Le bailleur a sollicit\u00e9 la r\u00e9siliation du bail pour d\u00e9faut de paiement et l&#8217;expulsion du locataire. Le tribunal a constat\u00e9 la r\u00e9union des conditions de la clause r\u00e9solutoire et ordonn\u00e9 l&#8217;expulsion. Il a \u00e9galement condamn\u00e9 le locataire au paiement des sommes dues et a rappel\u00e9 le principe de l&#8217;ex\u00e9cution provisoire de droit.<\/p>\n<p>La mise en \u0153uvre rigoureuse de la clause r\u00e9solutoire l\u00e9gale<\/p>\n<p>Le cadre l\u00e9gal de la r\u00e9siliation pour d\u00e9faut de paiement est strictement d\u00e9fini. L&#8217;article 24 de la loi du 6 juillet 1989 pr\u00e9voit que la clause ne produit effet &#8220;que deux mois apr\u00e8s la signification d\u2019un commandement de payer demeur\u00e9 infructueux&#8221; (Motifs, 1\u00b0). Le juge v\u00e9rifie scrupuleusement le respect de cette condition suspensive. En l&#8217;esp\u00e8ce, il rel\u00e8ve l&#8217;absence de r\u00e8glement &#8220;dans les deux mois ayant suivi le commandement&#8221; (Motifs, 1\u00b0). Cette application litt\u00e9rale prot\u00e8ge le bailleur tout en offrant un d\u00e9lai minimal au locataire. La jurisprudence confirme cette approche en exigeant la r\u00e9union pr\u00e9cise des conditions contractuelles et l\u00e9gales. &#8220;En effet, seuls deux versements [&#8230;] ont \u00e9t\u00e9 enregistr\u00e9s. De sorte qu&#8217;il y a lieu de constater que les conditions d&#8217;acquisition de la clause r\u00e9solutoire pr\u00e9vue au bail sont r\u00e9unies&#8221; (Cour d&#8217;appel de N\u00eemes, le 24 avril 2025, n\u00b024\/00667). La d\u00e9cision comment\u00e9e s&#8217;inscrit dans cette ligne en constatant la r\u00e9siliation de plein droit.<\/p>\n<p>Le rejet des d\u00e9lais de paiement consacre l&#8217;exigence de reprise effective.<\/p>\n<p>La loi offre une possibilit\u00e9 de suspension au locataire sous conditions cumulatives. &#8220;Le juge peut accorder [&#8230;] des d\u00e9lais de paiement au locataire \u00e0 condition qu\u2019il soit en situation de r\u00e9gler sa dette locative et qu\u2019il ait repris le versement int\u00e9gral du loyer courant avant la date d\u2019audience&#8221; (Motifs, 1\u00b0). Le tribunal op\u00e8re un contr\u00f4le concret de ces conditions. Il constate ici l&#8217;absence de reprise de paiement et une proposition jug\u00e9e insuffisante. Le locataire &#8220;n&#8217;est donc pas en position de solliciter la suspension de la clause r\u00e9solutoire&#8221; (Motifs, 1\u00b0). Cette interpr\u00e9tation restrictive vise \u00e0 \u00e9viter les man\u0153uvres dilatoires. Elle fait pr\u00e9valoir l&#8217;ex\u00e9cution du contrat sur le report du paiement des arri\u00e9r\u00e9s. La port\u00e9e de cette solution est pratique, elle dissuade les demandes de d\u00e9lais non \u00e9tay\u00e9es par une reprise sinc\u00e8re des obligations. Le juge sanctionne ainsi l&#8217;inaction du locataire apr\u00e8s le commandement.<\/p>\n<p>Les cons\u00e9quences attach\u00e9es \u00e0 l&#8217;expulsion et le rejet des demandes accessoires<\/p>\n<p>L&#8217;expulsion entra\u00eene des effets automatiques encadr\u00e9s par la loi. Le jugement rappelle le principe de l&#8217;indemnit\u00e9 d&#8217;occupation due jusqu&#8217;\u00e0 la lib\u00e9ration des lieux. Il pr\u00e9cise aussi le r\u00e9gime des meubles laiss\u00e9s sur place. &#8220;Les meubles se trouvant sur les lieux sont remis, aux frais de la personne expuls\u00e9e, en un lieu que celle-ci d\u00e9signe. A d\u00e9faut, ils sont laiss\u00e9s sur place&#8221; (Motifs, 1\u00b0). Le tribunal en d\u00e9duit qu&#8217;il &#8220;n&#8217;a pas \u00e0 ordonner la s\u00e9questration des meubles, laquelle est un effet de droit&#8221; (Motifs, 1\u00b0). Cette analyse limite le r\u00f4le du juge \u00e0 la constatation des r\u00e8gles d&#8217;ordre public. Elle \u00e9vite de surcharger le dispositif de mesures ex\u00e9cutoires superflues. La valeur de cette pr\u00e9cision est proc\u00e9durale, elle guide les parties sur les demandes recevables. Le bailleur est ainsi d\u00e9bout\u00e9 de sa demande de s\u00e9questration sp\u00e9cifique, l&#8217;effet \u00e9tant acquis.<\/p>\n<p>Le rappel des principes g\u00e9n\u00e9raux de la proc\u00e9dure et de l&#8217;ex\u00e9cution<\/p>\n<p>La d\u00e9cision statue \u00e9galement sur les demandes p\u00e9cuniaires et les frais de proc\u00e9dure. Elle condamne le locataire au paiement de l&#8217;arri\u00e9r\u00e9 de loyer, charges et indemnit\u00e9s d&#8217;occupation. Concernant l&#8217;ex\u00e9cution, le jugement rappelle un principe fondamental. &#8220;L\u2019ex\u00e9cution provisoire des jugements est de droit, sauf si le juge d\u00e9cide [&#8230;] de l\u2019\u00e9carter totalement ou partiellement&#8221; (Motifs, 3\u00b0). En l&#8217;absence de motif, il n&#8217;y a pas lieu de l&#8217;\u00e9carter. Ce rappel a une port\u00e9e pratique importante pour le bailleur. Il permet une ex\u00e9cution imm\u00e9diate malgr\u00e9 un \u00e9ventuel appel. Enfin, le rejet de la demande au titre de l&#8217;article 700 du code de proc\u00e9dure civile sanctionne l&#8217;absence de frais irr\u00e9p\u00e9tibles justifi\u00e9s. La solution est classique et applique strictement les conditions de cette disposition.
