Le bailleur, ayant respect\u00e9 les formalit\u00e9s pr\u00e9alables, sollicite la r\u00e9solution du bail et l&#8217;expulsion du locataire, lequel est demeur\u00e9 non comparant. La juridiction examine la recevabilit\u00e9 de l&#8217;action puis les conditions d&#8217;acquisition des effets de la clause r\u00e9solutoire. Elle fait droit aux demandes principales en ordonnant l&#8217;expulsion et le paiement de sommes dues, tout en rejetant la demande d&#8217;astreinte.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale de la demande en expulsion<\/p>\n<p>Le juge v\u00e9rifie d&#8217;abord le respect des conditions de saisine et des formalit\u00e9s pr\u00e9alables imp\u00e9ratives. Le requ\u00e9rant justifie avoir notifi\u00e9 l&#8217;assignation \u00e0 la pr\u00e9fecture plus de six semaines avant l&#8217;audience. Il d\u00e9montre \u00e9galement avoir saisi la commission de pr\u00e9vention des expulsions deux mois avant l&#8217;assignation. Ces actes sont conformes aux exigences l\u00e9gales protectrices du locataire. L&#8217;action est ainsi d\u00e9clar\u00e9e recevable, fondant r\u00e9guli\u00e8rement la saisine du juge des contentieux de la protection. Cette analyse rigoureuse assure le respect des droits de la d\u00e9fense et des garanties proc\u00e9durales. Elle confirme le r\u00f4le de filtre du juge pour pr\u00e9venir les expulsions irr\u00e9guli\u00e8res.<\/p>\n<p>La d\u00e9termination du droit applicable \u00e0 la clause r\u00e9solutoire<\/p>\n<p>Le juge \u00e9carte l&#8217;application de la loi nouvelle au profit du texte plus favorable au locataire. Il rel\u00e8ve que la loi du 27 juillet 2023 a modifi\u00e9 le r\u00e9gime des clauses r\u00e9solutoires. Toutefois, en l&#8217;absence de dispositions transitoires, le principe de faveur commande d&#8217;appliquer l&#8217;ancien texte. &#8220;L&#8217;intention initiale des parties pr\u00e9vaut quant \u00e0 l&#8217;application de la clause r\u00e9solutoire, en ce qu&#8217;elle est plus protectrice des droits du locataire&#8221; (Motifs, II). Le juge retient donc l&#8217;article 24-I de la loi de 1989 non modifi\u00e9. Ce raisonnement consacre un ordre public de protection en mati\u00e8re locative. Il assure une s\u00e9curit\u00e9 juridique en maintenant l&#8217;application de la loi ancienne plus favorable.<\/p>\n<p>L&#8217;acquisition des effets de la clause et ses cons\u00e9quences<\/p>\n<p>Le juge constate la r\u00e9union des conditions l\u00e9gales pour la r\u00e9solution du bail et en tire les cons\u00e9quences. Le bail contient une clause r\u00e9solutoire et un commandement de payer a \u00e9t\u00e9 signifi\u00e9. &#8220;Ce commandement est demeur\u00e9 infructueux pendant plus de deux mois&#8221; (Motifs, II). Les effets de la clause sont donc acquis depuis le 6 janvier 2025. Le juge ordonne l&#8217;expulsion du locataire mais maintient le d\u00e9lai de deux mois pr\u00e9vu par la loi. Il rejette la demande d&#8217;astreinte et organise le paiement des sommes dues \u00e0 titre provisionnel. Cette solution \u00e9quilibre le droit du bailleur et les garanties proc\u00e9durales du locataire. Elle illustre le contr\u00f4le strict des conditions de l&#8217;expulsion locative.<\/p>\n<p>La port\u00e9e de la d\u00e9cision sur le r\u00e9gime des clauses r\u00e9solutoires<\/p>\n<p>Cette d\u00e9cision pr\u00e9cise le r\u00e9gime transitoire applicable apr\u00e8s la r\u00e9forme de juillet 2023. En privil\u00e9giant la loi la plus favorable, elle renforce la protection du locataire en cas de d\u00e9faut de paiement. Le d\u00e9lai de deux mois apr\u00e8s commandement infructueux demeure le principe directeur. Cette approche rejoint la jurisprudence ant\u00e9rieure sur le caract\u00e8re d&#8217;ordre public de ces r\u00e8gles. &#8220;Toute clause ins\u00e9r\u00e9e dans le bail pr\u00e9voyant la r\u00e9siliation de plein droit ne produit effet qu&#8217;un mois apr\u00e8s un commandement demeur\u00e9 infructueux&#8221; (Tribunal judiciaire de Paris, le 14 mai 2025, n\u00b022\/11698). La d\u00e9cision assure ainsi la continuit\u00e9 et la pr\u00e9visibilit\u00e9 du droit malgr\u00e9 la r\u00e9forme.
