L&#8217;exclusion du r\u00e9gime protecteur de l&#8217;inaptitude professionnelle<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/a><\/li>\n<li class=\"toc-h2\"><a href=\"#fondements-juridiques\">Fondements juridiques<\/a><\/li>\n<\/ul>\n<\/nav>\n<p>La Cour d&#8217;appel de Reims, dans un arr\u00eat du 29 avril 2026 (n\u00b025\/00587), \u00e9tait saisie d&#8217;un litige opposant une salari\u00e9e \u00e0 son employeur au sujet de ses demandes de rappel d&#8217;heures suppl\u00e9mentaires, d&#8217;indemnit\u00e9 pour travail dissimul\u00e9 et de contestation de son licenciement pour inaptitude. La salari\u00e9e exer\u00e7ait des fonctions impliquant des d\u00e9placements fr\u00e9quents et l&#8217;organisation de formations en dehors des locaux. Soutenant avoir accompli de nombreuses heures non r\u00e9mun\u00e9r\u00e9es, elle produisait des tableaux r\u00e9capitulatifs et des extraits d&#8217;agenda. Le conseil de prud&#8217;hommes l&#8217;avait d\u00e9bout\u00e9e de l&#8217;int\u00e9gralit\u00e9 de ses demandes, consid\u00e9rant qu&#8217;elle n&#8217;avait pas sollicit\u00e9 d&#8217;autorisation pr\u00e9alable et que la preuve n&#8217;\u00e9tait pas rapport\u00e9e. En appel, elle maintenait ses pr\u00e9tentions et sollicitait \u00e9galement la reconnaissance d&#8217;un harc\u00e8lement moral \u00e0 l&#8217;origine de son inaptitude. La question de droit centrale portait sur l&#8217;articulation de la charge de la preuve des heures suppl\u00e9mentaires et sur les conditions permettant d&#8217;\u00e9tablir l&#8217;accord tacite de l&#8217;employeur, ainsi que sur les crit\u00e8res de reconnaissance d&#8217;une origine professionnelle de l&#8217;inaptitude. La cour a partiellement infirm\u00e9 le jugement : elle a accord\u00e9 des rappels d&#8217;heures suppl\u00e9mentaires pour les ann\u00e9es 2019 \u00e0 2021, une indemnit\u00e9 pour travail dissimul\u00e9 et des dommages et int\u00e9r\u00eats pour irr\u00e9gularit\u00e9 de la proc\u00e9dure de licenciement, mais a rejet\u00e9 les demandes fond\u00e9es sur le harc\u00e8lement moral et l&#8217;origine professionnelle de l&#8217;inaptitude.<\/p>\n<h2 id=\"i-lassouplissement-du-regime-probatoire-des-heures-supplementaires-au-profit-du-\">I. L&#8217;assouplissement du r\u00e9gime probatoire des heures suppl\u00e9mentaires au profit du salari\u00e9<\/h2>\n<p><\/p>\n<h3 id=\"a-lamenagement-de-la-charge-de-la-preuve-des-heures-de-travail\">A. L&#8217;am\u00e9nagement de la charge de la preuve des heures de travail<\/h3>\n<p>La cour rappelle le m\u00e9canisme probatoire instaur\u00e9 par l&#8217;article L.3171-4 du code du travail. Il appartient d&#8217;abord au salari\u00e9 de pr\u00e9senter des \u00e9l\u00e9ments suffisamment pr\u00e9cis quant aux heures non r\u00e9mun\u00e9r\u00e9es qu&#8217;il pr\u00e9tend avoir accomplies, afin de permettre \u00e0 l&#8217;employeur d&#8217;y r\u00e9pondre utilement. En l&#8217;esp\u00e8ce, la salari\u00e9e produisait des tableaux r\u00e9capitulatifs mentionnant ses horaires, les lieux et les noms des soci\u00e9t\u00e9s visit\u00e9es, ainsi que des extraits d&#8217;agenda Outlook et des attestations de formation. La cour juge que <em>&#8220;les \u00e9l\u00e9ments produits par Madame [K] [E] sont suffisamment pr\u00e9cis pour permettre \u00e0 l&#8217;employeur d&#8217;y r\u00e9pondre&#8221;<\/em>. Ce faisant, elle \u00e9carte explicitement la motivation du premier juge, qui avait reproch\u00e9 \u00e0 la salari\u00e9e de ne pas avoir sollicit\u00e9 d&#8217;autorisation