Le litige opposait un bailleur public et son locataire concernant l&#8217;\u00e9tat d&#8217;un logement et le paiement des loyers. La juridiction a d&#8217;abord d\u00e9clar\u00e9 irrecevable une note en d\u00e9lib\u00e9r\u00e9 d\u00e9pos\u00e9e par le locataire apr\u00e8s la cl\u00f4ture des d\u00e9bats. Elle a ensuite examin\u00e9 les manquements r\u00e9ciproques des parties aux obligations du bail. Le juge a condamn\u00e9 le bailleur \u00e0 indemniser le locataire pour un logement ind\u00e9cent. Il a aussi condamn\u00e9 le locataire au paiement d&#8217;arri\u00e9r\u00e9s, tout en suspendant les effets d&#8217;une clause r\u00e9solutoire.<\/p>\n<p>La sanction du non-respect de la proc\u00e9dure contradictoire<\/p>\n<p>Le rejet d&#8217;une note en d\u00e9lib\u00e9r\u00e9 non autoris\u00e9e. Le juge a d\u00e9clar\u00e9 irrecevable la note adress\u00e9e en cours de d\u00e9lib\u00e9r\u00e9 par le locataire. Cette d\u00e9cision rappelle le principe fondamental du contradictoire apr\u00e8s la cl\u00f4ture des d\u00e9bats. Elle s&#8217;inscrit dans une jurisprudence constante sur la recevabilit\u00e9 des productions tardives. &#8220;Apr\u00e8s la cl\u00f4ture des d\u00e9bats, les parties ne peuvent d\u00e9poser aucune note \u00e0 l&#8217;appui de leurs observations&#8221; (Cour d&#8217;appel de Riom, le 14 janvier 2026, n\u00b025\/00612). La rigueur proc\u00e9durale est ainsi strictement appliqu\u00e9e pour garantir l&#8217;\u00e9quit\u00e9 des d\u00e9bats.<\/p>\n<p>La port\u00e9e de cette irrecevabilit\u00e9 est limit\u00e9e au strict respect des formes. La d\u00e9cision montre que le juge a entendu les observations orales du locataire sur ce point. Seule la formalisation \u00e9crite post\u00e9rieure est \u00e9cart\u00e9e, pr\u00e9servant le droit \u00e0 la d\u00e9fense. Cette approche assure une s\u00e9curit\u00e9 juridique en encadrant strictement les \u00e9changes post-audience. Elle pr\u00e9vient tout risque de surprise proc\u00e9durale et garantit l&#8217;\u00e9galit\u00e9 des armes entre les parties devant le juge.<\/p>\n<p>La mise en \u0153uvre du principe de d\u00e9cence du logement<\/p>\n<p>La caract\u00e9risation d&#8217;un manquement \u00e0 l&#8217;obligation de d\u00e9cence. Le juge retient que le logement \u00e9tait affect\u00e9 par une humidit\u00e9 excessive. Ce d\u00e9sordre rendait les lieux indignes au sens du d\u00e9cret du 30 janvier 2002. &#8220;Le bailleur est tenu de mettre \u00e0 la disposition du locataire un logement d\u00e9cent [&#8230;] ne laissant pas appara\u00eetre de risques manifestes pouvant porter atteinte \u00e0 la s\u00e9curit\u00e9 physique ou \u00e0 la sant\u00e9&#8221; (Motifs). La r\u00e9action tardive du bailleur, malgr\u00e9 des alertes r\u00e9p\u00e9t\u00e9es, constitue une faute engageant sa responsabilit\u00e9.<\/p>\n<p>L&#8217;\u00e9valuation du pr\u00e9judice et ses modalit\u00e9s de r\u00e9paration. Le trouble de jouissance est \u00e9valu\u00e9 au quart de la jouissance pour vingt-deux mois. Le pr\u00e9judice mat\u00e9riel est fix\u00e9 \u00e0 la valeur des biens d\u00e9t\u00e9rior\u00e9s par l&#8217;humidit\u00e9. La r\u00e9paration est int\u00e9grale mais proportionn\u00e9e \u00e0 la gravit\u00e9 du manquement constat\u00e9. Cette indemnisation n&#8217;emp\u00eache pas la poursuite de l&#8217;action en r\u00e9siliation pour d\u00e9faut de paiement. Le juge op\u00e8re ainsi une balance \u00e9quilibr\u00e9e entre la protection du locataire et les droits du bailleur.<\/p>\n<p>L&#8217;\u00e9quilibre des obligations r\u00e9ciproques et leurs sanctions<\/p>\n<p>Le maintien de l&#8217;obligation de payer le loyer malgr\u00e9 l&#8217;ind\u00e9cence. Le locataire ne pouvait se pr\u00e9valoir d&#8217;une exception d&#8217;inex\u00e9cution totale. Le logement, bien qu&#8217;ind\u00e9cent, n&#8217;\u00e9tait pas totalement inhabitable selon le juge. L&#8217;acquisition de la clause r\u00e9solutoire pour d\u00e9faut de paiement est donc constat\u00e9e. Cette solution rappelle le caract\u00e8re autonome des obligations respectives des parties. Elle \u00e9vite toute forme d&#8217;auto-justice et renvoie \u00e0 l&#8217;appr\u00e9ciation souveraine du juge.<\/p>\n<p>La suspension des effets de la r\u00e9siliation et la compensation des cr\u00e9ances. Le juge accorde des d\u00e9lais de paiement et suspend la clause r\u00e9solutoire. Il constate ensuite la compensation entre la dette locative et les indemnit\u00e9s dues. &#8220;La clause r\u00e9solutoire est r\u00e9put\u00e9e n&#8217;avoir jamais jou\u00e9&#8221; (Motifs). Cette solution pratique permet de pr\u00e9server la relation locative. Elle illustre le pouvoir d&#8217;am\u00e9nagement du juge pour concilier sanction et maintien du contrat.
