#8217;absence de r\u00e8glement de la part de Monsieur [T] [I], malgr\u00e9 des revenus (&#8230;) depuis le 01er septembre 2023, aucune reprise du paiement du loyer ne peut \u00eatre consid\u00e9r\u00e9e comme r\u00e9alis\u00e9e&#187; (III. SUR LES DELAIS DE PAIEMENT). Le locataire n&#8217;ayant manifest\u00e9 aucun effort de paiement apr\u00e8s le commandement, le juge estime qu&#8217;aucune bonne foi ne peut lui \u00eatre reconnue. La port\u00e9e de ce refus est significative, car il entra\u00eene l&#8217;expulsion sans sursis et prive le locataire du m\u00e9canisme protecteur de suspension de la r\u00e9siliation.
