Ces derniers, mis en demeure, contestaient le quantum de leur dette en invoquant une in\u00e9galit\u00e9 de traitement par rapport \u00e0 des lots similaires et en mettant en cause l\u2019exactitude de l\u2019\u00e9tat descriptif de division. Le syndicat, quant \u00e0 lui, r\u00e9clamait le paiement des sommes dues assorti de dommages-int\u00e9r\u00eats pour r\u00e9sistance abusive. Le tribunal a accueilli le principe de la cr\u00e9ance tout en en r\u00e9duisant le montant et en rejetant la demande de dommages-int\u00e9r\u00eats. Cette d\u00e9cision illustre avec rigueur le contr\u00f4le op\u00e9r\u00e9 par le juge sur l\u2019exigibilit\u00e9 des charges de copropri\u00e9t\u00e9 et les conditions de la d\u00e9ch\u00e9ance du terme. Elle soul\u00e8ve la question de savoir comment le juge des r\u00e9f\u00e9r\u00e9s, saisi en proc\u00e9dure acc\u00e9l\u00e9r\u00e9e au fond, appr\u00e9cie la r\u00e9gularit\u00e9 de la proc\u00e9dure de recouvrement et sanctionne les contestations infond\u00e9es des copropri\u00e9taires d\u00e9faillants. L\u2019analyse de ce jugement r\u00e9v\u00e8le d\u2019abord la rigueur proc\u00e9durale exig\u00e9e pour la mise en \u0153uvre de la d\u00e9ch\u00e9ance du terme (I), avant de mettre en lumi\u00e8re le rejet des moyens de d\u00e9fense non \u00e9tay\u00e9s et la modulation des condamnations accessoires (II).<\/p>\n<p><strong>I. La confirmation d\u2019une cr\u00e9ance de copropri\u00e9t\u00e9 r\u00e9guli\u00e8rement rendue exigible<\/strong><\/p>\n<p>Le tribunal v\u00e9rifie scrupuleusement le respect des conditions l\u00e9gales permettant de rendre imm\u00e9diatement exigibles les provisions sur charges. Il rappelle d\u2019abord le fondement l\u00e9gal de l\u2019obligation au paiement. \u00ab En application de l&#8217;article 10 de la loi du 10 juillet 1965, les copropri\u00e9taires sont tenus de participer aux charges [&#8230;] proportionnellement aux valeurs relatives des parties privatives comprises dans leurs lots. \u00bb Cette obligation na\u00eet formellement de l\u2019approbation des comptes par l\u2019assembl\u00e9e g\u00e9n\u00e9rale. Le juge \u00e9nonce ainsi que \u00ab l&#8217;obligation \u00e0 la dette existe, d\u00e8s lors que l&#8217;assembl\u00e9e g\u00e9n\u00e9rale des copropri\u00e9taires a approuv\u00e9 les comptes pr\u00e9sent\u00e9s par le syndic et qu&#8217;aucun recours n&#8217;a \u00e9t\u00e9 form\u00e9 dans le d\u00e9lai l\u00e9gal \u00bb.<\/p>\n<p>Le c\u0153ur de la d\u00e9monstration r\u00e9side dans la v\u00e9rification de la r\u00e9gularit\u00e9 de la mise en demeure et de la d\u00e9ch\u00e9ance du terme pr\u00e9vue \u00e0 l\u2019article 19-2 de la loi du 10 juillet 1965. Le tribunal constate que le syndicat a produit la mise en demeure dat\u00e9e du 12 f\u00e9vrier 2025, informant les copropri\u00e9taires du risque de d\u00e9ch\u00e9ance du terme. Il rel\u00e8ve \u00e9galement la production d\u2019une s\u00e9rie compl\u00e8te de proc\u00e8s-verbaux d\u2019assembl\u00e9es g\u00e9n\u00e9rales, couvrant plusieurs exercices, attestant du vote r\u00e9gulier des budgets pr\u00e9visionnels. Le juge en d\u00e9duit que les conditions de l\u2019article 19-2 sont remplies, pr\u00e9cisant qu\u2019\u00ab il appartient au juge [&#8230;] de constater le vote du budget pr\u00e9visionnel par l&#8217;assembl\u00e9e g\u00e9n\u00e9rale de la copropri\u00e9t\u00e9 ainsi que la d\u00e9ch\u00e9ance du terme, avant de condamner le copropri\u00e9taire d\u00e9faillant \u00bb. Cette v\u00e9rification minutieuse des pi\u00e8ces justificatives est essentielle pour fonder l\u00e9galement la condamnation au paiement des provisions devenues exigibles.