Le bailleur sollicite l&#8217;expulsion de l&#8217;occupant pour d\u00e9faut de paiement d&#8217;un important arri\u00e9r\u00e9 de redevances. L&#8217;occupant, d\u00e9fendeur, ne compara\u00eet pas. Le juge rejette l&#8217;application de la clause r\u00e9solutoire mais prononce judiciairement la r\u00e9siliation du contrat pour manquement grave. Il ordonne l&#8217;expulsion sous d\u00e9lai et condamne l&#8217;occupant au paiement des sommes dues et d&#8217;une indemnit\u00e9 d&#8217;occupation.<\/p>\n<p>La distinction entre r\u00e9solution contractuelle et r\u00e9siliation judiciaire<\/p>\n<p>La d\u00e9cision op\u00e8re une distinction nette entre deux voies de rupture pour inex\u00e9cution. Elle \u00e9carte d&#8217;abord l&#8217;application de la clause r\u00e9solutoire stipul\u00e9e au contrat. Le bailleur produit un courrier de r\u00e9siliation mais ne justifie pas d\u2019un envoi par lettre recommand\u00e9e. La clause r\u00e9solutoire ne peut ainsi \u00eatre acquise. Ce point rappelle que la mise en \u0153uvre d&#8217;une telle clause est strictement subordonn\u00e9e au respect des modalit\u00e9s de notification contractuelles. Cette solution rejoint une jurisprudence constante exigeant une notification effective. Ainsi, il a \u00e9t\u00e9 jug\u00e9 que la mise en \u0153uvre de la clause r\u00e9solutoire du contrat de r\u00e9sidence d&#8217;un logement-foyer est subordonn\u00e9e \u00e0 la remise effective de la lettre de mise en demeure \u00e0 son destinataire (Tribunal judiciaire de Paris, le 30 janvier 2025, n\u00b024\/10119). La valeur de ce point est de prot\u00e9ger le contractant d\u00e9faillant contre une rupture automatique et parfois brutale.<\/p>\n<p>Le juge fonde ensuite la rupture sur le pouvoir g\u00e9n\u00e9ral de r\u00e9siliation pour manquement grave. En application des dispositions des articles 1103, 1217, 1224, 1 223 et 1741 du code civil, le juge peut prononcer la r\u00e9siliation du contrat liant les parties d\u00e8s lors que les manquements de l\u2019une des parties sont suffisamment graves et caract\u00e9ris\u00e9s. Le manquement est caract\u00e9ris\u00e9 par un arri\u00e9r\u00e9 locatif important et une abstention de tout r\u00e8glement prolong\u00e9e. Il en r\u00e9sulte l&#8217;existence d&#8217;un manquement suffisamment grave justifiant la r\u00e9siliation du contrat du contrat d\u2019occupation au jour de l\u2019assignation. La port\u00e9e de cette analyse est de r\u00e9affirmer la pr\u00e9\u00e9minence du contr\u00f4le judiciaire. Le juge conserve un pouvoir souverain pour appr\u00e9cier la gravit\u00e9 de l&#8217;inex\u00e9cution et fixer la date de rupture, ind\u00e9pendamment des clauses contractuelles.<\/p>\n<p>Les cons\u00e9quences patrimoniales et proc\u00e9durales de la r\u00e9siliation<\/p>\n<p>La d\u00e9cision d\u00e9taille les suites financi\u00e8res de la r\u00e9siliation prononc\u00e9e. Elle condamne d&#8217;abord l&#8217;occupant au paiement de l&#8217;arri\u00e9r\u00e9 de redevances et d&#8217;indemnit\u00e9s \u00e9chues, soit une somme importante. La soci\u00e9t\u00e9 RLF produit un d\u00e9compte d\u00e9montrant que l&#8217;occupant restait lui devoir la somme de 15316,42 euros. Elle institue \u00e9galement une indemnit\u00e9 d&#8217;occupation due jusqu&#8217;\u00e0 la lib\u00e9ration effective des lieux. Le montant de cette indemnit\u00e9 mensuelle d&#8217;occupation sera fix\u00e9 \u00e0 la somme correspondant \u00e0 celui de la redevance. La valeur de cette mesure est de r\u00e9parer int\u00e9gralement le pr\u00e9judice du bailleur. Elle \u00e9vite que l&#8217;occupation sans droit apr\u00e8s la r\u00e9siliation ne devienne un avantage injuste pour le locataire d\u00e9faillant.<\/p>\n<p>Sur le plan proc\u00e9dural, le juge organise l&#8217;expulsion tout en am\u00e9nageant des d\u00e9lais protecteurs. Il ordonne la lib\u00e9ration des lieux dans un d\u00e9lai de quinze jours puis pr\u00e9voit l&#8217;expulsion forc\u00e9e. Il rappelle cependant le d\u00e9lai l\u00e9gal de deux mois apr\u00e8s commandement et la tr\u00eave hivernale. Les conditions ne sont pas r\u00e9unies pour supprimer le d\u00e9lai de deux mois suivant le commandement de quitter les lieux. La port\u00e9e de ces dispositions est de concilier l&#8217;ex\u00e9cution forc\u00e9e avec les n\u00e9cessit\u00e9s de l&#8217;ordre public social. Le juge refuse par ailleurs une astreinte, estimant que les voies normales d&#8217;ex\u00e9cution suffisent.
