Une salari\u00e9e avait d\u00e9missionn\u00e9 apr\u00e8s avoir subi divers manquements de son employeur, notamment un d\u00e9faut de paiement d&#8217;<a href=\"https:\/\/kohenavocats.com\/avocats-droit-social-paris\/avocats-heures-supplementaires-paris\/\" target=\"_blank\" title=\"heures suppl\u00e9mentaires\">heures suppl\u00e9mentaires<\/a>. Le conseil de prud&#8217;hommes avait partiellement fait droit \u00e0 ses demandes. L&#8217;employeur et la salari\u00e9e font appel. La cour d&#8217;appel doit se prononcer sur la qualification de la rupture et sur les diverses demandes indemnitaires de la salari\u00e9e. La cour confirme la requalification de la d\u00e9mission en prise d&#8217;acte justifi\u00e9e et accorde d&#8217;importantes indemnit\u00e9s, notamment pour <a href=\"https:\/\/kohenavocats.com\/avocats-en-droit-penal-a-paris-conseil-et-defense-strategique\/avocats-travail-dissimule-paris\/\" target=\"_blank\" title=\"travail dissimul\u00e9\">travail dissimul\u00e9<\/a>.<\/p>\n<p>La caract\u00e9risation probatoire des heures suppl\u00e9mentaires non r\u00e9mun\u00e9r\u00e9es<\/p>\n<p>La charge de la preuve concernant les heures travaill\u00e9es est am\u00e9nag\u00e9e au b\u00e9n\u00e9fice du salari\u00e9. Le juge rappelle que face \u00e0 une demande pr\u00e9cise, c&#8217;est \u00e0 l&#8217;employeur de produire des \u00e9l\u00e9ments contraires. &#171;Il appartient au salari\u00e9 de pr\u00e9senter \u00e0 l&#8217;appui de sa demande, des \u00e9l\u00e9ments suffisamment pr\u00e9cis quant aux heures non r\u00e9mun\u00e9r\u00e9es qu&#8217;il pr\u00e9tend avoir accomplies afin de permettre \u00e0 l&#8217;employeur, qui assure le contr\u00f4le des heures de travail effectu\u00e9es, d&#8217;y r\u00e9pondre utilement en produisant ses propres \u00e9l\u00e9ments.&#187; (Motifs, 2-1) Le simple tableau \u00e9tabli par la salari\u00e9e, jug\u00e9 suffisamment d\u00e9taill\u00e9, inverse ainsi la charge de la preuve. L&#8217;employeur, qui \u00e9choue \u00e0 d\u00e9montrer la manipulation des relev\u00e9s de badgeage ou \u00e0 justifier les pauses et jours de r\u00e9cup\u00e9ration all\u00e9gu\u00e9s, voit sa contestation rejet\u00e9e. Cette solution consacre une approche pragmatique de la preuve, facilitant l&#8217;indemnisation du salari\u00e9 de bonne foi qui documente ses all\u00e9gations. Elle op\u00e8re une r\u00e9partition claire des obligations probatoires dans le contentieux du travail.<\/p>\n<p>La dissimulation caract\u00e9ris\u00e9e des heures ouvre droit \u00e0 une indemnit\u00e9 sp\u00e9cifique. La connaissance par l&#8217;employeur des d\u00e9passements horaires, via les relev\u00e9s de badgeage, et l&#8217;absence de paiement \u00e9tablissent l&#8217;\u00e9l\u00e9ment intentionnel. &#171;D\u00e8s lors, c&#8217;est sciemment que la SAS Florette France a dissimul\u00e9 ces heures, ce qui ouvre droit pour Mme [G] \u00e0 une indemnit\u00e9 forfaitaire \u00e9gale \u00e0 six mois de salaire.&#187; (Motifs, 2-3) Le calcul pr\u00e9cis de cette indemnit\u00e9, int\u00e9grant le salaire moyen et les rappels, en fait une sanction p\u00e9cuniaire significative. Cette condamnation a une port\u00e9e dissuasive forte. Elle vise \u00e0 punir les pratiques de travail dissimul\u00e9, qui privent le salari\u00e9 de sa r\u00e9mun\u00e9ration et l&#8217;organisme social de ses cotisations. La d\u00e9cision rappelle ainsi la s\u00e9v\u00e9rit\u00e9 du droit face \u00e0 la fraude aux heures travaill\u00e9es.