pr\u00e9alable et de ne pas justifier de l&#8217;acc\u00e8s de l&#8217;employeur \u00e0 son agenda. La charge de la preuve est ainsi all\u00e9g\u00e9e : le salari\u00e9 n&#8217;a pas \u00e0 prouver que son employeur avait acc\u00e8s aux documents, mais seulement \u00e0 fournir des indications circonstanci\u00e9es. L&#8217;employeur, qui assure le contr\u00f4le des horaires, doit ensuite produire ses propres \u00e9l\u00e9ments. En l&#8217;absence de tout syst\u00e8me de d\u00e9compte du temps de travail, la cour constate que l&#8217;employeur <em>&#8220;ne justifie d&#8217;aucune modalit\u00e9 de d\u00e9compte et de contr\u00f4le du temps de travail&#8221;<\/em>. Cette carence le prive de la possibilit\u00e9 de contester utilement les \u00e9l\u00e9ments du salari\u00e9, conform\u00e9ment \u00e0 l&#8217;obligation l\u00e9gale de tenir des documents de contr\u00f4le.<\/p>\n<h3 id=\"b-lextension-de-la-notion-dheures-supplementaires-tacitement-autorisees\">B. L&#8217;extension de la notion d&#8217;heures suppl\u00e9mentaires tacitement autoris\u00e9es<\/h3>\n<p>La cour pr\u00e9cise ensuite les conditions dans lesquelles l&#8217;employeur est r\u00e9put\u00e9 avoir donn\u00e9 son accord \u00e0 l&#8217;accomplissement d&#8217;heures suppl\u00e9mentaires. Elle \u00e9nonce qu&#8217;en l&#8217;absence de demande expresse, <em>&#8220;il suffit que l&#8217;employeur ait donn\u00e9 un accord tacite, lequel r\u00e9sulte de la connaissance qu&#8217;il avait du nombre d&#8217;heures effectu\u00e9es par le salari\u00e9, ou du fait que son opposition \u00e0 l&#8217;accomplissement d&#8217;heures suppl\u00e9mentaires ait \u00e9t\u00e9 trop tardive, ou encore que le nombre d&#8217;heures de travail ait \u00e9t\u00e9 impos\u00e9 par la quantit\u00e9, l&#8217;importance ou la nature des t\u00e2ches \u00e0 accomplir&#8221;<\/em>. En l&#8217;esp\u00e8ce, la salari\u00e9e renseignait ses rendez-vous sur l&#8217;agenda Outlook et le directeur de la soci\u00e9t\u00e9 \u00e9tait en copie des messages. La cour en d\u00e9duit que <em>&#8220;l&#8217;employeur \u00e9tait au courant de l&#8217;accomplissement de ces heures suppl\u00e9mentaires&#8221;<\/em>. Elle ajoute que la nature m\u00eame des fonctions, impliquant une grande flexibilit\u00e9 et des horaires d\u00e9cal\u00e9s, rendait n\u00e9cessaire la r\u00e9alisation de ces heures, sans que l&#8217;employeur n&#8217;organise de r\u00e9cup\u00e9ration. Cette solution s&#8217;inscrit dans un courant jurisprudentiel favorable au salari\u00e9, qui retient un accord tacite d\u00e8s lors que l&#8217;employeur ne pouvait ignorer la dur\u00e9e effective du travail, m\u00eame en l&#8217;absence de dispositif de contr\u00f4le.<\/p>\n<h2 id=\"ii-le-refus-detendre-la-protection-du-salarie-inapte-a-une-origine-professionnel\">II. Le refus d&#8217;\u00e9tendre la protection du salari\u00e9 inapte \u00e0 une origine professionnelle<\/h2>\n<p><\/p>\n<h3 id=\"a-labsence-de-caracterisation-dun-harcelement-moral\">A. L&#8217;absence de caract\u00e9risation d&#8217;un harc\u00e8lement moral<\/h3>\n<p>La salari\u00e9e soutenait que son inaptitude r\u00e9sultait d&#8217;un harc\u00e8lement moral, caract\u00e9ris\u00e9 par un avertissement injustifi\u00e9 et des pressions. La cour applique le m\u00e9canisme probatoire de l&#8217;article L.1154-1 du code du travail : le salari\u00e9 doit pr\u00e9senter des \u00e9l\u00e9ments de fait laissant supposer l&#8217;existence d&#8217;un harc\u00e8lement ; il incombe ensuite \u00e0 l&#8217;employeur