Le preneur conteste le bien-fond\u00e9 de la cr\u00e9ance et invoque des troubles de jouissance justifiant selon lui le non-paiement. Les juges rejettent la plupart des moyens de l&#8217;occupant mais accordent une r\u00e9duction des charges pour vice de forme. Ils constatent ensuite la r\u00e9siliation du bail par acquisition de la clause r\u00e9solutoire et ordonnent l&#8217;expulsion.<\/p>\n<p>La validation exigeante du commandement de payer<\/p>\n<p>La d\u00e9cision rappelle d&#8217;abord les conditions de validit\u00e9 du commandement, instrument essentiel de la clause r\u00e9solutoire. Le commandement doit permettre une identification claire des sommes r\u00e9clam\u00e9es pour \u00eatre efficace. Le tribunal pr\u00e9cise que &#8220;le commandement de payer visant la clause r\u00e9solutoire doit \u00e9noncer de mani\u00e8re pr\u00e9cise et d\u00e9taill\u00e9e les sommes dues par le locataire&#8221; (Motifs). Il ajoute qu&#8217;un montant sur\u00e9valu\u00e9 reste valable pour la partie non contest\u00e9e. En l&#8217;esp\u00e8ce, le document \u00e9tait accompagn\u00e9 d&#8217;un historique de compte d\u00e9taill\u00e9 rendant les sommes parfaitement identifiables. Cette analyse garantit une s\u00e9curit\u00e9 juridique pour le bailleur tout en prot\u00e9geant le locataire contre des r\u00e9clamations obscures. La port\u00e9e de ce contr\u00f4le strict est illustr\u00e9e par une jurisprudence o\u00f9 un commandement pr\u00e9cis a permis de constater l&#8217;acquisition de la clause (Tribunal judiciaire de Bobigny, le 23 janvier 2025, n\u00b024\/09329). Le juge \u00e9carte ensuite les contestations sur le fond de la cr\u00e9ance, notamment la prescription, par l&#8217;application des r\u00e8gles d&#8217;imputation des paiements sur la dette la plus ancienne.<\/p>\n<p>Le rejet de l&#8217;exception d&#8217;inex\u00e9cution et la sanction du d\u00e9faut de paiement<\/p>\n<p>Le tribunal d\u00e9finit ensuite les conditions strictes de l&#8217;exception d&#8217;inex\u00e9cution en mati\u00e8re de bail commercial. Il rappelle que &#8220;les manquements invoqu\u00e9s \u00e0 son encontre, \u00e0 l&#8217;origine de troubles de jouissance, doivent non seulement \u00eatre d\u00e9montr\u00e9s par le preneur mais encore rev\u00eatir une gravit\u00e9 suffisante pour justifier le non paiement des loyers&#8221; (Motifs). L&#8217;occupant invoquait la perte d&#8217;acc\u00e8s \u00e0 certaines pi\u00e8ces, l&#8217;absence de m\u00e9nage ou de chauffage. Les juges estiment que ces griefs, non contractuels ou non d\u00e9montr\u00e9s, ne portaient pas une atteinte suffisante \u00e0 la jouissance. La valeur de cette solution r\u00e9side dans l&#8217;affirmation du principe selon lequel l&#8217;occupation effective des locaux exclut une dispense totale de loyer. Le rejet des demandes reconventionnelles en d\u00e9coule logiquement, sauf une r\u00e9duction de charges pour non-conformit\u00e9 du bail \u00e0 la loi Pinel. Sur la clause r\u00e9solutoire, le juge constate son acquisition car le commandement, valable pour la somme due apr\u00e8s r\u00e9duction, est rest\u00e9 infructueux. Il refuse d&#8217;accorder des d\u00e9lais de gr\u00e2ce, notant un d\u00e9faut de paiement r\u00e9p\u00e9t\u00e9 et ancien. Cette s\u00e9v\u00e9rit\u00e9 s&#8217;oppose \u00e0 des solutions plus cl\u00e9mentes lorsque le juge use de son pouvoir d&#8217;octroyer des d\u00e9lais (Cour d&#8217;appel de Paris, le 12 juin 2025, n\u00b022\/01176).
