Elle tranche un litige n\u00e9 d\u2019une d\u00e9claration d\u2019\u00ab absence de sinistre \u00bb ins\u00e9r\u00e9e dans l\u2019acte, malgr\u00e9 d\u2019anciens mouvements de terrain reconnus en catastrophe naturelle.<\/p>\n<p>Une maison a \u00e9t\u00e9 vendue en 2014, l\u2019acte comprenant une d\u00e9claration d\u2019\u00ab absence de sinistre \u00bb et une clause relative \u00e0 l\u2019\u00e9tat des constructions. Un accord amiable de septembre 2014 a financ\u00e9 une \u00e9tanch\u00e9it\u00e9 partielle du sous-sol, sans viser des d\u00e9sordres structurels imput\u00e9s \u00e0 des mouvements de terrain. En 2016, les acqu\u00e9reurs constatent une fissure horizontale au mur enterr\u00e9 et font diligenter des expertises, lesquelles mettent en \u00e9vidence d\u2019anciens sinistres.<\/p>\n<p>Par r\u00e9f\u00e9r\u00e9, une expertise judiciaire est ordonn\u00e9e et men\u00e9e jusqu\u2019en 2020. Une assignation au fond suit en 2021; le tribunal judiciaire de Melun, le 14 f\u00e9vrier 2023, rejette toutes demandes indemnitaires. Les acqu\u00e9reurs interjettent appel, soutenant un dol par r\u00e9ticence, les vendeurs opposant la transaction ant\u00e9rieure et l\u2019absence d\u2019intention de tromper.<\/p>\n<p>La question portait sur la qualification d\u2019une r\u00e9ticence dolosive en cas de non-divulgation d\u2019un sinistre indemnis\u00e9 et de travaux structurels significatifs. La cour l\u2019admet, \u00e9carte l\u2019effet exon\u00e9ratoire de la transaction cantonn\u00e9e \u00e0 un autre d\u00e9sordre, et indemnise les chefs de pr\u00e9judice mat\u00e9riellement \u00e9tablis, tout en rejetant les demandes non imput\u00e9es.<\/p>\n<p>I. La r\u00e9ticence dolosive caract\u00e9ris\u00e9e<\/p>\n<p>A. Principe et charge de la preuve<\/p>\n<p>La cour fixe d\u2019abord le cadre l\u00e9gal applicable \u00e0 la vente conclue avant la r\u00e9forme du droit des contrats. Elle rappelle le texte fondateur et sa rigueur probatoire. Elle cite ainsi: \u00ab Le dol est une cause de nullit\u00e9 de la convention lorsque les man&#8217;uvres pratiqu\u00e9es par l&#8217;une des parties sont telles, qu&#8217;il est \u00e9vident que, sans ces man&#8217;uvres, l&#8217;autre partie n&#8217;aurait pas contract\u00e9. Il ne se pr\u00e9sume pas et doit \u00eatre prouv\u00e9 \u00bb.<\/p>\n<p>Elle pr\u00e9cise la port\u00e9e du silence trompeur, conforme \u00e0 une jurisprudence constante. Elle souligne que \u00ab Il est constant que le dol peut prendre la forme d&#8217;un silence lorsque le cocontractant s&#8217;est sciemment retenu de donner une information que l&#8217;autre partie ne pouvait conna\u00eetre pour l&#8217;amener \u00e0 contracter ; \u00bb.<\/p>\n<p>La d\u00e9cision articule ensuite les \u00e9l\u00e9ments constitutifs exig\u00e9s, en ciblant l\u2019information d\u00e9terminante. La formulation r\u00e9capitulative retient notamment: \u00ab le vendeur n&#8217;en a pas sciemment inform\u00e9 les acqu\u00e9reurs, \u00bb. L\u2019exigence probatoire conjugue connaissance du vice, dissimulation volontaire et caract\u00e8re d\u00e9terminant pour consentir.<\/p>\n<p>B. Application aux sinistres de catastrophe naturelle<\/p>\n<p>La cour constate l\u2019existence d\u2019un sinistre ant\u00e9rieur indemnis\u00e9 au titre d\u2019une catastrophe naturelle et de travaux structurels de reprise en sous-\u0153uvre. Elle rel\u00e8ve une d\u00e9claration d\u2019\u00ab absence de sinistre \u00bb ins\u00e9r\u00e9e dans l\u2019acte authentique, alors que l\u2019information, essentielle, existait et devait \u00eatre d\u00e9livr\u00e9e aux acqu\u00e9reurs. La dissimulation a d\u00e9termin\u00e9 le consentement, au moins quant aux conditions de la vente.