Le bailleur justifie d\u2019un commandement de payer demeur\u00e9 infructueux et sollicite l\u2019expulsion. Le locataire demande l\u2019octroi de d\u00e9lais de paiement. Le juge constate la r\u00e9siliation de plein droit du bail et d\u00e9boute le locataire de sa demande de d\u00e9lais, ordonnant son expulsion et le paiement d\u2019une indemnit\u00e9 d\u2019occupation.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale et le fondement de la r\u00e9siliation<\/p>\n<p>Le respect des formalit\u00e9s pr\u00e9alables \u00e0 l\u2019expulsion est scrupuleusement v\u00e9rifi\u00e9. Le juge constate la notification r\u00e9guli\u00e8re de l\u2019assignation au repr\u00e9sentant de l\u2019\u00c9tat. Il rel\u00e8ve \u00e9galement que les seuils de signalement \u00e0 la commission de pr\u00e9vention des expulsions sont atteints, le pr\u00e9fet ayant fix\u00e9 ces seuils \u00e0 un impay\u00e9 de trois mois ou \u00e0 une dette \u00e9quivalente \u00e0 trois fois le loyer mensuel. La saisine de la Caisse d\u2019Allocations Familiales dans les d\u00e9lais l\u00e9gaux est \u00e9galement justifi\u00e9e, rendant la demande recevable.<\/p>\n<p>La clause r\u00e9solutoire express\u00e9ment stipul\u00e9e produit ses effets de plein droit. Un commandement de payer visant cette clause a \u00e9t\u00e9 signifi\u00e9 pour un arri\u00e9r\u00e9 locatif pr\u00e9cis. Le juge rel\u00e8ve que &#8220;les causes de ce commandement de payer sont demeur\u00e9es impay\u00e9es pendant plus de deux mois&#8221;. En cons\u00e9quence, la r\u00e9siliation du contrat de bail est acquise \u00e0 compter d\u2019une date d\u00e9termin\u00e9e, sans qu\u2019une intervention judiciaire d\u00e9clarative ne soit n\u00e9cessaire au titre de l\u2019article 1224 du code civil.<\/p>\n<p>Le rejet des d\u00e9lais de paiement et ses cons\u00e9quences pratiques<\/p>\n<p>L\u2019octroi de d\u00e9lais de paiement est subordonn\u00e9 \u00e0 des conditions strictes non remplies. Le juge applique l\u2019article 24 de la loi du 6 juillet 1989, qui pr\u00e9voit que le juge peut accorder des d\u00e9lais &#8220;lorsque le locataire est en situation de r\u00e9gler sa dette locative et qu&#8217;il a repris le r\u00e8glement du loyer courant&#8221;. Le jugement constate qu\u2019en l\u2019esp\u00e8ce, &#8220;Monsieur [X] [C] n&#8217;a pas repris le r\u00e8glement du loyer courant&#8221;. Cette absence de reprise du versement courant fait obstacle \u00e0 tout report ou \u00e9chelonnement, confirmant une jurisprudence constante.<\/p>\n<p>Cette solution est en coh\u00e9rence avec une d\u00e9cision r\u00e9cente de la Cour d\u2019appel de N\u00eemes. Celle-ci a en effet jug\u00e9 que &#8220;la condition de reprise du versement int\u00e9gral du loyer courant n&#8217;est donc pas remplie&#8221; lorsqu\u2019aucun paiement n\u2019est intervenu (Cour d\u2019appel de N\u00eemes, le 24 avril 2025, n\u00b024\/00667). Le d\u00e9bout\u00e9 de la demande de d\u00e9lais entra\u00eene logiquement le rejet de la suspension des effets de la clause r\u00e9solutoire, rendant la r\u00e9siliation d\u00e9finitive.<\/p>\n<p>La requalification des sommes dues et le prononc\u00e9 de l\u2019expulsion<\/p>\n<p>Le maintien dans les lieux apr\u00e8s r\u00e9siliation transforme la nature des sommes exigibles. Le juge op\u00e8re une requalification n\u00e9cessaire des loyers \u00e9chus post\u00e9rieurement \u00e0 la rupture du contrat. Il pr\u00e9cise que &#8220;les sommes correspondant \u00e0 la p\u00e9riode suivant la r\u00e9siliation du bail doivent \u00eatre requalifi\u00e9es en indemnit\u00e9 d&#8217;occupation&#8221;. Cette indemnit\u00e9 est fix\u00e9e au montant du loyer contractuel augment\u00e9 des charges, garantissant au bailleur une compensation financi\u00e8re pendant l\u2019occupation sans titre.<\/p>\n<p>L\u2019expulsion est justifi\u00e9e par l\u2019importance et l\u2019anciennet\u00e9 de l\u2019arri\u00e9r\u00e9. Le juge estime que &#8220;l&#8217;anciennet\u00e9 et l&#8217;importance de l&#8217;arri\u00e9r\u00e9, justifient que le bailleur puisse \u00e0 nouveau disposer de son logement&#8221;. Il ordonne donc la lib\u00e9ration des lieux et, \u00e0 d\u00e9faut, l\u2019expulsion avec le concours de la force publique apr\u00e8s un commandement de quitter les lieux rest\u00e9 infructueux. Le prononc\u00e9 de l\u2019ex\u00e9cution provisoire de droit acc\u00e9l\u00e8re la remise en possession du logement au bailleur.<\/p>\n<p>Ce jugement illustre la rigueur proc\u00e9durale encadrant les expulsions locatives tout en affirmant l\u2019effectivit\u00e9 des clauses r\u00e9solutoires. Il rappelle avec fermet\u00e9 la condition essentielle de reprise du loyer courant pour b\u00e9n\u00e9ficier de d\u00e9lais de paiement, privant de tout sursis les locataires qui ne proc\u00e8dent pas \u00e0 ce r\u00e9tablissement pr\u00e9alable.