de prouver que les agissements ne sont pas constitutifs d&#8217;un harc\u00e8lement. En l&#8217;esp\u00e8ce, la salari\u00e9e invoquait l&#8217;avertissement du 19 novembre 2021 et des menaces de rupture, mais elle ne produisait qu&#8217;un seul \u00e9crit m\u00e9dical \u00e9voquant un probl\u00e8me relationnel. La cour estime que <em>&#8220;ces \u00e9l\u00e9ments, pris dans leur ensemble, ne laissent pas pr\u00e9sumer l&#8217;existence d&#8217;un harc\u00e8lement moral&#8221;<\/em>, car l&#8217;avertissement \u00e9tait un agissement isol\u00e9 et les certificats m\u00e9dicaux ne faisaient que reprendre les d\u00e9clarations de l&#8217;int\u00e9ress\u00e9e. Elle refuse ainsi de reconna\u00eetre un lien entre les conditions de travail et l&#8217;inaptitude. Cette appr\u00e9ciation stricte des conditions de la pr\u00e9somption de harc\u00e8lement t\u00e9moigne d&#8217;une volont\u00e9 de ne pas \u00e9tendre la protection au-del\u00e0 des cas o\u00f9 les faits sont suffisamment \u00e9tablis.<\/p>\n<h3 id=\"b-lexclusion-du-regime-protecteur-de-linaptitude-professionnelle\">B. L&#8217;exclusion du r\u00e9gime protecteur de l&#8217;inaptitude professionnelle<\/h3>\n<p>La salari\u00e9e demandait \u00e0 b\u00e9n\u00e9ficier des indemnit\u00e9s sp\u00e9cifiques pr\u00e9vues en cas d&#8217;inaptitude d&#8217;origine professionnelle (articles L.1226-14 et L.1226-15 du code du travail). La cour rappelle que ces r\u00e8gles protectrices s&#8217;appliquent <em>&#8220;d\u00e8s lors que l&#8217;inaptitude du salari\u00e9 a, au moins partiellement, pour origine un accident du travail ou une maladie professionnelle et que l&#8217;employeur a connaissance de cette origine au moment du licenciement&#8221;<\/em>. Elle souligne que la reconnaissance de l&#8217;origine professionnelle n&#8217;est pas subordonn\u00e9e \u00e0 une d\u00e9cision de la CPAM <strong>(Cass. soc., 9 juin 2010, n\u00b0 09-41.040)<\/strong>. Toutefois, en l&#8217;esp\u00e8ce, la salari\u00e9e ne justifiait d&#8217;aucun \u00e9l\u00e9ment \u00e9tablissant un lien entre son inaptitude et une maladie professionnelle. Aucun arr\u00eat de travail n&#8217;avait \u00e9t\u00e9 \u00e9tabli pour accident du travail ou maladie professionnelle. La cour en d\u00e9duit que <em>&#8220;l&#8217;inaptitude de Madame [K] [E] est d&#8217;origine non professionnelle&#8221;<\/em>. Elle \u00e9carte ainsi la demande d&#8217;indemnit\u00e9 sp\u00e9ciale, rejoignant la solution de la Cour d&#8217;appel de Versailles du 24 f\u00e9vrier 2025 (n\u00b022\/01256) selon laquelle <em>&#8220;la l\u00e9gislation sp\u00e9cifique sur l&#8217;inaptitude professionnelle n&#8217;avait pas vocation \u00e0 s&#8217;appliquer&#8221;<\/em> en l&#8217;absence d&#8217;\u00e9l\u00e9ments m\u00e9dicaux objectifs. Par ailleurs, la cour rel\u00e8ve que l&#8217;employeur n&#8217;avait connaissance que d&#8217;une origine non professionnelle au moment du licenciement, conform\u00e9ment \u00e0 la condition cumulative pos\u00e9e par la jurisprudence <strong>(Cass. soc., 8 septembre 2021, n\u00b020-14.235)<\/strong>.