Le bailleur, un organisme public, invoque une clause r\u00e9solutoire apr\u00e8s un commandement de payer demeur\u00e9 infructueux. La juridiction doit v\u00e9rifier la recevabilit\u00e9 de l\u2019action et les conditions d\u2019acquisition de la clause. Elle constate l\u2019acquisition de la clause et ordonne l\u2019expulsion, refusant d\u2019accorder des d\u00e9lais de paiement, tout en condamnant l\u2019occupante au paiement des sommes dues.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale de la demande en expulsion<\/p>\n<p>Le juge v\u00e9rifie scrupuleusement le respect des formalit\u00e9s pr\u00e9alables impos\u00e9es par la loi. Ces conditions de recevabilit\u00e9 sont des garde-fous essentiels pour le locataire.<\/p>\n<p>Le contr\u00f4le des d\u00e9lais de saisine et de notification<\/p>\n<p>L\u2019action est jug\u00e9e recevable au regard du strict respect des d\u00e9lais l\u00e9gaux. Le bailleur justifie avoir saisi la commission de pr\u00e9vention des expulsions plus de deux mois avant l\u2019assignation. &#8220;l&#8217;OPH du d\u00e9partement du [Localit\u00e9 9] (HABITAT 25) justifie avoir saisi la commission de coordination des actions de pr\u00e9vention des expulsions locatives le 9 juillet 2024, soit deux mois au moins avant la d\u00e9livrance de l\u2019assignation du 16 mai 2025&#8221; (Motifs, II). La notification de l\u2019assignation \u00e0 la pr\u00e9fecture est \u00e9galement intervenue dans le d\u00e9lai de six semaines requis avant l\u2019audience. Ce contr\u00f4le formel rigoureux assure la s\u00e9curit\u00e9 juridique de la proc\u00e9dure d\u2019expulsion.<\/p>\n<p>La port\u00e9e des conditions de recevabilit\u00e9<\/p>\n<p>Cette analyse rappelle le caract\u00e8re imp\u00e9ratif des formalit\u00e9s pr\u00e9alables \u00e0 l\u2019expulsion. Leur m\u00e9connaissance entra\u00eenerait l\u2019irrecevabilit\u00e9 de la demande, prot\u00e9geant ainsi le locataire contre une proc\u00e9dure exp\u00e9ditive. La d\u00e9cision souligne que ces \u00e9tapes, notamment la saisine de la commission, ne sont pas de simples formalit\u00e9s. Elles constituent un pr\u00e9alable substantiel visant \u00e0 favoriser une solution amiable et \u00e0 pr\u00e9venir l\u2019expulsion. Leur respect conditionne l\u2019examen au fond par le juge.<\/p>\n<p>L\u2019acquisition de la clause r\u00e9solutoire et le refus de d\u00e9lais de paiement<\/p>\n<p>Le c\u0153ur de la d\u00e9cision r\u00e9side dans l\u2019appr\u00e9ciation des conditions de mise en \u0153uvre de la clause r\u00e9solutoire. Le juge en constate l\u2019acquisition tout en pr\u00e9cisant les limites de son pouvoir d\u2019am\u00e9nagement.<\/p>\n<p>Le constat de l\u2019inex\u00e9cution et l\u2019effet du commandement<\/p>\n<p>La clause r\u00e9solutoire stipul\u00e9e au contrat ne produit effet qu\u2019apr\u00e8s un commandement de payer demeur\u00e9 infructueux pendant six semaines. Le bailleur a accord\u00e9 un d\u00e9lai plus favorable de deux mois. &#8220;Ce commandement est demeur\u00e9 infructueux pendant plus de deux mois, de sorte qu\u2019il y a lieu de constater que les conditions d\u2019acquisition de la clause r\u00e9solutoire contenue dans le bail \u00e9taient r\u00e9unies&#8221; (Motifs, II). Le juge constate donc son acquisition \u00e0 une date certaine, transformant l\u2019occupante en personne sans droit ni titre.<\/p>\n<p>Le pouvoir discr\u00e9tionnaire du juge pour accorder des d\u00e9lais<\/p>\n<p>Le juge examine la possibilit\u00e9 d\u2019accorder des d\u00e9lais de paiement mais l\u2019\u00e9carte. Il rel\u00e8ve que le locataire n\u2019a pas repris le paiement int\u00e9gral du loyer courant avant l\u2019audience. &#8220;bien que la dette soit en constante diminution depuis la signification du commandement de payer, les \u00e9ch\u00e9ances de juin et juillet 2025 n&#8217;ont pas \u00e9t\u00e9 r\u00e9gl\u00e9es en totalit\u00e9&#8221; (Motifs, II). Il pr\u00e9cise surtout que depuis la r\u00e9forme de 2023, il ne peut plus accorder de d\u00e9lais d\u2019office. Ce point confirme une jurisprudence ant\u00e9rieure. &#8220;L&#8217;article 24 V de la loi du 6 juillet 1989 dispose que : Le juge peut, m\u00eame d&#8217;office, accorder des d\u00e9lais de paiement&#8221; (Cour d&#8217;appel de Douai, le 4 septembre 2025, n\u00b024\/03518). La d\u00e9cision comment\u00e9e montre l\u2019\u00e9volution : le juge ne le peut plus d\u2019office, et les conditions l\u00e9gales n\u2019\u00e9taient pas remplies.<\/p>\n<p>La port\u00e9e de la d\u00e9cision et ses cons\u00e9quences pratiques<\/p>\n<p>Cette d\u00e9cision illustre l\u2019\u00e9quilibre recherch\u00e9 par le l\u00e9gislateur entre protection du locataire et droits du bailleur. Elle rappelle que la clause r\u00e9solutoire n\u2019est plus automatique mais n\u00e9cessite une proc\u00e9dure formalis\u00e9e. Toutefois, une fois les conditions l\u00e9gales r\u00e9unies et en l\u2019absence de reprise du paiement courant, le juge a l\u2019obligation de constater l\u2019expulsion. Le refus de d\u00e9lais de paiement, fond\u00e9 sur un texte pr\u00e9cis, limite son pouvoir d\u2019appr\u00e9ciation pour favoriser une ex\u00e9cution stricte des obligations contractuelles.
