Le bailleur demandait la r\u00e9siliation du bail pour impay\u00e9s et l&#8217;expulsion de la locataire. Apr\u00e8s avoir v\u00e9rifi\u00e9 la recevabilit\u00e9 de l&#8217;action, le juge a constat\u00e9 la r\u00e9union des conditions de la clause r\u00e9solutoire. Il a en cons\u00e9quence ordonn\u00e9 l&#8217;expulsion et condamn\u00e9 la locataire au paiement des sommes dues.<\/p>\n<p>La recevabilit\u00e9 de l&#8217;action en r\u00e9siliation<\/p>\n<p>Le juge v\u00e9rifie d&#8217;abord le respect des formalit\u00e9s pr\u00e9alables impos\u00e9es par la loi. La saisine de la commission de pr\u00e9vention des expulsions est une condition essentielle. &#8220;Madame [I] [G] [H] justifie avoir saisi la Commission de coordination des actions de pr\u00e9vention des expulsions locatives le 17 f\u00e9vrier 2025, soit deux mois au moins avant la d\u00e9livrance de l\u2019assignation du 18 juin 2025&#8221; (Motifs). Ce point est crucial pour \u00e9viter l&#8217;irrecevabilit\u00e9 de la demande, comme le rappelle une jurisprudence. &#8220;VOSGELIS justifie avoir saisi la Caisse des allocations familiales des Vosges le 25 mars 2025, soit deux mois au moins avant la d\u00e9livrance de l&#8217;assignation, conform\u00e9ment aux dispositions de l&#8217;article 24 II de la loi n\u00b089-462 du 06 juillet 1989&#8221; (Tribunal judiciaire, le 3 f\u00e9vrier 2026, n\u00b025\/02681). Le respect du d\u00e9lai de six semaines entre l&#8217;assignation et l&#8217;audience est \u00e9galement contr\u00f4l\u00e9. L&#8217;assignation notifi\u00e9e le 19 juin pour une audience du 1er septembre satisfait \u00e0 l&#8217;article 24 III. Ces v\u00e9rifications pr\u00e9alables garantissent la r\u00e9gularit\u00e9 proc\u00e9durale et le droit \u00e0 un proc\u00e8s \u00e9quitable.<\/p>\n<p>L&#8217;acquisition des effets de la clause r\u00e9solutoire<\/p>\n<p>Le juge analyse ensuite les conditions de mise en \u0153uvre de la clause l\u00e9gale. La loi du 27 juillet 2023 a modifi\u00e9 le d\u00e9lai apr\u00e8s commandement, le r\u00e9duisant de deux mois \u00e0 six semaines. Le juge pr\u00e9cise le champ d&#8217;application de cette nouvelle r\u00e8gle. &#8220;Ces dispositions nouvelles, d&#8217;application imm\u00e9diate, ne peuvent n\u00e9anmoins s\u2019appliquer aux commandements de payer d\u00e9livr\u00e9s ant\u00e9rieurement au 29 juillet 2023, non plus qu\u2019\u00e0 ceux d\u00e9livr\u00e9s post\u00e9rieurement, mais qui mentionneraient encore un d\u00e9lai de 2 mois&#8221; (Motifs). En l&#8217;esp\u00e8ce, le bail et le commandement invoquent un d\u00e9lai de deux mois, toujours applicable. Le commandement \u00e9tant rest\u00e9 infructueux, &#8220;les conditions d\u2019acquisition de la clause r\u00e9solutoire contenue dans le bail se sont trouv\u00e9es r\u00e9unies \u00e0 la date du 15 avril 2025&#8221; (Motifs). Le juge \u00e9carte enfin toute suspension des effets. Aucune demande de d\u00e9lais de paiement n&#8217;est formul\u00e9e et le loyer courant n&#8217;a pas \u00e9t\u00e9 repris. Le juge peut ainsi ordonner l&#8217;expulsion et une indemnit\u00e9 d&#8217;occupation provisionnelle. Cette analyse rigoureuse assure la s\u00e9curit\u00e9 juridique et l&#8217;effectivit\u00e9 du droit du bailleur.<\/p>\n<p>La port\u00e9e de la d\u00e9cision en proc\u00e9dure de r\u00e9f\u00e9r\u00e9<\/p>\n<p>Cette ordonnance illustre l&#8217;\u00e9tendue des pouvoirs du juge des contentieux de la protection statuant en r\u00e9f\u00e9r\u00e9. Il statue sur le fond en l&#8217;absence de comparution de la d\u00e9fenderesse, conform\u00e9ment \u00e0 l&#8217;article 472 du code de proc\u00e9dure civile. Surtout, il prononce des mesures ex\u00e9cutoires par provision malgr\u00e9 l&#8217;existence d&#8217;un diff\u00e9rend s\u00e9rieux. L&#8217;octroi d&#8217;une provision pour l&#8217;arri\u00e9r\u00e9 et l&#8217;indemnit\u00e9 d&#8217;occupation future en est la manifestation. &#8220;Le pr\u00e9sident du tribunal judiciaire ou le juge des contentieux de la protection dans les limites de sa comp\u00e9tence peuvent toujours, m\u00eame en pr\u00e9sence d&#8217;une contestation s\u00e9rieuse, prescrire en r\u00e9f\u00e9r\u00e9 les mesures conservatoires ou de remise en \u00e9tat qui s&#8217;imposent&#8221; (Motifs, art. 835 CPC). La d\u00e9cision assure ainsi une protection efficace des droits du cr\u00e9ancier. Elle \u00e9vite que le pr\u00e9judice ne s&#8217;aggrave durant l&#8217;instance au fond.
