Le syndicat des copropri\u00e9taires r\u00e9clamait le paiement d\u2019un arri\u00e9r\u00e9 apr\u00e8s l\u2019approbation des comptes. La d\u00e9fenderesse contestait l\u2019imputabilit\u00e9 de charges ant\u00e9rieures \u00e0 son acquisition, estimant que le syndic ne justifiait pas son d\u00e9compte. La question centrale portait sur la charge des r\u00e9gularisations de comptes approuv\u00e9es apr\u00e8s la vente. Le tribunal a fait droit \u00e0 la demande principale du syndicat, tout en r\u00e9duisant les frais de recouvrement.<\/p>\n<p>I. L\u2019imputabilit\u00e9 des charges \u00e0 l\u2019acqu\u00e9reur apr\u00e8s approbation des comptes<\/p>\n<p>Le tribunal a appliqu\u00e9 les dispositions du d\u00e9cret du 17 mars 1967 pour d\u00e9terminer le d\u00e9biteur des charges. Il a jug\u00e9 que les r\u00e9gularisations de charges pour l\u2019exercice 2018\/2019 \u00e9taient exigibles apr\u00e8s la vente. En effet, <em>&#171;le moins per\u00e7u sur provision r\u00e9v\u00e9l\u00e9 par l\u2019approbation des comptes est \u00e0 la charge de celui qui est copropri\u00e9taire lors de l\u2019approbation des comptes&#187;<\/em> (motifs, article 6-2, 3\u00b0 du d\u00e9cret). La date d\u2019exigibilit\u00e9, et non l\u2019exercice comptable, est donc le crit\u00e8re d\u00e9terminant.<\/p>\n<p>La valeur de cette solution est de clarifier la r\u00e8gle d\u2019imputation des charges en cas de mutation. Elle confirme que l\u2019acqu\u00e9reur supporte les r\u00e9gularisations approuv\u00e9es apr\u00e8s son entr\u00e9e en jouissance, m\u00eame si les d\u00e9penses sont ant\u00e9rieures. La port\u00e9e de cette d\u00e9cision est de rappeler que les conventions entre vendeur et acqu\u00e9reur sont inopposables au syndicat. Le tribunal a ainsi \u00e9cart\u00e9 l\u2019argument de la d\u00e9fenderesse tir\u00e9 de l\u2019\u00e9tat dat\u00e9, non produit aux d\u00e9bats.<\/p>\n<p>II. Le contr\u00f4le des frais de recouvrement et la condamnation pour r\u00e9sistance abusive<\/p>\n<p>Le tribunal a op\u00e9r\u00e9 une distinction stricte entre les frais n\u00e9cessaires et les frais de gestion courante. Il a retenu seulement la mise en demeure et la sommation de payer, soit 208,15 euros. En revanche, les frais de transmission du dossier \u00e0 l\u2019huissier et \u00e0 l\u2019avocat ont \u00e9t\u00e9 \u00e9cart\u00e9s comme non n\u00e9cessaires. Le juge a ainsi appliqu\u00e9 une interpr\u00e9tation restrictive de l\u2019article 10-1 de la loi de 1965, r\u00e9duisant la cr\u00e9ance de 519,55 euros.<\/p>\n<p>Sur la demande de dommages et int\u00e9r\u00eats, le tribunal a caract\u00e9ris\u00e9 une faute de la d\u00e9fenderesse. Il a relev\u00e9 que <em>&#171;les impay\u00e9s de charges sont r\u00e9currents et anciens, de telle sorte que la dette est aujourd\u2019hui particuli\u00e8rement importante&#187;<\/em> (motifs). Cette attitude, constitutive d\u2019une mauvaise foi, a justifi\u00e9 l\u2019octroi de 1 000 euros.
