Une soci\u00e9t\u00e9, acqu\u00e9reur de lots dans une copropri\u00e9t\u00e9, avait \u00e9t\u00e9 condamn\u00e9e \u00e0 conserver l&#8217;usage d&#8217;habitation de ces lots. Ayant lou\u00e9 les locaux \u00e0 une soci\u00e9t\u00e9 tierce pour un usage de bureaux, elle avait sollicit\u00e9 des pr\u00e9cisions sur l&#8217;obligation mise \u00e0 sa charge. Le syndicat des copropri\u00e9taires opposait l&#8217;irrecevabilit\u00e9 de la demande en raison de la clart\u00e9 de la d\u00e9cision. La cour a d\u00e9clar\u00e9 la requ\u00eate recevable et pr\u00e9cis\u00e9 que la condamnation s&#8217;interpr\u00e9tait par r\u00e9f\u00e9rence \u00e0 l&#8217;acte de vente indiquant que les lots constituaient une unit\u00e9 d&#8217;habitation, rejetant toute autre demande. La question centrale \u00e9tait de d\u00e9terminer dans quelles limites un juge peut interpr\u00e9ter sa propre d\u00e9cision et comment d\u00e9finir la notion d&#8217;usage d&#8217;habitation en copropri\u00e9t\u00e9.<\/p>\n<h2 id=\"i-les-conditions-de-linterpretation-dune-decision-judiciaire\">I. Les conditions de l&#8217;interpr\u00e9tation d&#8217;une d\u00e9cision judiciaire<\/h2>\n<p><\/p>\n<h3 id=\"a-la-recevabilite-de-la-requete-en-interpretation\">A. La recevabilit\u00e9 de la requ\u00eate en interpr\u00e9tation<\/h3>\n<p>La cour a d&#8217;abord \u00e9cart\u00e9 le moyen tir\u00e9 du caract\u00e8re clair et pr\u00e9cis de la condamnation pour d\u00e9clarer la requ\u00eate recevable. Elle a jug\u00e9 que <em>&#8220;le caract\u00e8re clair et pr\u00e9cis de la condamnation litigieuse all\u00e9gu\u00e9 par le syndicat des copropri\u00e9taires constitue \u00e0 l&#8217;\u00e9vidence un argument de fond tendant \u00e0 faire rejeter la requ\u00eate en interpr\u00e9tation&#8221;<\/em>. En cons\u00e9quence, <em>&#8220;\u00e0 d\u00e9faut pour la partie intim\u00e9e d&#8217;opposer une fin de non-recevoir, la requ\u00eate en interpr\u00e9tation ne peut qu&#8217;\u00eatre d\u00e9clar\u00e9e recevable&#8221;<\/em>. Cette solution rappelle que l&#8217;article 461 du code de proc\u00e9dure civile permet \u00e0 tout juge d&#8217;interpr\u00e9ter sa d\u00e9cision, sans que l&#8217;absence d&#8217;ambigu\u00eft\u00e9 apparente ne fasse obstacle \u00e0 la recevabilit\u00e9 de la demande. La cour distingue nettement la question de la recevabilit\u00e9, conditionn\u00e9e par l&#8217;absence de voie de recours, de celle du bien-fond\u00e9, qui suppose une obscurit\u00e9 r\u00e9elle. Ainsi, elle rejette la fin de non-recevoir soulev\u00e9e implicitement et privil\u00e9gie un acc\u00e8s large \u00e0 l&#8217;interpr\u00e9tation, conform\u00e9ment \u00e0 l&#8217;esprit de l&#8217;article 461.<\/p>\n<h3 id=\"b-les-limites-du-pouvoir-dinterpretation-du-juge\">B. Les limites du pouvoir d&#8217;interpr\u00e9tation du juge<\/h3>\n<p>La cour a ensuite cantonn\u00e9 strictement son office en rappelant qu&#8217;<em>&#8220;il n&#8217;appartient pas \u00e0 la cour d&#8217;appel de sugg\u00e9rer \u00e0 la soci\u00e9t\u00e9 La Cara, ni les \u00e9ventuelles mesures \u00e0 prendre pour respecter sa condamnation, ni les moyens de preuve du respect de celle-ci&#8221;<\/em>. Elle refuse ainsi de se substituer au d\u00e9biteur de l&#8217;obligation pour d\u00e9finir les actes concrets d&#8217;ex\u00e9cution. Cette retenue s&#8217;explique par la nature de l&#8217;interpr\u00e9tation, qui doit se limiter \u00e0 \u00e9clairer un point obscur sans ajouter \u00e0 la d\u00e9cision. La cour pr\u00e9cise, en tant que de besoin, que la condamnation <em>&#8220;s&#8217;interpr\u00e8te par r\u00e9f\u00e9rence aux pr\u00e9visions de l&#8217;acte de vente du 27 juillet 2023 indiquant que les lots 19, 20, 22 et 23 constituent actuellement une seule et m\u00eame unit\u00e9 d&#8217;habitation&#8221;<\/em>. Elle fixe ainsi un crit\u00e8re objectif, tir\u00e9 de la qualification contractuelle originaire, sans entrer dans des prescriptions de comportement. L&#8217;interpr\u00e9tation ne modifie pas la substance de la condamnation ; elle en explicite le fondement.