Une soci\u00e9t\u00e9 copropri\u00e9taire majoritaire avait assign\u00e9 l\u2019autre copropri\u00e9taire et le syndicat pour \u00eatre autoris\u00e9e \u00e0 r\u00e9aliser des travaux conservatoires urgents sur la toiture. Le d\u00e9fendeur opposait une fin de non-recevoir tir\u00e9e de l\u2019autorit\u00e9 de la chose jug\u00e9e et une exception d\u2019incomp\u00e9tence. La question de droit portait sur la possibilit\u00e9 pour un copropri\u00e9taire d\u2019imposer des travaux n\u00e9cessaires \u00e0 la conservation de l\u2019immeuble face au refus de l\u2019autre. Le juge a d\u00e9clar\u00e9 la demanderesse recevable, \u00e9cart\u00e9 l\u2019exception et autoris\u00e9 les travaux, condamnant le d\u00e9fendeur \u00e0 consigner sa quote-part.<\/p>\n<p>I. La recevabilit\u00e9 de l\u2019action et la comp\u00e9tence du juge<\/p>\n<p>Le magistrat \u00e9carte d\u2019abord la fin de non-recevoir fond\u00e9e sur l\u2019autorit\u00e9 de la chose jug\u00e9e. Il constate que les diligences \u00e9voqu\u00e9es dans le pr\u00e9c\u00e9dent jugement ont \u00e9t\u00e9 r\u00e9alis\u00e9es et que la m\u00e9sentente persiste, ce qui constitue un \u00e9l\u00e9ment nouveau. Il rel\u00e8ve que &#171;les diligences \u00e9voqu\u00e9es dans le jugement ont \u00e9t\u00e9 r\u00e9alis\u00e9es depuis afin que l\u2019ensemble des travaux pr\u00e9conis\u00e9s par l\u2019expertise judiciaire soient entrepris&#187; (Motifs, page 5). Cette appr\u00e9ciation lui permet d\u2019\u00e9carter l\u2019irrecevabilit\u00e9 et de statuer sur le fond.<\/p>\n<p>Le juge rejette ensuite l\u2019exception d\u2019incomp\u00e9tence soulev\u00e9e par le d\u00e9fendeur. Il rappelle que les articles 41-16 et suivants de la loi de 1965 permettent au pr\u00e9sident du tribunal de statuer selon la proc\u00e9dure acc\u00e9l\u00e9r\u00e9e au fond. Il affirme que &#171;les travaux d\u00e9battus sont des travaux de nature conservatoire de sorte que l\u2019exception d\u2019incomp\u00e9tence fond\u00e9e sur une absence d\u2019urgence n\u2019est pas pertinente&#187; (Motifs, page 6). Cette d\u00e9cision confirme la comp\u00e9tence mat\u00e9rielle du juge pour conna\u00eetre des mesures urgentes requises par l\u2019int\u00e9r\u00eat commun.<\/p>\n<p>La valeur de cette solution est de pr\u00e9ciser que l\u2019autorit\u00e9 de la chose jug\u00e9e n\u2019est pas un obstacle lorsque des circonstances nouvelles modifient la situation. Sa port\u00e9e est de permettre \u00e0 un copropri\u00e9taire de saisir \u00e0 nouveau le juge si les travaux pr\u00e9conis\u00e9s n\u2019ont pas \u00e9t\u00e9 r\u00e9alis\u00e9s. Le rejet de l\u2019exception d\u2019incomp\u00e9tence souligne que la qualification de travaux conservatoires suffit \u00e0 fonder la comp\u00e9tence du juge des r\u00e9f\u00e9r\u00e9s.<\/p>\n<p>II. L\u2019autorisation judiciaire des travaux et le rejet des demandes reconventionnelles<\/p>\n<p>Le juge autorise la soci\u00e9t\u00e9 demanderesse \u00e0 r\u00e9aliser les travaux sur la base des devis conformes \u00e0 l\u2019expertise. Il constate que le d\u00e9fendeur n\u2019a pas entrepris les diligences utiles pour pr\u00e9venir le p\u00e9ril affectant l\u2019int\u00e9r\u00eat commun. Il note que &#171;les devis correspondant \u00e0 ces d\u00e9cisions ne sont pas fournis de sorte qu\u2019il ne rapporte pas la preuve d\u2019une conformit\u00e9 des travaux vis\u00e9s&#187; (Motifs, page 7). Le magistrat ordonne en cons\u00e9quence la consignation de la quote-part du d\u00e9fendeur.<\/p>\n<p>Le juge \u00e9carte les demandes reconventionnelles du d\u00e9fendeur, faute de preuve suffisante. Il estime que le d\u00e9fendeur &#171;ne d\u00e9montre pas avoir entrepris les diligences utiles pour pr\u00e9venir le p\u00e9ril affectant l\u2019int\u00e9r\u00eat commun&#187; (Motifs, page 7). Cette solution confirme que le copropri\u00e9taire majoritaire ne peut imposer ses d\u00e9cisions sans justifier de leur conformit\u00e9 aux pr\u00e9conisations de l\u2019expert.<\/p>\n<p>La valeur de cette d\u00e9cision est de r\u00e9affirmer la primaut\u00e9 de l\u2019int\u00e9r\u00eat commun sur le blocage d\u2019un copropri\u00e9taire. Sa port\u00e9e est de rappeler que le juge peut autoriser un copropri\u00e9taire \u00e0 agir seul pour pr\u00e9server l\u2019immeuble.
