Ce dernier invoquait l\u2019origine professionnelle de son inaptitude suite \u00e0 un \u00e9v\u00e9nement survenu en mars 2018. La cour a rejet\u00e9 sa demande d\u2019audition de t\u00e9moins et a confirm\u00e9 le jugement de premi\u00e8re instance qui avait d\u00e9bout\u00e9 le salari\u00e9 de l\u2019ensemble de ses pr\u00e9tentions. La solution retenue d\u00e9nie le caract\u00e8re professionnel de l\u2019inaptitude et valide le licenciement.<\/p>\n<p>La preuve contraignante de l\u2019accident du travail<\/p>\n<p>La charge de la preuve incombe au salari\u00e9 qui invoque un accident. Le juge rappelle que le salari\u00e9 doit \u00e9tablir la mat\u00e9rialit\u00e9 de l\u2019\u00e9v\u00e9nement soudain et sa survenance au temps et au lieu du travail. &#171;Il appartient au salari\u00e9 d&#8217;apporter la preuve de la mat\u00e9rialit\u00e9 de l&#8217;accident et de sa survenance au temps et au lieu du travail&#187; (Motifs). Cette preuve ne peut reposer sur ses seules d\u00e9clarations et n\u00e9cessite des \u00e9l\u00e9ments objectifs et concordants.<\/p>\n<p>L\u2019examen des pi\u00e8ces a r\u00e9v\u00e9l\u00e9 des contradictions entre les versions des parties. Les attestations de coll\u00e8gues et du m\u00e9decin du travail ne corroboraient pas le r\u00e9cit du salari\u00e9. &#171;Les attestations de Messieurs [T] et [U] ainsi que de celle du m\u00e9decin du travail, le Dr [D], ne permettent donc pas de confirmer les affirmations de Monsieur [X]&#187; (Motifs). La cour a \u00e9galement relev\u00e9 l\u2019absence de prescription d\u2019arr\u00eat de travail le jour m\u00eame et une d\u00e9cision judiciaire ant\u00e9rieure infirmant l\u2019existence de l\u2019accident.<\/p>\n<p>Cette analyse consacre une application stricte des conditions de preuve de l\u2019accident du travail. Elle rappelle que les pr\u00e9somptions ne jouent qu\u2019une fois la mat\u00e9rialit\u00e9 de l\u2019\u00e9v\u00e9nement \u00e9tablie. La port\u00e9e est significative pour les salari\u00e9s, qui doivent consolider leur all\u00e9gation par des \u00e9l\u00e9ments ext\u00e9rieurs probants d\u00e8s le stade du contentieux.<\/p>\n<p>L\u2019exclusion du statut protecteur faute de lien \u00e9tabli<\/p>\n<p>L\u2019application des r\u00e8gles protectrices est subordonn\u00e9e \u00e0 la d\u00e9monstration d\u2019un lien de causalit\u00e9. La cour rappelle le cadre l\u00e9gal issu des articles L. 1226-6 et suivants du code du travail. &#171;Les r\u00e8gles protectrices applicables aux victimes d&#8217;un accident du travail [&#8230;] s&#8217;appliquent d\u00e8s lors que l&#8217;inaptitude du salari\u00e9 [&#8230;] a, au moins partiellement, pour origine cet accident ou cette maladie&#187; (Motifs). Ce dispositif exige \u00e9galement que l\u2019employeur ait eu connaissance de cette origine au moment du licenciement.<\/p>\n<p>En l\u2019esp\u00e8ce, le d\u00e9faut de preuve de l\u2019accident entra\u00eene m\u00e9caniquement l\u2019impossibilit\u00e9 d\u2019\u00e9tablir son origine professionnelle. &#171;Il n&#8217;est pas \u00e9tabli que, le 1er mars 2018, Monsieur [X] a \u00e9t\u00e9 victime d&#8217;un accident du travail pouvant \u00eatre \u00e0 l&#8217;origine de son inaptitude&#187; (Motifs). D\u00e8s lors, le licenciement pour inaptitude, d\u00e9pourvu de cette cause professionnelle, est jug\u00e9 fond\u00e9 et le r\u00e9gime protecteur inapplicable.<\/p>\n<p>Cette d\u00e9cision illustre la jurisprudence constante exigeant un lien certain entre l\u2019accident et l\u2019inaptitude. &#171;Les r\u00e8gles protectrices [&#8230;] s&#8217;appliquent d\u00e8s lors que l&#8217;inaptitude du salari\u00e9, quel que soit le moment o\u00f9 elle est constat\u00e9e ou invoqu\u00e9e, a, au moins partiellement, pour origine cet accident ou cette maladie&#187; (Cour d&#8217;appel de Versailles, le 29 juin 2022, n\u00b020\/01170). La valeur de l\u2019arr\u00eat r\u00e9side dans son rappel que la simple invocation d\u2019un \u00e9v\u00e9nement, sans preuve suffisante, ne suffit pas \u00e0 activer ce statut d\u00e9rogatoire.
