Il statuait sur une action en r\u00e9siliation de bail pour d\u00e9faut d&#8217;assurance et en paiement d&#8217;arri\u00e9r\u00e9s. Le juge a constat\u00e9 la r\u00e9siliation du contrat pour inex\u00e9cution de l&#8217;obligation d&#8217;assurance. Il a \u00e9galement accord\u00e9 des d\u00e9lais de paiement au locataire tout en ordonnant l&#8217;ex\u00e9cution de travaux pour cause d&#8217;ind\u00e9cence. Cette solution \u00e9quilibr\u00e9e m\u00e9rite une analyse approfondie de ses motifs et de sa port\u00e9e.<\/p>\n<p>La sanction du d\u00e9faut d&#8217;assurance et ses conditions<\/p>\n<p>Le juge rappelle le formalisme strict encadrant les clauses r\u00e9solutoires pour d\u00e9faut d&#8217;assurance. L&#8217;article 7 g) de la loi du 6 juillet 1989 subordonne leur effet \u00e0 un commandement pr\u00e9alable. Ce commandement doit reproduire les dispositions l\u00e9gales sous peine de nullit\u00e9. En l&#8217;esp\u00e8ce, le commandement d\u00e9livr\u00e9 \u00e9tait conforme et est demeur\u00e9 infructueux pendant plus d&#8217;un mois. La communication ult\u00e9rieure d&#8217;une attestation d&#8217;assurance a \u00e9t\u00e9 jug\u00e9e inop\u00e9rante pour arr\u00eater le processus. &#171;La communication ult\u00e9rieure d&#8217;une attestation d&#8217;assurance pour la p\u00e9riode du 1er septembre 2024 au 31 ao\u00fbt 2025 est dans ces conditions inop\u00e9rante.&#187; (Motifs, I). Le juge a donc constat\u00e9 la r\u00e9siliation du bail \u00e0 la date d&#8217;acquisition de la clause. Cette application rigoureuse prot\u00e8ge le locataire contre une r\u00e9siliation brutale. Elle garantit aussi au bailleur l&#8217;ex\u00e9cution d&#8217;une obligation essentielle \u00e0 la pr\u00e9servation du patrimoine lou\u00e9.<\/p>\n<p>La gestion concurrente de la dette locative et de l&#8217;ind\u00e9cence<\/p>\n<p>Le traitement des demandes p\u00e9cuniaires r\u00e9v\u00e8le un \u00e9quilibre entre les droits des parties. Le juge a d&#8217;abord \u00e9cart\u00e9 la prescription partielle de la cr\u00e9ance locative. &#171;L&#8217;assignation en paiement (&#8230;) ayant \u00e9t\u00e9 d\u00e9livr\u00e9e le 8 octobre 2024, la demande en paiement des loyers ant\u00e9rieurs \u00e0 octobre 2021 est couverte par la prescription.&#187; (Motifs, II). Cette solution est conforme \u00e0 la jurisprudence. &#171;Aucune cause d&#8217;interruption de la prescription n&#8217;\u00e9tant \u00e9tablie, la demande en paiement (&#8230;) est effectivement prescrite&#187; (Cour d&#8217;appel de Versailles, le 16 septembre 2025, n\u00b024\/04785). Par ailleurs, le locataire invoquait un constat d&#8217;ind\u00e9cence pour contester la dette. Le juge a rappel\u00e9 que seul un arr\u00eat\u00e9 d&#8217;insalubrit\u00e9 peut exon\u00e9rer du paiement du loyer. L&#8217;absence d&#8217;un tel acte maintient donc l&#8217;obligation de payer. Cette distinction pr\u00e9serve la force obligatoire du contrat tout en reconnaissant l&#8217;existence d&#8217;un trouble de jouissance distinct.<\/p>\n<p>L&#8217;am\u00e9nagement judiciaire des cons\u00e9quences de la r\u00e9siliation<\/p>\n<p>La d\u00e9cision se distingue par l&#8217;am\u00e9nagement des suites de la r\u00e9siliation prononc\u00e9e. Le juge a utilis\u00e9 le pouvoir d&#8217;octroyer des d\u00e9lais de paiement pr\u00e9vu par l&#8217;article 24 V de la loi de 1989. Il a suspendu les effets de la clause r\u00e9solutoire en raison de la reprise des paiements par le locataire. &#171;Au regard de la reprise du paiement du loyer et des difficult\u00e9s rencontr\u00e9es, il sera fait droit \u00e0 la demande de suspension&#187; (Motifs, III). Cette mesure \u00e9vite l&#8217;expulsion imm\u00e9diate et permet un apurement progressif de la dette. Elle est toutefois assortie d&#8217;un m\u00e9canisme de conditionnalit\u00e9 tr\u00e8s strict. Tout d\u00e9faut de paiement entra\u00eenera la caducit\u00e9 des d\u00e9lais et la reprise des effets de la r\u00e9siliation. Cette approche concilie la protection du locataire en difficult\u00e9 avec la s\u00e9curit\u00e9 juridique du bailleur.<\/p>\n<p>La sanction de l&#8217;obligation de d\u00e9cence et sa r\u00e9paration<\/p>\n<p>En contrepartie, le juge a s\u00e9v\u00e8rement sanctionn\u00e9 le manquement du bailleur \u00e0 son obligation de d\u00e9cence. Un constat d&#8217;ind\u00e9cence \u00e9tabli par un organisme agr\u00e9\u00e9 a \u00e9t\u00e9 retenu comme preuve du trouble de jouissance. L&#8217;inaction du propri\u00e9taire, malgr\u00e9 la connaissance du probl\u00e8me, a justifi\u00e9 une condamnation. &#171;Au vu de l&#8217;inaction du propri\u00e9taire du bien durant une ann\u00e9e, il y a lieu de lui ordonner de faire r\u00e9aliser les travaux n\u00e9cessaires&#187; (Motifs, IV). Le bailleur a \u00e9t\u00e9 condamn\u00e9 \u00e0 verser des dommages-int\u00e9r\u00eats pour le pr\u00e9judice subi. Il doit aussi ex\u00e9cuter les travaux sous astreinte financi\u00e8re. Cette double condamnation, p\u00e9cuniaire et en nature, assure une r\u00e9paration effective du pr\u00e9judice.