<\/p>\n<h2 id=\"ii-la-portee-de-linterpretation-donnee-par-la-cour\">II. La port\u00e9e de l&#8217;interpr\u00e9tation donn\u00e9e par la cour<\/h2>\n<p><\/p>\n<h3 id=\"a-la-reference-a-lacte-de-vente-comme-critere-objectif\">A. La r\u00e9f\u00e9rence \u00e0 l&#8217;acte de vente comme crit\u00e8re objectif<\/h3>\n<p>En retenant l&#8217;acte de vente comme \u00e9l\u00e9ment de r\u00e9f\u00e9rence, la cour consacre une approche concr\u00e8te de la notion d&#8217;usage d&#8217;habitation. Elle se fonde sur la qualification juridique initiale des lots, telle qu&#8217;elle r\u00e9sulte du contrat de vente, plut\u00f4t que sur une d\u00e9finition abstraite. Cette solution est coh\u00e9rente avec la jurisprudence applicable en mati\u00e8re de copropri\u00e9t\u00e9. La Cour de cassation a en effet jug\u00e9 que <em>&#8220;les copropri\u00e9taires ne pouvaient changer l&#8217;affectation de leurs lots que sous r\u00e9serve qu&#8217;elle ne soit pas contraire \u00e0 la destination g\u00e9n\u00e9rale de l&#8217;immeuble et ne porte pas atteinte aux droits des autres copropri\u00e9taires&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/682ebb829d9918cbebdef1b1\" rel=\"nofollow\" target=\"_blank\">(Cass. Troisi\u00e8me chambre civile, 22 mai 2025, n\u00b023-19.387)<\/a><\/strong>. De m\u00eame, une cour d&#8217;appel a rappel\u00e9 que <em>&#8220;chaque copropri\u00e9taire dispose des parties privatives comprises dans son lot ; il use et jouit librement des parties privatives et des parties communes sous la condition de ne porter atteinte ni aux droits des autres copropri\u00e9taires ni \u00e0 la destination de l&#8217;immeuble&#8221;<\/em> <strong><a href=\"https:\/\/www.courdecassation.fr\/decision\/679089a6a212a19f662df6ee\" rel=\"nofollow\" target=\"_blank\">(Cour d&#8217;appel de Reims, 21 janvier 2025, n\u00b023\/01798)<\/a><\/strong>. En l&#8217;esp\u00e8ce, l&#8217;acte de vente attestait que les lots formaient une unit\u00e9 d&#8217;habitation, ce qui constitue une donn\u00e9e objective permettant de d\u00e9terminer le contenu de l&#8217;obligation.<\/p>\n<h3 id=\"b-le-rejet-des-demandes-dinjonctions-complementaires\">B. Le rejet des demandes d&#8217;injonctions compl\u00e9mentaires<\/h3>\n<p>La cour a rejet\u00e9 <em>&#8220;le surplus des demandes de la soci\u00e9t\u00e9 La Cara comme ne relevant pas d&#8217;une interpr\u00e9tation des d\u00e9cisions rendues&#8221;<\/em>. La soci\u00e9t\u00e9 demandait notamment \u00e0 savoir si l&#8217;absence d&#8217;exploitation des locaux et l&#8217;absence d&#8217;accueil de salari\u00e9s ou de clients suffisaient \u00e0 ex\u00e9cuter la condamnation. En refusant de r\u00e9pondre, la cour maintient fermement la distinction entre l&#8217;interpr\u00e9tation, qui vise \u00e0 dissiper une ambigu\u00eft\u00e9, et l&#8217;ex\u00e9cution, qui rel\u00e8ve de la diligence du d\u00e9biteur. Ce faisant, elle \u00e9vite de se prononcer sur des circonstances de fait qui pourraient \u00e9voluer. La solution laisse au d\u00e9biteur la responsabilit\u00e9 de prendre les mesures n\u00e9cessaires pour que les lots retrouvent leur affectation d&#8217;habitation, sous le contr\u00f4le ult\u00e9rieur du juge de l&#8217;ex\u00e9cution en cas de liquidation de l&#8217;astreinte.
