Le bailleur social agit contre la locataire, rest\u00e9e d\u00e9faillante malgr\u00e9 un commandement. La juridiction statue par d\u00e9faut apr\u00e8s une absence \u00e0 l\u2019audience. Elle doit d\u00e9terminer si le manquement justifie la r\u00e9siliation et l\u2019expulsion. La solution retenue accueille les demandes principales du bailleur et rejette les demandes accessoires.<\/p>\n<p>Le r\u00e9gime de la r\u00e9siliation pour d\u00e9faut de paiement<\/p>\n<p>L\u2019application du d\u00e9lai l\u00e9gal dans les contrats en cours. Le juge rappelle le principe de non-r\u00e9troactivit\u00e9 de la loi nouvelle aux contrats en cours. La loi du 27 juillet 2023 a r\u00e9duit le d\u00e9lai de gr\u00e2ce apr\u00e8s commandement de deux mois \u00e0 six semaines. &#171;Toutefois, ce nouveau d\u00e9lai de 6 semaines n\u2019est pas applicable aux baux conclus ant\u00e9rieurement \u00e0 l\u2019entr\u00e9e en vigueur de la nouvelle loi&#187; (Motifs). La d\u00e9cision s\u2019appuie sur l\u2019article 2 du code civil et un avis de la Cour de cassation. Elle prot\u00e8ge ainsi la s\u00e9curit\u00e9 juridique et les droits acquis du locataire li\u00e9s \u00e0 son contrat ancien.<\/p>\n<p>La caract\u00e9risation d\u2019un manquement suffisamment grave. Le d\u00e9faut de paiement persistant constitue une violation d\u2019une obligation essentielle du contrat. &#171;Le paiement du loyer et des charges est une obligation essentielle du contrat de location&#187; (Motifs, sur le fondement de l\u2019article 7 de la loi de 1989). La preuve est rapport\u00e9e par le bailleur via le relev\u00e9 de compte et le commandement demeur\u00e9 infructueux. Aucune r\u00e9gularisation totale ni demande de d\u00e9lai de gr\u00e2ce n\u2019est intervenue dans le d\u00e9lai contractuel de deux mois. Ce manquement objectif est donc suffisamment grave pour fonder la r\u00e9siliation, confirmant une jurisprudence constante. &#171;Le d\u00e9faut de paiement pendant plusieurs mois caract\u00e9rise un manquement contractuel de nature \u00e0 justifier la r\u00e9siliation du contrat de bail aux torts du locataire&#187; (Tribunal judiciaire de Chartres, le 14 janvier 2025, n\u00b024\/02863).<\/p>\n<p>Les suites de la r\u00e9siliation et le rejet des demandes accessoires<\/p>\n<p>Les cons\u00e9quences l\u00e9gales : expulsion et indemnit\u00e9 d\u2019occupation. La r\u00e9siliation prend effet \u00e0 la date d\u2019expiration du d\u00e9lai contractuel, soit le 20 octobre 2024. L\u2019occupation devient d\u00e8s lors sans titre et g\u00e9n\u00e8re une indemnit\u00e9 due au bailleur. &#171;Madame [D] [E] occupe d\u00e9sormais les lieux sans droit, ni titre, et cause, par ce fait, un pr\u00e9judice au bailleur&#187; (Motifs). L\u2019expulsion est ordonn\u00e9e avec un d\u00e9lai de deux mois apr\u00e8s commandement de quitter les lieux. La d\u00e9cision rappelle cependant les recours possibles pour le relogement aupr\u00e8s du juge de l\u2019ex\u00e9cution ou de la commission du DALO. Cette mesure \u00e9quilibre le droit du propri\u00e9taire et la <a href=\"https:\/\/kohenavocats.com\/avocats-droit-social-paris\/avocats-protection-sociale-retraite-paris\/\" target=\"_blank\" title=\"protection sociale\">protection sociale<\/a> de l\u2019occupant.<\/p>\n<p>Le rejet de la demande de dommages-int\u00e9r\u00eats pour r\u00e9sistance abusive. Le bailleur invoquait un pr\u00e9judice distinct li\u00e9 \u00e0 la mauvaise foi du locataire. Le juge exige la preuve d\u2019un pr\u00e9judice autonome, distinct du simple retard de paiement. &#171;La SA d&#8217;HLM PARTELIOS HABITAT doit pouvoir justifier un pr\u00e9judice distinct de celui caus\u00e9 par le d\u00e9faut de paiement de la dette&#187; (Motifs). Cette exigence stricte prot\u00e8ge le d\u00e9biteur contre des sanctions disproportionn\u00e9es. Elle cadre l\u2019application de l\u2019article 1231-6 du code civil en exigeant une d\u00e9monstration concr\u00e8te de la mauvaise foi et du pr\u00e9judice sp\u00e9cifique. Seule une indemnit\u00e9 forfaitaire au titre de l\u2019article 700 du CPC est allou\u00e9e pour les frais irr\u00e9p\u00e9tibles.<\/p>\n<p>Cette d\u00e9cision illustre rigueur proc\u00e9durale et protection des \u00e9quilibres contractuels. Elle applique avec pr\u00e9cision le droit transitoire pour pr\u00e9server la stabilit\u00e9 des conventions. La gravit\u00e9 du manquement est appr\u00e9ci\u00e9e objectivement, fondant une r\u00e9siliation justifi\u00e9e. &#171;La gravit\u00e9 du manquement aux obligations d\u00e9coulant du bail est ainsi suffisamment caract\u00e9ris\u00e9e, justifiant la r\u00e9siliation du contrat aux torts exclusifs du d\u00e9fendeur et son expulsion&#187; (Tribunal judiciaire, le 30 janvier 2025, n\u00b024\/00810).