<\/p>\n<p><strong>II. Le rejet des d\u00e9fenses non \u00e9tay\u00e9es et la modulation des condamnations accessoires<\/strong><\/p>\n<p>Face aux contestations des copropri\u00e9taires, le tribunal adopte une position exigeante en mati\u00e8re de preuve. Les d\u00e9fendeurs avaient avanc\u00e9 que leur lot supportait des charges sup\u00e9rieures \u00e0 des lots similaires et \u00e9voquaient un \u00e9ventuel vice de l\u2019\u00e9tat descriptif de division. Le juge \u00e9carte ces arguments au motif qu\u2019ils ne sont soutenus par aucun \u00e9l\u00e9ment probant. Il souligne que \u00ab les d\u00e9clarations faites \u00e0 l&#8217;audience [&#8230;] sur la possibilit\u00e9 que l&#8217;\u00e9tat descriptif de division soit &#187; peut-\u00eatre faux &#187; n&#8217;est soutenu par aucun commencement de preuve \u00bb. Il ajoute qu\u2019\u00ab ils ne produisent aucun \u00e9l\u00e9ment \u00e0 m\u00eame d&#8217;appr\u00e9cier leur affirmation selon laquelle des lots \u00e9quivalents [&#8230;] se verraient appliquer des charges inf\u00e9rieures \u00bb. Cette s\u00e9v\u00e9rit\u00e9 rappelle que de simples all\u00e9gations, non corrobor\u00e9es par des preuves, sont insuffisantes pour contester un d\u00e9compte de charges \u00e9tabli sur la base de documents syndicaux r\u00e9guliers.<\/p>\n<p>Le tribunal fait ensuite preuve de nuance dans l\u2019examen des demandes accessoires du syndicat. D\u2019une part, il op\u00e8re une distinction nette entre les charges de copropri\u00e9t\u00e9 proprement dites et les frais de recouvrement contentieux. Il d\u00e9cide de soustraire du principal r\u00e9clam\u00e9 \u00ab la somme de 927,92 euros correspondant \u00e0 des frais de mise en demeure, de contentieux et de suivi qui sont indemnis\u00e9s par l&#8217;application [&#8230;] de l&#8217;article 700 du code de proc\u00e9dure civile, et qui pourraient, de par leur r\u00e9gime, faire l&#8217;objet d&#8217;un d\u00e9compte s\u00e9par\u00e9 \u00bb. D\u2019autre part, il rejette la demande de dommages et int\u00e9r\u00eats pour r\u00e9sistance abusive. Le juge motive ce rejet en application de l\u2019article 1231-6, alin\u00e9a 3, du code civil, constatant que le syndicat \u00ab ne d\u00e9montrant ni l&#8217;existence d&#8217;un pr\u00e9judice ind\u00e9pendant du retard en paiement, ni la mauvaise foi \u00bb des copropri\u00e9taires. Enfin, il use de son pouvoir d\u2019appr\u00e9ciation pour allouer une somme au titre de l\u2019article 700 du CPC, qu\u2019il fixe \u00e0 500 euros, consid\u00e9rant qu\u2019\u00ab il serait in\u00e9quitable de laisser \u00e0 la charge du syndicat des copropri\u00e9taires les sommes expos\u00e9es par lui dans la pr\u00e9sente instance \u00bb.
