La demande porte sur l\u2019exigibilit\u00e9 des provisions non \u00e9chues apr\u00e8s mise en demeure et sur la qualification des frais de recouvrement.<\/p>\n<p>Un copropri\u00e9taire a \u00e9t\u00e9 mis en demeure le 20 f\u00e9vrier 2025, apr\u00e8s notification des cons\u00e9quences pr\u00e9vues par l\u2019article 19-2 en cas d\u2019inex\u00e9cution persistante. Il \u00e9tait redevable d\u2019un arri\u00e9r\u00e9 puis des provisions devenues imm\u00e9diatement exigibles, selon les budgets vot\u00e9s par l\u2019assembl\u00e9e g\u00e9n\u00e9rale.<\/p>\n<p>Assignation a \u00e9t\u00e9 d\u00e9livr\u00e9e le 23 juin 2025 pour audience du 17 juillet 2025, le d\u00e9fendeur n\u2019ayant pas comparu malgr\u00e9 un d\u00e9lai suffisant. Le syndicat a sollicit\u00e9 7 371 euros au titre des charges et provisions, ainsi qu\u2019une indemnit\u00e9 sur le fondement de l\u2019article 700 du code de proc\u00e9dure civile.<\/p>\n<p>La question pos\u00e9e concerne les conditions d\u2019exigibilit\u00e9 des provisions et la possibilit\u00e9 d\u2019int\u00e9grer des frais de recouvrement dans le d\u00e9compte des charges. Le tribunal r\u00e9pond en rappelant l\u2019obligation aux charges, l\u2019office du juge sous l\u2019article 19-2, et la s\u00e9paration des frais r\u00e9gis par l\u2019article 10-1.<\/p>\n<p>\u00ab L\u2019obligation \u00e0 la dette existe, d\u00e8s lors que l\u2019assembl\u00e9e g\u00e9n\u00e9rale des copropri\u00e9taires a approuv\u00e9 les comptes pr\u00e9sent\u00e9s par le syndic et qu\u2019aucun recours n\u2019a \u00e9t\u00e9 form\u00e9 dans le d\u00e9lai l\u00e9gal, mentionn\u00e9 \u00e0 l\u2019article 42 de la loi du 10 juillet 1965. \u00bb Il est \u00e9galement affirm\u00e9 que \u00ab Il appartient au juge charg\u00e9 d\u2019appliquer l\u2019article 19-2 de la loi du 10 juillet 1965 de constater le vote du budget pr\u00e9visionnel par l\u2019assembl\u00e9e g\u00e9n\u00e9rale de la copropri\u00e9t\u00e9 ainsi que la d\u00e9ch\u00e9ance du terme, avant de condamner le copropri\u00e9taire d\u00e9faillant au versement des provisions pr\u00e9vues \u00e0 l\u2019article 14-1 et devenues exigibles. \u00bb<\/p>\n<p>I. Les conditions de l\u2019exigibilit\u00e9 des charges et provisions<\/p>\n<p>A. Le rappel normatif et l\u2019office du juge<\/p>\n<p>Le tribunal rappelle d\u2019abord la r\u00e8gle d\u2019imputation des charges par l\u2019article 10, qui fonde l\u2019obligation contributive de chaque lot. Il cite ainsi: \u00ab En application de l\u2019article 10 de la loi du 10 juillet 1965, les copropri\u00e9taires sont tenus de participer aux charges entra\u00een\u00e9es par les services collectifs et les \u00e9l\u00e9ments d\u2019\u00e9quipement commun en fonction de l\u2019utilit\u00e9 objective que ces services et \u00e9l\u00e9ments pr\u00e9sentent \u00e0 l\u2019\u00e9gard de chaque lot, d\u00e8s lors que ces charges ne sont pas individualis\u00e9es. Ils sont tenus de participer aux charges relatives \u00e0 la conservation, \u00e0 l\u2019entretien et \u00e0 l\u2019administration des parties communes, g\u00e9n\u00e9rales et sp\u00e9ciales, et de verser au fonds de travaux mentionn\u00e9 \u00e0 l\u2019article 14-2 la cotisation pr\u00e9vue au m\u00eame article, proportionnellement aux valeurs relatives des parties privatives comprises dans leurs lots. \u00bb<\/p>\n<p>L\u2019obligation \u00e0 la dette est ensuite rattach\u00e9e \u00e0 l\u2019approbation r\u00e9guli\u00e8re des comptes et \u00e0 l\u2019absence de recours dans les d\u00e9lais l\u00e9gaux. La motivation pr\u00e9cit\u00e9e fixe clairement le point de cristallisation de la dette, distinct des modalit\u00e9s d\u2019exigibilit\u00e9 des provisions pr\u00e9visionnelles.<\/p>\n<p>Enfin, l\u2019office du juge est d\u00e9fini sous l\u2019article 19-2, qui commande la v\u00e9rification du vote du budget, la constatation de la d\u00e9ch\u00e9ance du terme et la condamnation corr\u00e9lative. La formulation pr\u00e9cit\u00e9e pr\u00e9cise l\u2019encha\u00eenement des v\u00e9rifications, garantissant l\u2019articulation entre dette d\u00e9finitivement acquise et exigibilit\u00e9 anticip\u00e9e.