Il \u00e9tait saisi par un bailleur demandant la r\u00e9siliation d\u2019un bail pour d\u00e9faut de paiement et l\u2019expulsion des locataires. Le juge a examin\u00e9 la r\u00e9gularit\u00e9 de la proc\u00e9dure de r\u00e9siliation engag\u00e9e et les cons\u00e9quences de l\u2019inex\u00e9cution. Il a constat\u00e9 la r\u00e9siliation du bail, ordonn\u00e9 l\u2019expulsion et condamn\u00e9 les occupants au paiement des sommes dues et \u00e0 une indemnit\u00e9 d\u2019occupation.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale de la r\u00e9siliation pour d\u00e9faut de paiement<\/p>\n<p>Le juge v\u00e9rifie d\u2019abord le strict respect des formalit\u00e9s l\u00e9gales protectrices. Le commandement de payer, acte introductif n\u00e9cessaire, doit contenir des mentions obligatoires sous peine de nullit\u00e9. La d\u00e9cision rappelle que &#8220;toute clause pr\u00e9voyant la r\u00e9siliation de plein droit du contrat de location pour d\u00e9faut de paiement du loyer ou des charges aux termes convenus ou pour non-versement du d\u00e9p\u00f4t de garantie ne produit effet que deux mois apr\u00e8s un commandement de payer demeur\u00e9 infructueux&#8221; (article 24 de la loi du 6 juillet 1989). L\u2019acte de commissaire de justice produit d\u00e9montre le respect de ce formalisme. Cette exigence garantit au locataire une information compl\u00e8te sur ses droits et les d\u00e9lais dont il dispose. La port\u00e9e de ce contr\u00f4le est essentielle pour assurer la s\u00e9curit\u00e9 juridique de la proc\u00e9dure d\u2019expulsion. Le juge s\u2019assure \u00e9galement du respect des obligations de signalement aux organismes sociaux. La proc\u00e9dure est jug\u00e9e r\u00e9guli\u00e8re &#8220;d\u00e8s lors que les d\u00e9lais pr\u00e9vus \u00e0 l\u2019article 24 alin\u00e9a 2 de la loi 89-462 du 06 juillet 1989 ont \u00e9t\u00e9 respect\u00e9s tant pour le signalement de la situation d\u2019impay\u00e9 \u00e0 la CCAPEX&#8221; (Motifs). Ce contr\u00f4le renforce la protection des locataires en difficult\u00e9 en int\u00e9grant une dimension sociale \u00e0 la proc\u00e9dure. La valeur de cette analyse est de lier la r\u00e9gularit\u00e9 formelle \u00e0 l\u2019effectivit\u00e9 des dispositifs de pr\u00e9vention des expulsions.<\/p>\n<p>Les cons\u00e9quences civiles de l\u2019inex\u00e9cution du contrat<\/p>\n<p>La constatation de la r\u00e9siliation entra\u00eene des effets imm\u00e9diats sur la situation des occupants. Ceux-ci, n\u2019\u00e9tant plus locataires, se trouvent dans une situation d\u2019occupation sans titre. Le juge ordonne donc logiquement &#8220;la lib\u00e9ration des lieux&#8221; et, \u00e0 d\u00e9faut, &#8220;il sera proc\u00e9d\u00e9 \u00e0 leur expulsion&#8221; (Dispositif). Cette mesure vise \u00e0 permettre au bailleur de recouvrer la libre disposition de son bien. La d\u00e9cision illustre la rigueur de l\u2019ex\u00e9cution forc\u00e9e en cas de d\u00e9faillance persistante. Pour pr\u00e9venir tout pr\u00e9judice au bailleur durant cette p\u00e9riode, une indemnit\u00e9 d\u2019occupation est accord\u00e9e. Le juge fixe celle-ci &#8220;\u00e0 compter du 21 novembre 2023, une indemnit\u00e9 d&#8217;occupation mensuelle provisionnelle d&#8217;un montant \u00e9gal \u00e0 celui des loyers et provisions sur charges&#8221; (Motifs). Cette condamnation a pour sens de compenser l\u2019enrichissement sans cause des occupants et de dissuader la prolongation indue de l\u2019occupation. Par ailleurs, le juge statue sur la dette locative r\u00e9siduelle. Il condamne les locataires \u00e0 payer &#8220;la somme de 647,15 euros au titre des loyers, charges et indemnit\u00e9s d&#8217;occupation impay\u00e9s&#8221; (Motifs). Le caract\u00e8re provisionnel de cette condamnation renvoie l\u2019examen d\u00e9finitif des comptes au juge du fond.
