Le salari\u00e9 contestait son licenciement pour faute et r\u00e9clamait diverses indemnit\u00e9s li\u00e9es \u00e0 son temps de travail. La cour a infirm\u00e9 le jugement de premi\u00e8re instance en retenant l&#8217;absence de cause r\u00e9elle et s\u00e9rieuse au licenciement et en allouant plusieurs cr\u00e9ances salariales. Elle a pr\u00e9cis\u00e9ment d\u00e9fini les obligations probatoires en mati\u00e8re de d\u00e9compte du temps de travail et sanctionn\u00e9 la violation d&#8217;une garantie proc\u00e9durale disciplinaire.<\/p>\n<p>La r\u00e9partition de la charge de la preuve des heures travaill\u00e9es<\/p>\n<p>La cour rappelle les principes gouvernant la preuve du temps de travail effectif en cas de litige. Cette charge initiale incombe au demandeur.<\/p>\n<p>L&#8217;employeur doit ensuite fournir les \u00e9l\u00e9ments de nature \u00e0 justifier les horaires r\u00e9alis\u00e9s. &#8220;En cas de litige relatif \u00e0 l&#8217;existence ou au nombre d&#8217;heures de travail accomplies, il appartient au salari\u00e9 de pr\u00e9senter, \u00e0 l&#8217;appui de sa demande, des \u00e9l\u00e9ments suffisamment pr\u00e9cis quant aux heures non r\u00e9mun\u00e9r\u00e9es qu&#8217;il pr\u00e9tend avoir accomplies afin de permettre \u00e0 l&#8217;employeur, qui assure le contr\u00f4le des heures de travail effectu\u00e9es, d&#8217;y r\u00e9pondre utilement en produisant ses propres \u00e9l\u00e9ments&#8221; (Motifs). La cour applique strictement ce principe.<\/p>\n<p>La valeur de cette solution r\u00e9side dans l&#8217;\u00e9quilibre trouv\u00e9 entre les parties. Le salari\u00e9 n&#8217;est pas dispens\u00e9 d&#8217;apporter des premiers \u00e9l\u00e9ments concrets, comme des agendas ou des courriels. L&#8217;employeur, qui d\u00e9tient les moyens de contr\u00f4le, ne peut se contenter de critiques g\u00e9n\u00e9rales. Il doit produire des documents objectifs pour contredire les all\u00e9gations. La port\u00e9e est pratique, guidant les juges dans l&#8217;appr\u00e9ciation souveraine des preuves contradictoires.<\/p>\n<p>La sanction d&#8217;une irr\u00e9gularit\u00e9 proc\u00e9durale dans la discipline<\/p>\n<p>La cour examine la r\u00e9gularit\u00e9 de la proc\u00e9dure disciplinaire ayant conduit au licenciement. Elle se fonde sur les r\u00e9f\u00e9rentiels internes de l&#8217;entreprise, qui pr\u00e9voient des garanties sp\u00e9cifiques. L&#8217;article 4.8 du chapitre 9 du r\u00e9f\u00e9rentiel RH00001 impose de porter \u00e0 la connaissance du salari\u00e9 les commentaires de son chef en d\u00e9saccord avec ses d\u00e9clarations. &#8220;Il est constant que ces d\u00e9clarations n&#8217;ont pas \u00e9t\u00e9 port\u00e9es \u00e0 sa connaissance en parall\u00e8le de son avis de son passage devant le conseil de discipline, ce qui l&#8217;a priv\u00e9 notamment de la possibilit\u00e9 de fournir \u00e9ventuellement des explications \u00e9crites compl\u00e9mentaires \u00e0 cet \u00e9gard&#8221; (Motifs).<\/p>\n<p>La violation de cette r\u00e8gle est sanctionn\u00e9e par la nullit\u00e9 du licenciement. &#8220;Une telle rupture prononc\u00e9e en m\u00e9connaissance d&#8217;une r\u00e8gle de proc\u00e9dure disciplinaire pr\u00e9vue par ce statut, constituant une garantie de fond, est d\u00e9pourvue de cause r\u00e9elle et s\u00e9rieuse&#8221; (Motifs). La cour constate que les d\u00e9clarations du sup\u00e9rieur hi\u00e9rarchique contredisaient celles du salari\u00e9 sur des points essentiels. Le d\u00e9faut de communication a priv\u00e9 l&#8217;int\u00e9ress\u00e9 d&#8217;une garantie de fond.<\/p>\n<p>Cette analyse rejoint la jurisprudence selon laquelle l&#8217;irr\u00e9gularit\u00e9 d&#8217;une proc\u00e9dure interne viciant les droits de la d\u00e9fense entache le licenciement. &#8220;La chambre sociale a jug\u00e9 que l&#8217;irr\u00e9gularit\u00e9 commise dans le d\u00e9roulement de la proc\u00e9dure disciplinaire, pr\u00e9vue par une disposition conventionnelle ou un r\u00e8glement int\u00e9rieur, est assimil\u00e9e \u00e0 la violation d&#8217;une garantie de fond et rend le licenciement sans cause r\u00e9elle et s\u00e9rieuse lorsqu&#8217;elle a priv\u00e9 le salari\u00e9 de droits de sa d\u00e9fense&#8221; (Cour d&#8217;appel de Reims, le 19 juin 2025, n\u00b024\/01184). La port\u00e9e est significative pour les proc\u00e9dures internes complexes.<\/p>\n<p>La d\u00e9cision renforce ainsi la protection des garanties proc\u00e9durales issues de sources internes \u00e0 l&#8217;entreprise. Elle rappelle que le non-respect d&#8217;une r\u00e8gle destin\u00e9e \u00e0 assurer la contradiction et la d\u00e9fense, d\u00e8s lors qu&#8217;elle a pu influencer la d\u00e9cision, vicie irr\u00e9m\u00e9diablement la proc\u00e9dure.
