La question de droit portait sur la possibilit\u00e9 de renouveler la p\u00e9riode d&#8217;observation au-del\u00e0 de la dur\u00e9e l\u00e9gale maximale. La solution retenue est le renouvellement exceptionnel pour six mois \u00e0 compter du 8 octobre 2025.<\/p>\n<p>I. Les conditions du renouvellement exceptionnel de la p\u00e9riode d&#8217;observation<\/p>\n<p>Le tribunal a fond\u00e9 sa d\u00e9cision sur l&#8217;avis favorable du minist\u00e8re public, du mandataire judiciaire et du juge commissaire. Il a estim\u00e9 que la soci\u00e9t\u00e9 d\u00e9bitrice entendait pr\u00e9senter un plan de redressement sur dix ans. La pr\u00e9servation de la filiale \u00e9tait jug\u00e9e indispensable pour la poursuite d&#8217;activit\u00e9 du groupe.<\/p>\n<p>La d\u00e9cision illustre la mise en \u0153uvre de l&#8217;article L. 631-7 du code de commerce. Le juge a v\u00e9rifi\u00e9 l&#8217;existence de perspectives s\u00e9rieuses de redressement avant d&#8217;accorder cette prorogation. La valeur de ce jugement est de confirmer qu&#8217;une prolongation exceptionnelle peut \u00eatre ordonn\u00e9e pour sauvegarder un groupe.<\/p>\n<p>II. La port\u00e9e du jugement sur les pouvoirs du tribunal et les voies de recours<\/p>\n<p>Le tribunal a statu\u00e9 par un jugement non susceptible d&#8217;appel, sauf par le minist\u00e8re public. Cette irrecevabilit\u00e9 de l&#8217;appel principal renforce l&#8217;autorit\u00e9 de la chose jug\u00e9e pour les parties. La voie de recours r\u00e9serv\u00e9e au minist\u00e8re public est pr\u00e9vue \u00e0 l&#8217;article L. 661-6 2\u00b0 du code de commerce.<\/p>\n<p>La port\u00e9e de cette solution est de limiter les contestations afin de garantir la c\u00e9l\u00e9rit\u00e9 des proc\u00e9dures collectives. Elle souligne le r\u00f4le central du minist\u00e8re public dans la surveillance des int\u00e9r\u00eats g\u00e9n\u00e9raux.
