Un copropri\u00e9taire, titulaire d\u2019un lot, a laiss\u00e9 subsister un arri\u00e9r\u00e9 modeste de charges. Le syndicat a d\u00e9livr\u00e9 une mise en demeure puis une assignation au printemps 2024, r\u00e9clamant le principal, les int\u00e9r\u00eats, la capitalisation, des frais de recouvrement et des dommages-int\u00e9r\u00eats. \u00c0 l\u2019audience, le principal a \u00e9t\u00e9 ajust\u00e9 \u00e0 16,80 euros, tandis que le d\u00e9fendeur contestait le d\u00e9compte, les int\u00e9r\u00eats et la capitalisation, et sollicitait diverses d\u00e9ductions ainsi qu\u2019une restitution de sommes pr\u00e9tendument ind\u00fbment port\u00e9es en compte. La question portait sur l\u2019exigibilit\u00e9 des charges apr\u00e8s approbation des comptes, le point de d\u00e9part et le r\u00e9gime des int\u00e9r\u00eats, la prise en charge des frais n\u00e9cessaires, et la caract\u00e9risation d\u2019un pr\u00e9judice distinct justifiant des dommages-int\u00e9r\u00eats. La d\u00e9cision retient le principe d\u2019exigibilit\u00e9, fait courir les int\u00e9r\u00eats \u00e0 compter de l\u2019assignation, ordonne la capitalisation, limite les frais de recouvrement, alloue des dommages-int\u00e9r\u00eats et rejette les demandes reconventionnelles.<\/p>\n<p>I. Exigibilit\u00e9 des charges et r\u00e9gime des int\u00e9r\u00eats<\/p>\n<p>A. L\u2019effet de l\u2019approbation des comptes sur la certitude de la cr\u00e9ance<br \/>\nLa d\u00e9cision rappelle le double fondement l\u00e9gal et pr\u00e9torien de l\u2019obligation contributive. Elle vise l\u2019article 10 de la loi du 10 juillet 1965 et souligne l\u2019autorit\u00e9 attach\u00e9e aux comptes approuv\u00e9s. Le juge \u00e9nonce ainsi que \u00ab L&#8217;approbation des comptes du syndic par l&#8217;assembl\u00e9e g\u00e9n\u00e9rale rend certaine, liquide et exigible la cr\u00e9ance du syndicat des copropri\u00e9taires relative \u00e0 chaque quote-part de charges \u00bb. La r\u00e8gle est compl\u00e9t\u00e9e par l\u2019article 42, qui impose de contester les r\u00e9solutions dans des d\u00e9lais contraints, \u00e0 peine de forclusion. L\u2019argumentation adverse, limit\u00e9e \u00e0 des contestations g\u00e9n\u00e9rales du d\u00e9compte et \u00e0 des imputations discut\u00e9es, ne remettait pas en cause l\u2019approbation intervenue. L\u2019esp\u00e8ce conduit logiquement \u00e0 retenir une cr\u00e9ance arr\u00eat\u00e9e au 9 janvier 2025, pour un solde r\u00e9siduel de 16,80 euros, dont l\u2019exigibilit\u00e9 est ind\u00e9pendante du faible montant final.<\/p>\n<p>Cette motivation s\u2019inscrit dans une ligne constante, distinguant la contestation de l\u2019utilit\u00e9 des d\u00e9penses, enferm\u00e9e dans le contentieux de l\u2019assembl\u00e9e g\u00e9n\u00e9rale, et la simple ex\u00e9cution de la r\u00e9partition vot\u00e9e. L\u2019\u00e9conomie du r\u00e9gime de la copropri\u00e9t\u00e9 tient \u00e0 cette stabilit\u00e9 des comptes, condition de la tr\u00e9sorerie commune et de la pr\u00e9visibilit\u00e9 budg\u00e9taire.<\/p>\n<p>B. Point de d\u00e9part et capitalisation des int\u00e9r\u00eats<br \/>\nLe juge fixe le dies a quo en ces termes: \u00ab Attendu que les int\u00e9r\u00eats au taux l\u00e9gal courent \u00e0 compter de l\u2019assignation. \u00bb Ce choix refl\u00e8te la fonction d\u2019interpellation de l\u2019acte introductif d\u2019instance lorsque la mise en demeure n\u2019est pas retenue comme point de d\u00e9part utile, faute d\u2019\u00e9tablir une mise en demeure pleinement op\u00e9rante pour toutes sommes dues. La solution se justifie au regard de la nature de l\u2019obligation p\u00e9cuniaire litigieuse, devenue exigible par l\u2019approbation, mais encore discut\u00e9e quant \u00e0 son quantum r\u00e9siduel. La capitalisation est ensuite ordonn\u00e9e par une formule sans ambigu\u00eft\u00e9: \u00ab Attendu qu\u2019en vertu de l\u2019article 1343-2 du Code civil il convient de prononcer la capitalisation des int\u00e9r\u00eats. \u00bb Elle suppose des int\u00e9r\u00eats dus pour au moins une ann\u00e9e r\u00e9volue, condition que la juridiction appr\u00e9cie in concreto, dans une logique de r\u00e9paration int\u00e9grale, sans cr\u00e9ation d\u2019une p\u00e9nalit\u00e9 autonome.