<\/p>\n<p>B. Les v\u00e9rifications op\u00e9r\u00e9es et la d\u00e9ch\u00e9ance du terme<\/p>\n<p>Le dossier comportait les proc\u00e8s-verbaux d\u2019assembl\u00e9es g\u00e9n\u00e9rales approuvant les comptes jusqu\u2019au 30 septembre 2024 et votant les budgets pr\u00e9visionnels pour les exercices ult\u00e9rieurs, ainsi qu\u2019une mise en demeure r\u00e9guli\u00e8rement pr\u00e9sent\u00e9e. Un extrait de compte arr\u00eat\u00e9 au 3 juin 2025 \u00e9tablissait l\u2019\u00e9tendue de l\u2019arri\u00e9r\u00e9 et des provisions devenues exigibles.<\/p>\n<p>Sur cette base, la juridiction admet le principe de la condamnation, en \u00e9cartant toutefois certains postes non int\u00e9grables aux charges. Elle motive en ces termes: \u00ab Les comptes ayant \u00e9t\u00e9 approuv\u00e9s pour les exercices clos au 30 septembre 2024 et les budgets pr\u00e9visionnels ayant \u00e9t\u00e9 adopt\u00e9s pour les exercices du 1er octobre 2024 au 30 septembre 2025 et du 1er octobre 2025 au 30 septembre 2026, la demande du syndicat des copropri\u00e9taires sera accueillie dans son principe sauf \u00e0 d\u00e9duire du d\u00e9compte produit aux d\u00e9bats la somme de 787,74 euros (9 + 50 + 150 + 200 + 55,44 + 73,30 + 50 + 50 + 150) correspondant \u00e0 des frais de mise en demeure, de contentieux et de suivi qui sont indemnis\u00e9s par l\u2019application des dispositions de l\u2019article 10-1 de la loi du 10 juillet 1965 et de l\u2019article 700 du code de proc\u00e9dure civile, et qui pourraient, de par leur r\u00e9gime, faire l\u2019objet d\u2019un d\u00e9compte s\u00e9par\u00e9 de celui des charges de copropri\u00e9t\u00e9. \u00bb La reconnaissance de la d\u00e9ch\u00e9ance du terme s\u2019articule donc avec une discipline de qualification stricte des postes r\u00e9clam\u00e9s.<\/p>\n<p>II. La qualification des frais de recouvrement et sa port\u00e9e<\/p>\n<p>A. La s\u00e9paration des frais: article 10-1 et indemnit\u00e9 de proc\u00e9dure<\/p>\n<p>La d\u00e9cision distingue nettement les charges, recouvrables selon l\u2019utilit\u00e9 ou les tanti\u00e8mes, et les frais de recouvrement, indemnisables sur fondements sp\u00e9cifiques. Elle tire la cons\u00e9quence pratique au dispositif: \u00ab Rejette la demande de paiement de la somme de 787,74 euros qui pourra \u00eatre r\u00e9cup\u00e9r\u00e9e dans le cadre des d\u00e9pens de la pr\u00e9sente instance sur justificatif des sommes engag\u00e9es ; \u00bb La solution \u00e9carte l\u2019imputation de ces frais au d\u00e9compte courant, pour en r\u00e9server l\u2019indemnisation au titre des d\u00e9pens et, selon l\u2019\u00e9quit\u00e9, de l\u2019article 700.<\/p>\n<p>Le raisonnement est compl\u00e9t\u00e9 par une appr\u00e9ciation d\u2019\u00e9quit\u00e9 propre \u00e0 l\u2019article 700, distincte des d\u00e9pens tarif\u00e9s. Le tribunal \u00e9nonce: \u00ab Enfin, il serait in\u00e9quitable de laisser \u00e0 la charge du syndicat des copropri\u00e9taires les sommes expos\u00e9es par lui dans la pr\u00e9sente instance et non comprises dans les d\u00e9pens. \u00bb Il alloue en cons\u00e9quence une somme de 800 euros, ajustant la demande initiale et \u00e9vitant toute double indemnisation.<\/p>\n<p>B. Les cons\u00e9quences probatoires et l\u2019effectivit\u00e9 du recouvrement<\/p>\n<p>La solution impose une pr\u00e9sentation s\u00e9par\u00e9e des frais de recouvrement, avec pi\u00e8ces justificatives et ventilation claire par postes. Elle incite les syndics \u00e0 calibrer les assignations, en distinguant charges approuv\u00e9es et frais extracomptables, afin de pr\u00e9venir les rejets partiels et s\u00e9curiser la liquidation des d\u00e9pens.<\/p>\n<p>Le rejet des 787,74 euros dans le d\u00e9compte des charges ne ferme pas la voie au remboursement, mais renvoie aux m\u00e9canismes de d\u00e9pens et d\u2019article 700. Cette orientation m\u00e9nage la protection du d\u00e9biteur contre l\u2019inflation du d\u00e9compte, tout en permettant l\u2019indemnisation des co\u00fbts n\u00e9cessaires et proportionn\u00e9s du recouvrement.<\/p>\n<p>L\u2019effectivit\u00e9 du prononc\u00e9 est consolid\u00e9e par la r\u00e8gle de droit commun de l\u2019ex\u00e9cution provisoire, rappel\u00e9e au dispositif. La formule \u00ab Rappelle que l\u2019ex\u00e9cution provisoire est de droit. \u00bb conf\u00e8re une port\u00e9e pratique imm\u00e9diate \u00e0 la condamnation, sans pr\u00e9judice des contestations ult\u00e9rieures limit\u00e9es aux postes non int\u00e9gr\u00e9s.