<\/p>\n<p><h2 id=\"jurisprudences-utilisees-pour-enrichir-le-commentaire\">Jurisprudences utilis\u00e9es pour enrichir le commentaire<\/h2>\n<p><\/p>\n<ul class=\"jurisprudences-rag-sources\">\n<li><a href=\"https:\/\/www.courdecassation.fr\/decision\/67aedfb9418db33424a8bee8\" rel=\"nofollow\" target=\"_blank\">Cour d&#x27;appel de Paris, le 13 f\u00e9vrier 2025, n\u00b021\/08005<\/a><\/li>\n<li><a href=\"https:\/\/www.courdecassation.fr\/decision\/67bd5ddefdad2f9a78297172\" rel=\"nofollow\" target=\"_blank\">Cour d&#x27;appel de Versailles, le 24 f\u00e9vrier 2025, n\u00b022\/01256<\/a><\/li>\n<\/ul>\n<\/div>\n<style scoped>.fondements-juridiques{margin:40px 0 0;padding:0}.fondements-juridiques>h2{font-size:22px;color:#1a1a1a;border-bottom:2px solid #2c5f8a;padding-bottom:10px;margin-bottom:20px}.fj-article{background:#fdfdfd;border:1px solid #e8e8e8;border-radius:6px;padding:20px;margin-bottom:16px}.fj-article h3{font-size:17px;color:#2c5f8a;margin:0 0 12px;font-weight:600}.fj-texte{font-size:15px;line-height:1.7;color:#333}.fj-texte p{margin:8px 0}.fj-badge{font-size:11px;padding:2px 8px;border-radius:3px;margin-left:8px;font-weight:500;vertical-align:middle}.fj-en-vigueur{background:#e8f5e9;color:#2e7d32}.fj-abroge{background:#ffebee;color:#c62828}.fj-modifie{background:#fff3e0;color:#e65100}<\/style>\n<section class=\"fondements-juridiques\">\n<h2 id=\"fondements-juridiques\">Fondements juridiques<\/h2>\n<div class=\"fj-article\">\n<h3><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006900981\" rel=\"nofollow\" target=\"_blank\">Article L. 1226-14 du Code du travail<\/a> <span class=\"fj-badge fj-en-vigueur\">En vigueur<\/span><\/h3>\n<div class=\"fj-texte\">\n<p>La rupture du contrat de travail dans les cas pr\u00e9vus au deuxi\u00e8me alin\u00e9a de l&#8217;article L. 1226-12 ouvre droit, pour le salari\u00e9, \u00e0 une indemnit\u00e9 compensatrice d&#8217;un montant \u00e9gal \u00e0 celui de l&#8217;indemnit\u00e9 compensatrice de pr\u00e9avis pr\u00e9vue \u00e0 l&#8217;article L. 1234-5 ainsi qu&#8217;\u00e0 une indemnit\u00e9 sp\u00e9ciale de licenciement qui, sauf dispositions conventionnelles plus favorables, est \u00e9gale au double de l&#8217;indemnit\u00e9 pr\u00e9vue par l&#8217;article L. 1234-9.<\/p>\n<p>Toutefois, ces indemnit\u00e9s ne sont pas dues par l&#8217;employeur qui \u00e9tablit que le refus par le salari\u00e9 du reclassement qui lui est propos\u00e9 est abusif.<\/p>\n<p>Les dispositions du pr\u00e9sent article ne se cumulent pas avec les avantages de m\u00eame nature pr\u00e9vus par des dispositions conventionnelles ou contractuelles en vigueur au 7 janvier 1981 et destin\u00e9s \u00e0 compenser le pr\u00e9judice r\u00e9sultant de la perte de l&#8217;emploi cons\u00e9cutive \u00e0 l&#8217;accident du travail ou \u00e0 la maladie professionnelle.<\/p>\n<\/div>\n<\/div>\n<div class=\"fj-article\">\n<h3><a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000035643503\" rel=\"nofollow\" target=\"_blank\">Article L. 1226-15 du Code du travail<\/a> <span class=\"fj-badge fj-en-vigueur\">En vigueur<\/span><\/h3>\n<div class=\"fj-texte\">\n<p>Lorsqu&#8217;un licenciement est prononc\u00e9 en m\u00e9connaissance des dispositions relatives \u00e0 la r\u00e9int\u00e9gration du salari\u00e9, pr\u00e9vues \u00e0 l&#8217;article L. 1226-8, le tribunal saisi peut proposer la r\u00e9int\u00e9gration du salari\u00e9 dans l&#8217;entreprise, avec maintien de ses avantages acquis. <br \/>Il en va de m\u00eame en cas de licenciement prononc\u00e9 en m\u00e9connaissance des dispositions relatives au reclassement du salari\u00e9 d\u00e9clar\u00e9 inapte pr\u00e9vues aux articles L. 1226-10 \u00e0 L. 1226-12. <br \/>En cas de refus de r\u00e9int\u00e9gration par l&#8217;une ou l&#8217;autre des parties, le juge octroie une indemnit\u00e9 au salari\u00e9 dont le montant est fix\u00e9 conform\u00e9ment aux dispositions de l&#8217;article L. 1235-3-1.