<\/p>\n<p>Cette articulation pr\u00e9serve l\u2019\u00e9quilibre entre l\u2019exigibilit\u00e9 n\u00e9e des comptes et la mod\u00e9ration du pr\u00e9judice temporel, ramen\u00e9 au taux l\u00e9gal, tout en r\u00e9servant la sanction de la dur\u00e9e par l\u2019anatocisme sous contr\u00f4le judiciaire. Elle rappelle aussi l\u2019utilit\u00e9 pratique de formaliser la mise en demeure quand des int\u00e9r\u00eats ant\u00e9rieurs \u00e0 l\u2019assignation sont recherch\u00e9s.<\/p>\n<p>II. Frais n\u00e9cessaires, dommages-int\u00e9r\u00eats et port\u00e9e de la d\u00e9cision<\/p>\n<p>A. Frais de recouvrement: n\u00e9cessit\u00e9, imputabilit\u00e9 et proportion<br \/>\nLa juridiction rappelle le principe d\u2019imputation sp\u00e9ciale issu de la loi de 1965: \u00ab sont imputables au seul copropri\u00e9taire concern\u00e9 les frais n\u00e9cessaires expos\u00e9s par le demandeur \u00bb. Encore faut-il que ces frais soient justifi\u00e9s, proportionn\u00e9s et rattach\u00e9s \u00e0 une cr\u00e9ance fond\u00e9e. Apr\u00e8s examen du dossier et de l\u2019ampleur r\u00e9elle du solde, le juge limite leur montant et tranche avec nettet\u00e9: \u00ab Attendu que les frais seront fix\u00e9s \u00e0 la somme de 250,00 euros. \u00bb La modulation r\u00e9pond au crit\u00e8re de n\u00e9cessit\u00e9 et tient compte de la modestie du principal exigible, malgr\u00e9 la r\u00e9alit\u00e9 des diligences utiles, notamment la mise en demeure et l\u2019assignation.<\/p>\n<p>La coh\u00e9rence de la solution repose sur un double filtre, probatoire et proportionnel, qui \u00e9vite la d\u00e9rive des frais accessoires lorsque l\u2019enjeu financier s\u2019est r\u00e9duit au fil de la proc\u00e9dure. Le rejet des demandes reconventionnelles, \u00ab Rejette les demandes reconventionnelles sollicit\u00e9es par la d\u00e9fenderesse \u00bb, confirme l\u2019absence de preuve suffisante d\u2019imputations indues, et cl\u00f4t le d\u00e9bat comptable r\u00e9siduel.<\/p>\n<p>B. Dommages-int\u00e9r\u00eats distincts et ex\u00e9cution provisoire<br \/>\nLe juge rappelle le standard l\u00e9gal du pr\u00e9judice ind\u00e9pendant du simple retard, sp\u00e9cialement lorsqu\u2019une d\u00e9faillance compromet la tr\u00e9sorerie collective. Il motive la condamnation par une affirmation circonstanci\u00e9e: \u00ab La carence du d\u00e9fendeur \u00e0 payer les charges a caus\u00e9 des difficult\u00e9s de tr\u00e9sorerie au syndicat des copropri\u00e9taires. \u00bb Le montant retenu, 200 euros, demeure mesur\u00e9, traduisant une appr\u00e9ciation concr\u00e8te du trouble de gestion caus\u00e9 par l\u2019avance forc\u00e9e de fonds. L\u2019octroi distinct des int\u00e9r\u00eats moratoires et de ce poste sp\u00e9cifique illustre la dualit\u00e9 des fonctions, compensatoire et moratoire, dans le contentieux des charges.<\/p>\n<p>La port\u00e9e pratique de l\u2019arr\u00eat se lit enfin dans la d\u00e9cision d\u2019ex\u00e9cution imm\u00e9diate: \u00ab Dit que l\u2019ex\u00e9cution provisoire est de droit. \u00bb Depuis la r\u00e9forme, l\u2019ex\u00e9cution provisoire de droit constitue le principe, sauf exclusion motiv\u00e9e. En mati\u00e8re de charges, la solution r\u00e9pond \u00e0 l\u2019int\u00e9r\u00eat sup\u00e9rieur de la collectivit\u00e9, dont l\u2019\u00e9quilibre budg\u00e9taire d\u00e9pend d\u2019un recouvrement rapide. Cette affirmation renforce l\u2019effectivit\u00e9 de la cr\u00e9ance, tout en laissant au juge d\u2019appel, le cas \u00e9ch\u00e9ant, la facult\u00e9 d\u2019en appr\u00e9cier la continuation.<\/p>\n<p>L\u2019ensemble compose une d\u00e9cision p\u00e9dagogique et pragmatique. Elle confirme l\u2019autorit\u00e9 des comptes approuv\u00e9s, fixe avec sobri\u00e9t\u00e9 le r\u00e9gime des int\u00e9r\u00eats et de leur capitalisation, contr\u00f4le strictement les frais n\u00e9cessaires, et admet des dommages-int\u00e9r\u00eats distincts lorsque la tr\u00e9sorerie commune a \u00e9t\u00e9 atteinte. Reste alors \u00e0 souligner la coh\u00e9rence de la r\u00e9ponse apport\u00e9e aux pr\u00e9tentions antagonistes et la clart\u00e9 des formules d\u00e9cisoires, gages de s\u00e9curit\u00e9 pour la pratique des copropri\u00e9t\u00e9s.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Tribunal judiciaire de [Localit\u00e9 4], 20 juin 2025.
