Un copropri\u00e9taire demandait l&#8217;ex\u00e9cution de travaux sur une toiture-terrasse commune \u00e0 l&#8217;origine de d\u00e9sordres. Le syndicat soulevait une fin de non-recevoir pour d\u00e9faut d&#8217;int\u00e9r\u00eat et contestait sa responsabilit\u00e9. La cour a rejet\u00e9 ces arguments et a ordonn\u00e9 les travaux sous astreinte, en condamnant le syndicat aux d\u00e9pens et \u00e0 une indemnit\u00e9 sur le fondement de l&#8217;article 700 du code de proc\u00e9dure civile.<\/p>\n<p>L&#8217;int\u00e9r\u00eat \u00e0 agir du copropri\u00e9taire face aux troubles de jouissance<\/p>\n<p>La recevabilit\u00e9 de l&#8217;action individuelle est fermement \u00e9tablie. Le syndicat contestait l&#8217;int\u00e9r\u00eat \u00e0 agir du demandeur, arguant qu&#8217;il ne d\u00e9tenait pas la jouissance de la toiture et que les constats n&#8217;\u00e9taient pas contradictoires. La cour \u00e9carte cet argument en rappelant la valeur probatoire des constats d&#8217;huissier. &#8220;un constat op\u00e9r\u00e9 par un officier minist\u00e9riel peut \u00eatre admis \u00e0 titre probatoire quand bien m\u00eame il n&#8217;a pas \u00e9t\u00e9 dress\u00e9 contradictoirement, d\u00e8s lors qu&#8217;il est r\u00e9guli\u00e8rement produit aux d\u00e9bats pour y \u00eatre discut\u00e9&#8221; (Cf. Cass. 3\u00e8me civ., 9 nov. 2004, n\u00b0 03-14.211). Les troubles constat\u00e9s, notamment l&#8217;obstruction de la lumi\u00e8re, sont ainsi retenus.<\/p>\n<p>L&#8217;application des textes r\u00e9gissant la copropri\u00e9t\u00e9 consacre un int\u00e9r\u00eat \u00e0 agir large. La cour se fonde sur l&#8217;article 15 de la loi du 10 juillet 1965. &#8220;Tout copropri\u00e9taire peut n\u00e9anmoins exercer seul les actions&#8221;. Elle rel\u00e8ve que les d\u00e9sordres proviennent d&#8217;une partie commune et affectent les lots du demandeur. D\u00e8s lors, son int\u00e9r\u00eat \u00e0 agir pour y rem\u00e9dier est jug\u00e9 &#8220;indiscutable&#8221;. Cette analyse assure une protection effective des droits individuels des copropri\u00e9taires l\u00e9s\u00e9s par des d\u00e9fauts d&#8217;entretien des parties communes.<\/p>\n<p>Le trouble manifestement illicite justifiant une injonction sous astreinte<\/p>\n<p>Le fondement juridique de l&#8217;injonction en r\u00e9f\u00e9r\u00e9 est clairement identifi\u00e9. La cour rappelle les pouvoirs du juge des r\u00e9f\u00e9r\u00e9s issus des articles 834 et 835 du code de proc\u00e9dure civile. Elle souligne que la pr\u00e9sence d&#8217;une contestation s\u00e9rieuse sur la r\u00e9partition des responsabilit\u00e9s n&#8217;est pas un obstacle. &#8220;d\u00e8s lors qu&#8217;il est acquis et non contest\u00e9 que les dommages invoqu\u00e9s trouvent leur origine dans l&#8217;\u00e9tanch\u00e9it\u00e9 d\u00e9fectueuse du toit-terrasse, qui est une partie commune&#8221;. Le syndicat est donc tenu \u00e0 une obligation l\u00e9gale de conservation.<\/p>\n<p>Le refus d&#8217;agir du syndicat constitue un trouble illicite justifiant une mesure urgente. La cour valide la qualification de trouble manifestement illicite retenue par les premiers juges. Ce trouble d\u00e9coule du &#8220;manifeste manquement \u00e0 son obligation de conservation et d&#8217;entretien des parties communes&#8221;. L&#8217;astreinte est confirm\u00e9e comme proportionn\u00e9e \u00e0 l&#8217;anciennet\u00e9 des d\u00e9sordres et \u00e0 l&#8217;abstention du syndicat.