<\/p>\n<p>La requalification de la rupture aux torts de l&#8217;employeur<\/p>\n<p>La d\u00e9mission \u00e9quivoque peut \u00eatre analys\u00e9e comme une prise d&#8217;acte justifi\u00e9e. Le contexte de la rupture, marqu\u00e9 par des dol\u00e9ances pr\u00e9alables et un arr\u00eat de travail, rend la volont\u00e9 du salari\u00e9 ambigu\u00eb. &#171;Ce contexte rend la d\u00e9mission de Mme [G] \u00e9quivoque. Il convient donc de la requalifier en prise d&#8217;acte.&#187; (Motifs, 3) Cette analyse rejoint la jurisprudence selon laquelle &#171;lorsque le salari\u00e9, sans invoquer un vice du consentement de nature \u00e0 entra\u00eener l&#8217;annulation de sa d\u00e9mission, remet en cause celle-ci en raison de faits ou manquements imputables \u00e0 son employeur, le juge doit, s&#8217;il r\u00e9sulte de circonstances ant\u00e9rieures ou contemporaines de la d\u00e9mission qu&#8217;\u00e0 la date \u00e0 laquelle elle a \u00e9t\u00e9 donn\u00e9e, celle-ci \u00e9tait \u00e9quivoque, l&#8217;analyser en une prise d&#8217;acte de la rupture&#187; (Cour d&#8217;appel de Versailles, le 4 janvier 2023, n\u00b021\/00327). La cour applique strictement ce principe, en recherchant les circonstances entourant l&#8217;acte de rupture.<\/p>\n<p>La prise d&#8217;acte produit ici les effets d&#8217;un licenciement sans cause. Le manquement grave de l&#8217;employeur, constitu\u00e9 par le d\u00e9faut de paiement des heures suppl\u00e9mentaires, justifie la rupture initi\u00e9e par le salari\u00e9. &#171;\u00c0 tout le moins, la SAS Florette France a manqu\u00e9 gravement \u00e0 ses obligations en ne r\u00e9mun\u00e9rant pas l&#8217;int\u00e9gralit\u00e9 des heures de travail accomplies par Mme [G], ce qui justifiait la rupture du contrat de travail.&#187; (Motifs, 3) La cour \u00e9carte cependant la qualification de licenciement nul, l&#8217;<a href=\"https:\/\/kohenavocats.com\/avocats-en-droit-penal-a-paris-conseil-et-defense-strategique\/avocat-harcelement-moral-paris\/\" target=\"_blank\" title=\"harc\u00e8lement moral\">harc\u00e8lement moral<\/a> et la discrimination n&#8217;\u00e9tant pas \u00e9tablis. Cette solution distingue nettement la gravit\u00e9 des manquements. Elle offre au salari\u00e9 une indemnisation pour licenciement injustifi\u00e9, tout en refusant la sanction plus lourde de la nullit\u00e9, r\u00e9serv\u00e9e aux atteintes aux libert\u00e9s fondamentales.<\/p>\n<p>Le calcul des dommages-int\u00e9r\u00eats pour licenciement sans cause ob\u00e9it au bar\u00e8me l\u00e9gal. La cour rejette l&#8217;argument fond\u00e9 sur la Charte sociale europ\u00e9enne, jug\u00e9e non d&#8217;effet direct. Elle estime en revanche que le bar\u00e8me de l&#8217;article L. 1235-3 du code du travail, par sa flexibilit\u00e9, est compatible avec la convention n\u00b0158 de l&#8217;OIT. &#171;Les dispositions de l&#8217;article L. 1235-3 du code du travail \u00e9tant, en cons\u00e9quence, compatibles avec les stipulations de l&#8217;article 10 de la Convention pr\u00e9cit\u00e9e, la situation concr\u00e8te du salari\u00e9 ne peut \u00eatre prise en compte que pour d\u00e9terminer le montant de l&#8217;indemnit\u00e9 due entre les montants minimaux et maximaux d\u00e9termin\u00e9s par l&#8217;article L. 1235-3 du code du travail.&#187; (Motifs, 3) La cour use de cette marge pour fixer une indemnit\u00e9 de 10 000 euros, tenant compte de l&#8217;anciennet\u00e9, du salaire et de la rapidit\u00e9 du reclassement.
