Le preneur a cess\u00e9 d\u2019honorer les loyers, entra\u00eenant un commandement de payer visant la clause r\u00e9solutoire et, ensuite, une assignation devant le juge des r\u00e9f\u00e9r\u00e9s. Le d\u00e9fendeur n\u2019a pas constitu\u00e9 avocat, tandis que le bailleur a maintenu des demandes d\u2019expulsion, de provision, d\u2019indemnit\u00e9 d\u2019occupation major\u00e9e et diverses condamnations accessoires.<\/p>\n<p>La question pos\u00e9e portait sur les conditions de constatation en r\u00e9f\u00e9r\u00e9 de l\u2019acquisition d\u2019une clause r\u00e9solutoire de bail commercial, et sur l\u2019\u00e9tendue des mesures cons\u00e9cutives. Le juge a retenu la r\u00e9gularit\u00e9 du commandement, constat\u00e9 la r\u00e9siliation de plein droit, ordonn\u00e9 l\u2019expulsion et fix\u00e9 l\u2019indemnit\u00e9 d\u2019occupation au loyer contractuel, avec une provision.<\/p>\n<p>I. Le r\u00e9f\u00e9r\u00e9 et l\u2019acquisition de la clause r\u00e9solutoire<\/p>\n<p>A. Conditions jurisprudentielles de la constatation<\/p>\n<p>\u00ab La juridiction des r\u00e9f\u00e9r\u00e9s n&#8217;est toutefois pas tenue de caract\u00e9riser l&#8217;urgence, au sens de l&#8217;article 834 du code de proc\u00e9dure civile, pour constater l&#8217;acquisition de la clause r\u00e9solutoire et la r\u00e9siliation de droit d&#8217;un bail. \u00bb La formule rappelle que l\u2019office du juge des r\u00e9f\u00e9r\u00e9s, en la mati\u00e8re, s\u2019attache \u00e0 l\u2019\u00e9vidence de l\u2019obligation et non \u00e0 la mesure d\u2019urgence. La solution, conforme \u00e0 la pratique, \u00e9vite de superposer des exigences impropres au m\u00e9canisme automatique voulu par le statut des baux commerciaux.<\/p>\n<p>\u00ab L\u2019article L. 145-41 du code de commerce dispose que toute clause ins\u00e9r\u00e9e dans le bail pr\u00e9voyant la r\u00e9siliation de plein droit ne produit effet qu&#8217;un mois apr\u00e8s un commandement demeur\u00e9 infructueux. Le commandement doit, \u00e0 peine de nullit\u00e9, mentionner ce d\u00e9lai. \u00bb Ce rappel \u00e9rige le d\u00e9lai d\u2019un mois et la mention expresse en conditions d\u2019efficacit\u00e9, garantissant l\u2019information utile du preneur. Cette exigence conditionne l\u2019effet automatique et guide l\u2019examen strict des pi\u00e8ces produites par le bailleur.<\/p>\n<p>Le juge \u00e9nonce trois garde\u2011fous: d\u00e9faut de paiement manifestement fautif, invocation de bonne foi par le bailleur, et absence d\u2019ambigu\u00eft\u00e9 contractuelle. La pr\u00e9cision selon laquelle \u00ab la clause r\u00e9solutoire d&#8217;un bail doit s&#8217;interpr\u00e9ter strictement \u00bb balise l\u2019office, en r\u00e9servant l\u2019interpr\u00e9tation aux hypoth\u00e8ses o\u00f9 l\u2019instrumentum pr\u00eaterait \u00e0 discussion.<\/p>\n<p>B. R\u00e9gularit\u00e9 du commandement et date d\u2019effet<\/p>\n<p>L\u2019ordonnance retient que le statut des baux commerciaux s\u2019applique sans discussion et que le commandement mentionne le d\u00e9lai l\u00e9gal, la clause et le d\u00e9tail int\u00e9gral des sommes r\u00e9clam\u00e9es. Elle souligne que \u00ab Le commandement contenait ainsi toutes les pr\u00e9cisions permettant au locataire de conna\u00eetre la nature, les causes et le montant des sommes r\u00e9clam\u00e9es, de proc\u00e9der au r\u00e8glement des sommes dues ou de motiver la critique du d\u00e9compte. \u00bb La r\u00e9gularit\u00e9 formelle, corrobor\u00e9e par le d\u00e9compte annex\u00e9, \u00e9carte toute contestation s\u00e9rieuse.