<\/p>\n<p>La transaction conclue en 2014 ne prot\u00e8ge pas les vendeurs, car elle visait une \u00e9tanch\u00e9it\u00e9 locale sans lien avec les mouvements de terrain. La motivation est nette: \u00ab Il ne peut par ailleurs \u00eatre valablement excip\u00e9 par les vendeurs de la transaction sign\u00e9e avec les acqu\u00e9reurs pour \u00e9chapper \u00e0 leur responsabilit\u00e9 d\u00e8s lors que l&#8217;objet de cette transaction limit\u00e9 \u00e0 la reprise partielle de l&#8217;\u00e9tanch\u00e9it\u00e9 du mur du garage concerne un autre d\u00e9sordre \u00e9tranger au mouvement de terrain li\u00e9 \u00e0 l&#8217;\u00e9tat de catastrophe naturelle qui est seul \u00e0 l&#8217;origine de la fissuration horizontale du mur du garage. \u00bb<\/p>\n<p>Cette articulation met en \u00e9vidence le crit\u00e8re d\u00e9cisif de l\u2019objet de la transaction, cantonn\u00e9e, et l\u2019inefficacit\u00e9 des clauses g\u00e9n\u00e9rales de style en pr\u00e9sence d\u2019une information d\u00e9terminante tue. L\u2019expertise judiciaire structure l\u2019imputabilit\u00e9 en validant l\u2019origine g\u00e9otechnique des d\u00e9sordres.<\/p>\n<p>II. Les effets et la port\u00e9e<\/p>\n<p>A. D\u00e9limitation des r\u00e9parations et refus des demandes accessoires<\/p>\n<p>La cour indemnise prioritairement la reprise structurelle du mur enterr\u00e9, en int\u00e9grant l\u2019actualisation et l\u2019indexation ad\u00e9quates. Elle ajoute les frais n\u00e9cessaires d\u2019\u00e9tudes et de ma\u00eetrise d\u2019\u0153uvre, en coh\u00e9rence avec l\u2019office technique de l\u2019expert. La motivation pr\u00e9cise les postes techniques: \u00ab Il chiffre la phase d&#8217;\u00e9tude et de consultation des entreprises \u00e0 2 400 euros TTC et la phase ex\u00e9cution avec suivi des travaux \u00e0 3 000 euros TTC. \u00bb<\/p>\n<p>L\u2019indemnisation du trouble de jouissance li\u00e9 \u00e0 l\u2019indisponibilit\u00e9 temporaire du garage est admise, mais l\u2019urgence n\u2019\u00e9tait pas caract\u00e9ris\u00e9e durant l\u2019expertise. La d\u00e9cision retient: \u00ab Il affirme qu&#8217;au vu des constatations effectu\u00e9es le 23 mars 2017 et par la suite, compte tenu de l&#8217;absence de pouss\u00e9e sur les \u00e9tais et d&#8217;infiltration dans le sous-sol sur cette p\u00e9riode, il n&#8217;a pas \u00e9t\u00e9 consid\u00e9r\u00e9 de situation d&#8217;urgence. \u00bb<\/p>\n<p>Les demandes non rattach\u00e9es par l\u2019expertise \u00e0 la cause dolosive sont \u00e9cart\u00e9es, au premier rang desquelles le dallage. La motivation est explicite et circonscrit le p\u00e9rim\u00e8tre du dommage r\u00e9parable: \u00ab Ce faisant les d\u00e9sordres de fissuration du dallage objet du devis actualis\u00e9 au 24 mai 2023 dont les appelants demandent r\u00e9paration n&#8217;ont pas \u00e9t\u00e9 examin\u00e9s par l&#8217;expert et leur imputabilit\u00e9 au sinistre non d\u00e9clar\u00e9 n&#8217;est pas \u00e9tablie. \u00bb La coh\u00e9rence indemnitaire s\u2019impose \u00e9galement au rejet d\u2019un cumul avec une pr\u00e9tendue perte de chance de contracter \u00e0 meilleures conditions.<\/p>\n<p>B. Port\u00e9e pour la pratique des ventes et le contentieux des sinistres<\/p>\n<p>L\u2019arr\u00eat renforce l\u2019obligation d\u2019information du vendeur sur les sinistres indemnis\u00e9s et travaux structurels, en particulier en zone d\u2019al\u00e9a retrait-gonflement des argiles. La d\u00e9claration d\u2019\u00ab absence de sinistre \u00bb ne saurait neutraliser un ant\u00e9c\u00e9dent indemnitaire pertinent, ni les travaux lourds cons\u00e9cutifs, d\u00e8s lors que l\u2019information est d\u00e9terminante.<\/p>\n<p>La d\u00e9cision \u00e9claire l\u2019articulation entre transaction et dol: une transaction d\u2019objet limit\u00e9 ne purge pas la r\u00e9ticence relative \u00e0 un autre d\u00e9sordre d\u00e9terminant. Elle confirme, en outre, l\u2019exigence probatoire: le dol \u00ab ne se pr\u00e9sume pas et doit \u00eatre prouv\u00e9 \u00bb, mais l\u2019expertise judiciaire en fournit la charpente causale.
