L\u2019ancien preneur, un professionnel de sant\u00e9, avait am\u00e9nag\u00e9 les lieux pour son activit\u00e9. Les bailleurs r\u00e9clament une indemnit\u00e9 pour travaux de remise en \u00e9tat et divers pr\u00e9judices. L\u2019ancien locataire forme une demande reconventionnelle. Le tribunal doit d\u00e9terminer l\u2019\u00e9tendue des obligations de remise en \u00e9tat et la validit\u00e9 des autres demandes indemnitaires. Il rejette la majeure partie des pr\u00e9tentions des bailleurs et accueille partiellement les demandes de l\u2019ancien preneur.<\/p>\n<p>La d\u00e9limitation des travaux \u00e0 la charge du locataire<\/p>\n<p>Le tribunal op\u00e8re un contr\u00f4le strict de la preuve des d\u00e9gradations. Il rappelle le principe l\u00e9gal selon lequel le preneur doit rendre la chose telle qu\u2019il l\u2019a re\u00e7ue, sauf v\u00e9tust\u00e9 ou force majeure. &#171;Il r\u00e9pond des d\u00e9gradations ou des pertes qui arrivent pendant sa jouissance, \u00e0 moins qu&#8217;il ne prouve qu&#8217;elles ont eu lieu sans sa faute&#187; (article 1732 du code civil). Chaque poste de travaux est examin\u00e9 \u00e0 l\u2019aune des \u00e9tats des lieux et des justificatifs produits. Pour les peintures, le tribunal rel\u00e8ve des d\u00e9gradations sp\u00e9cifiques imputables au locataire mais applique aussi la r\u00e8gle d\u2019usage sur la dur\u00e9e de vie. &#171;Compte tenu de la dur\u00e9e d&#8217;occupation des lieux, bien sup\u00e9rieure \u00e0 la dur\u00e9e de vie th\u00e9orique des peintures, la locataire n&#8217;a pas \u00e0 prendre en charge d&#8217;autre r\u00e9fection&#187;. Cette analyse d\u00e9taill\u00e9e an\u00e9antit les demandes non justifi\u00e9es, comme le changement des portes ou la r\u00e9fection compl\u00e8te de la cuisine.<\/p>\n<p>La port\u00e9e de cette m\u00e9thode est significative. Elle impose aux bailleurs une charge probatoire rigoureuse et limite strictement l\u2019indemnisation aux seules d\u00e9gradations locatives av\u00e9r\u00e9es. Le rejet de la demande d\u2019indemnit\u00e9 pour perte de loyer illustre cette exigence. Les bailleurs &#171;chiffrent l&#8217;indemnit\u00e9 r\u00e9clam\u00e9e au montant du loyer annuel&#187;, ce qui &#171;n&#8217;a pas de lien apparent avec le dommage&#187;. Le tribunal refuse ainsi toute indemnisation forfaitaire ou sp\u00e9culative, prot\u00e9geant le locataire contre des demandes abusives. Cette approche restrictive rappelle que la remise en \u00e9tat ne saurait constituer une remise \u00e0 neuf aux frais du sortant.<\/p>\n<p>Le rejet des demandes indemnitaires accessoires<\/p>\n<p>Le tribunal \u00e9carte les pr\u00e9tentions des bailleurs fond\u00e9es sur un pr\u00e9judice moral et une perte de revenus locatifs. Concernant le pr\u00e9judice moral, les demandeurs &#171;ne pr\u00e9cisent aucunement en quoi ce pr\u00e9judice aurait consist\u00e9&#187;. Cette absence de preuve concr\u00e8te conduit \u00e0 un rejet pur et simple. Pour la perte de loyer, le tribunal rel\u00e8ve un d\u00e9faut de justification du lien de causalit\u00e9 et du quantum. Il note aussi que les bailleurs disposaient de ressources pour financer les travaux. &#171;Ces revenus, ainsi que le <a href=\"https:\/\/kohenavocats.fr\/avocat-depot-garantie-paris\/\" target=\"_blank\" title=\"d\u00e9p\u00f4t de garantie\">d\u00e9p\u00f4t de garantie<\/a>, sont cens\u00e9s leur permettre de financer les travaux sans attente&#187;. Ce raisonnement \u00e9carte l\u2019id\u00e9e d\u2019un pr\u00e9judice autonome li\u00e9 \u00e0 un d\u00e9lai de relouer.<\/p>\n<p>La valeur de ces solutions r\u00e9side dans le cantonnement strict de la responsabilit\u00e9 du locataire. Elle rappelle que les obligations post-contractuelles sont limit\u00e9es aux r\u00e9parations des d\u00e9gradations. Le tribunal refuse d\u2019\u00e9tendre la responsabilit\u00e9 \u00e0 des pr\u00e9judices \u00e9conomiques indirects ou immat\u00e9riels non caract\u00e9ris\u00e9s. Par ailleurs, il accueille la demande reconventionnelle concernant les travaux sur la chaudi\u00e8re. &#171;Les travaux de mise en conformit\u00e9 d&#8217;une chaudi\u00e8re \u00e9tant [&#8230;] \u00e0 la charge du bailleur&#187;, leur remboursement est ordonn\u00e9. Cette d\u00e9cision r\u00e9affirme l\u2019obligation de maintenance du bailleur, distincte des r\u00e9parations locatives.
