Un salari\u00e9 titulaire d&#8217;un contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e intermittent avait refus\u00e9 une modification de son contrat propos\u00e9e par son employeur, une association sportive. Suite \u00e0 ce refus, son emploi fut supprim\u00e9. Le salari\u00e9 contestait la r\u00e9alit\u00e9 du motif \u00e9conomique et le respect de l&#8217;obligation de reclassement. La cour d&#8217;appel a confirm\u00e9 la r\u00e9gularit\u00e9 du licenciement, estimant que l&#8217;association justifiait de difficult\u00e9s \u00e9conomiques et avait satisfait \u00e0 son obligation de reclassement.<\/p>\n<p>La caract\u00e9risation des difficult\u00e9s \u00e9conomiques dans une association<\/p>\n<p>L&#8217;appr\u00e9ciation du motif \u00e9conomique invoqu\u00e9 par l&#8217;employeur constitue le premier temps de l&#8217;analyse. La cour rappelle que la charge de la preuve p\u00e8se int\u00e9gralement sur ce dernier. Il lui appartient de d\u00e9montrer la r\u00e9alit\u00e9 des difficult\u00e9s au moment de la rupture. La d\u00e9cision pr\u00e9cise que &#171;l&#8217;appr\u00e9ciation des difficult\u00e9s \u00e9conomiques et la r\u00e9organisation de l&#8217;entreprise n\u00e9cessaire \u00e0 la sauvegarde de sa comp\u00e9titivit\u00e9, ne diff\u00e8re pas au sein d&#8217;une association&#187; (Cour d&#8217;appel de Versailles, le 22 mai 2024, n\u00b022\/01634). Le statut associatif n&#8217;offre donc pas de r\u00e9gime d\u00e9rogatoire pour justifier un <a href=\"https:\/\/kohenavocats.com\/avocats-droit-social-paris\/avocats-licenciement-economique-paris\/\" target=\"_blank\" title=\"licenciement \u00e9conomique\">licenciement \u00e9conomique<\/a>.<\/p>\n<p>La port\u00e9e de cette analyse est confirm\u00e9e par l&#8217;examen des indicateurs financiers de la structure. La cour rel\u00e8ve une baisse constante des recettes, principalement issues des cotisations, sur trois exercices. Elle constate \u00e9galement une diminution significative et durable du nombre d&#8217;adh\u00e9rents. Ces \u00e9l\u00e9ments permettent de caract\u00e9riser des difficult\u00e9s \u00e9conomiques au sens de l&#8217;article L. 1233-3 du code du travail. La solution affirme ainsi que les associations sont soumises aux m\u00eames exigences probatoires que les entreprises commerciales. Leur p\u00e9rennit\u00e9 financi\u00e8re constitue un imp\u00e9ratif pouvant l\u00e9gitimer une suppression d&#8217;emploi.<\/p>\n<p>Les contours de l&#8217;obligation de reclassement en l&#8217;absence de groupe<\/p>\n<p>Le second volet concerne le respect de l&#8217;obligation de recherche de reclassement pr\u00e9alable au licenciement. La cour rappelle le principe selon lequel &#171;c&#8217;est \u00e0 l&#8217;employeur qu&#8217;il revient de prouver qu&#8217;il s&#8217;est acquitt\u00e9 de son obligation de reclassement&#187; (Cour d&#8217;appel de Versailles, le 22 mai 2024, n\u00b022\/01634). Cette charge implique de d\u00e9montrer soit des recherches actives, soit l&#8217;impossibilit\u00e9 absolue d&#8217;un reclassement. Le refus du salari\u00e9 d&#8217;une modification contractuelle ne dispense en aucun cas l&#8217;employeur de cette obligation pr\u00e9alable.<\/p>\n<p>La valeur de l&#8217;arr\u00eat r\u00e9side dans la d\u00e9finition du p\u00e9rim\u00e8tre de cette recherche. Le salari\u00e9 soutenait que l&#8217;obligation devait s&#8217;\u00e9tendre aux autres associations membres de la f\u00e9d\u00e9ration. La cour \u00e9carte cette argumentation en pr\u00e9cisant que l&#8217;appartenance \u00e0 une f\u00e9d\u00e9ration sportive ne cr\u00e9e pas un groupe au sens juridique du terme. Elle motive sa d\u00e9cision en indiquant que les clubs &#171;g\u00e8rent localement de mani\u00e8re totalement autonome leur propre activit\u00e9 et le recrutement des moniteurs dont elles peuvent avoir besoin sans possibilit\u00e9 de mutation ou de mise \u00e0 disposition&#187; (Cour d&#8217;appel de Versailles, le 22 mai 2024, n\u00b022\/01634).