<\/p>\n<p>Les causes n\u2019ayant pas \u00e9t\u00e9 acquitt\u00e9es dans le mois, la r\u00e9siliation a produit ses effets \u00e0 la date retenue par la juridiction. \u00ab D\u00e8s lors, la clause r\u00e9solutoire est acquise et le bail se trouve r\u00e9sili\u00e9 de plein droit avec toutes cons\u00e9quences de droit \u00e0 compter du 20 septembre 2024. \u00bb La solution proc\u00e8de d\u2019une lecture stricte des textes et d\u2019un contr\u00f4le documentaire, conforme \u00e0 l\u2019\u00e9conomie de la clause.<\/p>\n<p>Cette constatation ferme commande ensuite les mesures de remise en \u00e9tat et d\u2019ex\u00e9cution, au premier rang desquelles l\u2019expulsion et l\u2019\u00e9valuation de l\u2019occupation.<\/p>\n<p>II. Cons\u00e9quences et port\u00e9e de l\u2019ordonnance<\/p>\n<p>A. Expulsion et indemnit\u00e9 d\u2019occupation \u00e0 hauteur du loyer<\/p>\n<p>L\u2019ordonnance qualifie sans ambages la situation n\u00e9e du maintien post\u2011r\u00e9siliation. \u00ab Le maintien dans un immeuble, sans droit ni titre du fait de la r\u00e9siliation du bail, constitue un trouble manifestement illicite. \u00bb La qualification justifie l\u2019expulsion, avec un bref d\u00e9lai de restitution volontaire, en ad\u00e9quation avec la finalit\u00e9 de remise en \u00e9tat.<\/p>\n<p>Le juge rappelle ensuite la nature de la cr\u00e9ance post\u2011r\u00e9siliation. \u00ab Il est rappel\u00e9 qu\u2019\u00e0 compter de la r\u00e9siliation du bail par l&#8217;effet de la clause r\u00e9solutoire le preneur n&#8217;est plus d\u00e9biteur de loyers mais d&#8217;une indemnit\u00e9 d&#8217;occupation. \u00bb L\u2019indemnit\u00e9 est fix\u00e9e, \u00e0 titre provisionnel, au montant du loyer contractuel, outre charges et accessoires, solution proportionn\u00e9e au pr\u00e9judice locatif certain.<\/p>\n<p>S\u2019agissant des sommes arri\u00e9r\u00e9es, la juridiction s\u2019en tient au standard probatoire du r\u00e9f\u00e9r\u00e9. \u00ab Le montant de la provision allou\u00e9e en r\u00e9f\u00e9r\u00e9 n&#8217;a d&#8217;autre limite que le montant non s\u00e9rieusement contestable de la dette all\u00e9gu\u00e9e \u00bb Au vu du d\u00e9compte, la cr\u00e9ance arr\u00eat\u00e9e au 14 janvier 2025 \u00e0 14 712,16 \u20ac n\u2019\u00e9tait pas s\u00e9rieusement contestable, justifiant la condamnation provisionnelle et l\u2019allocation d\u2019int\u00e9r\u00eats aux dates retenues.<\/p>\n<p>B. Encadrement des pr\u00e9tentions p\u00e9cuniaires et r\u00f4le du juge des r\u00e9f\u00e9r\u00e9s<\/p>\n<p>Le juge refuse la majoration sollicit\u00e9e au\u2011del\u00e0 du loyer, en raison de sa coloration potentiellement sanctionnatrice. Il pr\u00e9cise que \u00ab Elle rel\u00e8ve donc de l&#8217;appr\u00e9ciation de ce juge et ne peut donc \u00eatre accueillie devant le juge des r\u00e9f\u00e9r\u00e9s, juge de l&#8217;\u00e9vidence, qu&#8217;\u00e0 concurrence du montant du loyer courant, charges en sus, auquel le bailleur peut pr\u00e9tendre en cas de maintien dans les lieux apr\u00e8s r\u00e9siliation du bail. \u00bb La motivation recentre l\u2019\u00e9valuation sur la compensation de la jouissance, en \u00e9cartant toute p\u00e9nalisation anticip\u00e9e.<\/p>\n<p>La demande relative au d\u00e9p\u00f4t de garantie conna\u00eet le m\u00eame sort, au regard de sa qualification. \u00ab La clause du bail relative au d\u00e9p\u00f4t de garantie s\u2019analyse comme une clause p\u00e9nale comme telle susceptible d\u2019\u00eatre mod\u00e9r\u00e9e par le juge du fond, en application des dispositions de l\u2019article 1231-5 du code civil. Par suite, il n\u2019y a pas lieu \u00e0 r\u00e9f\u00e9r\u00e9 sur ce point. \u00bb La r\u00e9serve pr\u00e9serve la comp\u00e9tence du juge du fond, conform\u00e9ment \u00e0 la prudence inh\u00e9rente au r\u00e9f\u00e9r\u00e9\u2011provision.<\/p>\n<p>Enfin, la juridiction assoit l\u2019efficacit\u00e9 imm\u00e9diate des mesures prononc\u00e9es.
