Le salari\u00e9 avait pr\u00e9par\u00e9 un colis de fruits et l\u00e9gumes d\u00e9marqu\u00e9 pendant son temps de travail, puis l\u2019avait fait passer en caisse aupr\u00e8s d\u2019une int\u00e9rimaire. La question de droit portait sur la qualification de la faute grave et l\u2019opposabilit\u00e9 d\u2019un usage d\u2019entreprise. La cour a infirm\u00e9 le jugement prud\u2019homal et requalifi\u00e9 le licenciement en cause r\u00e9elle et s\u00e9rieuse.<\/p>\n<p>I. L\u2019absence de faute grave malgr\u00e9 la violation du r\u00e8glement int\u00e9rieur<\/p>\n<p>A. La d\u00e9nonciation irr\u00e9guli\u00e8re de l\u2019usage autorisant les paniers anti-gaspi<\/p>\n<p>La cour rappelle que la d\u00e9nonciation d\u2019un usage doit faire l\u2019objet d\u2019une information \u00e9crite adress\u00e9e personnellement \u00e0 chaque salari\u00e9. Or, la soci\u00e9t\u00e9 ne justifie pas avoir r\u00e9guli\u00e8rement et individuellement inform\u00e9 le salari\u00e9 de la fin de cette pratique. Le compte-rendu de l\u2019entretien pr\u00e9alable mentionne que le salari\u00e9 a d\u00e9clar\u00e9 apprendre ce jour qu\u2019il n\u2019est plus possible de faire les colis \u00ab antigaspi \u00bb. En cons\u00e9quence, l\u2019usage demeure opposable \u00e0 l\u2019employeur, ce qui att\u00e9nue la gravit\u00e9 des faits reproch\u00e9s.<\/p>\n<p>B. La mat\u00e9rialit\u00e9 d\u2019une faute justifiant une cause r\u00e9elle et s\u00e9rieuse<\/p>\n<p>La cour constate que le salari\u00e9 a viol\u00e9 le r\u00e8glement int\u00e9rieur en ne passant pas \u00e0 la caisse principale et en pr\u00e9parant son achat durant son temps de travail. Elle rel\u00e8ve que ces manquements caract\u00e9risent une cause r\u00e9elle et s\u00e9rieuse de licenciement, mais non une faute grave. La d\u00e9cision pr\u00e9cise que les faits ne rendaient pas impossible le maintien du salari\u00e9 dans l\u2019entreprise, justifiant ainsi le rejet de la qualification la plus s\u00e9v\u00e8re.<\/p>\n<p>II. Les cons\u00e9quences juridiques de la requalification du licenciement<\/p>\n<p>A. L\u2019octroi des indemnit\u00e9s l\u00e9gales de rupture<\/p>\n<p>La cour accorde au salari\u00e9 une indemnit\u00e9 compensatrice de pr\u00e9avis d\u2019un mois, soit 1 906,99 euros bruts, outre les cong\u00e9s pay\u00e9s aff\u00e9rents. Elle alloue \u00e9galement une indemnit\u00e9 de licenciement de 675,39 euros, calcul\u00e9e selon l\u2019anciennet\u00e9 du salari\u00e9. Ces sommes sont dues d\u00e8s lors que le licenciement n\u2019est plus fond\u00e9 sur une faute grave, privative de tout droit \u00e0 pr\u00e9avis et indemnit\u00e9.<\/p>\n<p>B. La restitution du salaire retenu pendant la mise \u00e0 pied conservatoire<\/p>\n<p>La cour ordonne le remboursement de la retenue op\u00e9r\u00e9e au titre de la mise \u00e0 pied conservatoire, soit 710,71 euros bruts, outre 71,07 euros de cong\u00e9s pay\u00e9s aff\u00e9rents. Cette d\u00e9cision d\u00e9coule logiquement de l\u2019absence de faute grave, qui seule justifie une telle mesure conservatoire sans paiement.
