Elle se prononce sur la d\u00e9limitation pr\u00e9cise d&#8217;une parcelle acquise par prescription et sur les cons\u00e9quences d&#8217;empi\u00e8tements. L&#8217;arr\u00eat infirme le jugement pr\u00e9c\u00e9dent en red\u00e9finissant les limites et en ordonnant l&#8217;expulsion des occupants ainsi que la d\u00e9molition des constructions illicites. Il condamne \u00e9galement les auteurs des empi\u00e8tements \u00e0 des dommages et int\u00e9r\u00eats substantiels au profit des propri\u00e9taires l\u00e9s\u00e9s.<\/p>\n<p>La cons\u00e9cration de la prescription acquisitive dans ses limites<\/p>\n<p>La confirmation d&#8217;une propri\u00e9t\u00e9 partielle par prescription trentenaire. La cour rappelle que l&#8217;acquisition par prescription est d\u00e9finitivement \u00e9tablie par un arr\u00eat ant\u00e9rieur devenu irr\u00e9vocable. Cet arr\u00eat avait reconnu la propri\u00e9t\u00e9 d&#8217;une fraction de parcelle d&#8217;environ vingt-cinq ares au profit d&#8217;une famille. Cette d\u00e9cision s&#8217;appuie sur les conditions classiques de la possession requises par le code civil. &#171;Aux termes de l\u2019article 2261 du Code civil, pour pouvoir prescrire, il faut une possession continue et non interrompue, paisible, publique, non \u00e9quivoque, et \u00e0 titre de propri\u00e9taire.&#187; (Tribunal judiciaire de Thionville, le 16 juin 2025, n\u00b025\/00429) Le d\u00e9lai de trente ans est \u00e9galement rappel\u00e9 comme condition n\u00e9cessaire \u00e0 cette acquisition. &#171;Et aux termes de l&#8217;article 2272 du m\u00eame code, le <a href=\"https:\/\/kohenavocats.com\/avocats-en-droit-penal-a-paris-conseil-et-defense-strategique\/simulateur-prescription-penale\/\" target=\"_blank\" title=\"d\u00e9lai de prescription\">d\u00e9lai de prescription<\/a> requis pour acqu\u00e9rir la propri\u00e9t\u00e9 immobili\u00e8re est de trente ans en l&#8217;absence de titre.&#187; (Cour d&#8217;appel de Bastia, le 28 mai 2025, n\u00b024\/00250) La port\u00e9e de cette affirmation est de rendre intangible le droit de propri\u00e9t\u00e9 ainsi acquis, m\u00eame contre le titre originaire.<\/p>\n<p>La d\u00e9limitation stricte du p\u00e9rim\u00e8tre prescrit par les \u00e9l\u00e9ments topographiques et coutumiers. La cour proc\u00e8de \u00e0 une d\u00e9limitation pr\u00e9cise de la parcelle prescrite en s&#8217;appuyant sur un rapport d&#8217;expertise. Elle retient des limites fond\u00e9es sur des \u00e9l\u00e9ments naturels et des marqueurs traditionnels. L&#8217;expert a notamment pris en compte une ravine, une cl\u00f4ture ancienne et un sandragon, arbre local utilis\u00e9 pour le bornage. Le p\u00e9rim\u00e8tre ainsi d\u00e9fini forme un quasi-rectangle d&#8217;environ deux mille cinq cents m\u00e8tres carr\u00e9s. Cette m\u00e9thode consacre la valeur probante des usages locaux et de la topographie pour fixer les limites. Elle d\u00e9montre \u00e9galement que toute occupation exc\u00e9dant ce p\u00e9rim\u00e8tre pr\u00e9cis constitue un empi\u00e8tement sur la propri\u00e9t\u00e9 voisine.<\/p>\n<p>La sanction rigoureuse des empi\u00e8tements constat\u00e9s<\/p>\n<p>Le rejet des tentatives de r\u00e9gularisation et la condamnation \u00e0 l&#8217;expulsion. La cour constate que les occupants ont refus\u00e9 une proposition de rachat des parcelles empi\u00e9t\u00e9es. Elle rel\u00e8ve aussi que certaines constructions ont \u00e9t\u00e9 \u00e9difi\u00e9es en connaissance de cause sur le terrain d&#8217;autrui. D\u00e8s lors, elle ordonne l&#8217;expulsion des occupants de la zone d&#8217;empi\u00e8tement sous astreinte financi\u00e8re. Elle autorise \u00e9galement la d\u00e9molition des constructions illicites par les seuls propri\u00e9taires l\u00e9s\u00e9s. Cette solution affirme le caract\u00e8re absolu du droit de propri\u00e9t\u00e9 et son intangibilit\u00e9 en dehors des cas d&#8217;expropriation. &#171;En application des dispositions de l&#8217;article 545 du code civil, nul ne peut \u00eatre contraint de c\u00e9der sa propri\u00e9t\u00e9 si ce n&#8217;est pour cause d&#8217;utilit\u00e9 publique et moyennant une juste et pr\u00e9alable indemnit\u00e9.&#187; (Motifs de la d\u00e9cision) La port\u00e9e est claire : le juge refuse toute r\u00e9gularisation forc\u00e9e et impose la restitution pleine et enti\u00e8re.<\/p>\n<p>La r\u00e9paration int\u00e9grale du pr\u00e9judice subi par les propri\u00e9taires spoli\u00e9s. La cour alloue des dommages et int\u00e9r\u00eats distincts pour l&#8217;occupation ill\u00e9gitime et pour les frais futurs de d\u00e9molition. Elle condamne solidairement l&#8217;ensemble des occupants identifi\u00e9s \u00e0 payer ces sommes. Cette condamnation in solidum renforce la garantie de r\u00e9paration pour les propri\u00e9taires victimes. Elle sanctionne \u00e9galement les comportements proc\u00e9duraux en accordant une indemnit\u00e9 au titre de l&#8217;article 700 du code de proc\u00e9dure civile. La valeur de cette d\u00e9cision est d&#8217;assurer une r\u00e9paration compl\u00e8te, couvrant \u00e0 la fois le pr\u00e9judice pass\u00e9 et les d\u00e9penses \u00e0 venir.
