La soci\u00e9t\u00e9 employeur, plac\u00e9e en liquidation judiciaire, conteste la qualification de cause r\u00e9elle et s\u00e9rieuse retenue par les premiers juges. Elle invoquait initialement une faute grave fond\u00e9e sur un abandon de poste. La cour confirme le jugement en \u00e9cartant la faute grave mais proc\u00e8de \u00e0 un nouveau calcul de certaines indemnit\u00e9s dues au salari\u00e9.<\/p>\n<p>La qualification du licenciement et l&#8217;exercice du pouvoir de direction<\/p>\n<p>La r\u00e9affectation du salari\u00e9 constitue une simple modification des conditions de travail. La d\u00e9cision rel\u00e8ve d&#8217;une r\u00e9organisation rendue n\u00e9cessaire par la perte d&#8217;un march\u00e9 par l&#8217;employeur. &#171;Le seul changement de lieu d&#8217;affectation au sein d&#8217;une m\u00eame zone g\u00e9ographique, \u00e0 savoir de [Localit\u00e9 5] \u00e0 [Localit\u00e9 3] \u00e0 une distance de moins de 30 kilom\u00e8tres, constitue dans le cas de cette relation contractuelle un simple changement des conditions de travail relevant du pouvoir de direction du chef d&#8217;entreprise, et non une modification du contrat de travail requ\u00e9rant l&#8217;accord du salari\u00e9.&#187; (Motifs de l&#8217;arr\u00eat). La cour rappelle que la bonne foi de l&#8217;employeur est pr\u00e9sum\u00e9e en cette mati\u00e8re. Le refus du salari\u00e9 de se rendre sur le nouveau site, malgr\u00e9 une mise en demeure, caract\u00e9rise donc une absence injustifi\u00e9e.<\/p>\n<p>L&#8217;absence de faute grave malgr\u00e9 un comportement fautif du salari\u00e9<\/p>\n<p>Le refus d&#8217;obtemp\u00e9rer ne suffit pas \u00e0 caract\u00e9riser une faute grave en l&#8217;esp\u00e8ce. La cour rel\u00e8ve des circonstances att\u00e9nuantes dans la mise en \u0153uvre de la r\u00e9organisation. &#171;En l&#8217;esp\u00e8ce cette r\u00e9affectation est intervenue dans une certaine pr\u00e9cipitation \u00e0 l&#8217;\u00e9gard de plusieurs salari\u00e9s alors que la soci\u00e9t\u00e9 intervient sur de nombreux sites et le salari\u00e9 n&#8217;ayant \u00e9t\u00e9 pr\u00e9venu que par mail quelques jours avant et sans aucune explication.&#187; (Motifs de l&#8217;arr\u00eat). L&#8217;employeur n&#8217;a pas r\u00e9pondu aux difficult\u00e9s de transport soulev\u00e9es par le salari\u00e9. Ainsi, bien que le comportement soit fautif, il ne rev\u00eat pas le caract\u00e8re de gravit\u00e9 n\u00e9cessaire. Cette solution rejoint une jurisprudence selon laquelle des faits \u00e9tablis et fautifs ne sont pas toujours suffisamment s\u00e9rieux pour justifier un <a href=\"https:\/\/kohenavocats.com\/avocats-droit-social-paris\/avocats-licenciement-faute-paris\/\" target=\"_blank\" title=\"licenciement pour faute\">licenciement pour faute<\/a> grave.<\/p>\n<p>La fixation des indemnit\u00e9s en cas de cause r\u00e9elle et s\u00e9rieuse<\/p>\n<p>Le reclassement du licenciement entra\u00eene la r\u00e9vision du calcul des sommes dues. Le salari\u00e9 a droit \u00e0 un <a href=\"https:\/\/kohenavocats.com\/avocats-droit-social-paris\/avocats-heures-supplementaires-paris\/\" target=\"_blank\" title=\"rappel de salaire\">rappel de salaire<\/a> pour la p\u00e9riode de mise \u00e0 pied conservatoire. La cour recalcule pr\u00e9cis\u00e9ment cette somme ainsi que l&#8217;indemnit\u00e9 l\u00e9gale de licenciement. En revanche, la p\u00e9riode d&#8217;absence injustifi\u00e9e ant\u00e9rieure \u00e0 la mise \u00e0 pied est exclue de tout rappel de salaire. &#171;La mise \u00e0 pied conservatoire s&#8217;\u00e9tend sur 21 jours (&#8230;) et ne couvre pas la p\u00e9riode d&#8217;absence injustifi\u00e9e sur la p\u00e9riode ant\u00e9rieure, lors de laquelle le salari\u00e9 ne se tenait pas \u00e0 la disposition de son employeur&#187; (Motifs de l&#8217;arr\u00eat). Les autres demandes indemnitaires du salari\u00e9 sont \u00e9cart\u00e9es, conform\u00e9ment au r\u00e9gime du licenciement pour cause r\u00e9elle et s\u00e9rieuse.<\/p>\n<p>Les effets de la liquidation judiciaire sur la cr\u00e9ance du salari\u00e9<\/p>\n<p>La <a href=\"https:\/\/kohenavocats.fr\/elementor-60\/avocats-droit-affaires-paris\/avocat-procedures-collectives-paris\/\" target=\"_blank\" title=\"proc\u00e9dure collective\">proc\u00e9dure collective<\/a> affecte les modalit\u00e9s de paiement et les garanties applicables. La cour rappelle que la liquidation judiciaire suspend le cours des int\u00e9r\u00eats l\u00e9gaux. Elle ordonne la remise des documents de fin de contrat par le mandataire liquidateur. Surtout, elle d\u00e9clare la cr\u00e9ance opposable \u00e0 l&#8217;AGS et b\u00e9n\u00e9ficiant de sa garantie. &#171;La cr\u00e9ance b\u00e9n\u00e9ficie de la garantie l\u00e9gale de l&#8217;AGS dans les conditions pr\u00e9vues aux dispositions des articles L.3253-6 et suivants du code du travail&#187; (Motifs de l&#8217;arr\u00eat). Cette disposition assure au salari\u00e9 le paiement de ses indemnit\u00e9s malgr\u00e9 l&#8217;insolvabilit\u00e9 de l&#8217;employeur, dans les limites l\u00e9gales.<\/p>\n<p>Cet arr\u00eat rappelle avec pr\u00e9cision la distinction entre modification du contrat et changement des conditions de travail. Il d\u00e9montre que l&#8217;exercice du pouvoir de direction, bien que l\u00e9gitime, doit \u00eatre mis en \u0153uvre avec un certain formalisme. La cour sanctionne un d\u00e9faut de communication et d&#8217;accompagnement du salari\u00e9 face \u00e0 une r\u00e9organisation. Cela prive l&#8217;employeur de la qualification de faute grave, pourtant initialement vis\u00e9e. La d\u00e9cision prot\u00e8ge ainsi le salari\u00e9 d&#8217;une privation trop s\u00e9v\u00e8re de ses droits tout en reconnaissant son comportement fautif.
