Le bailleur d&#8217;un local commercial sollicitait la constatation de la r\u00e9siliation du bail pour d\u00e9faut de paiement des loyers, l&#8217;expulsion du preneur et le paiement de provisions. Le juge des r\u00e9f\u00e9r\u00e9s a accueilli l&#8217;essentiel des demandes en constatant la r\u00e9siliation acquise de plein droit et en ordonnant l&#8217;expulsion ainsi que le paiement de sommes provisionnelles. Cette d\u00e9cision illustre les pouvoirs du juge des r\u00e9f\u00e9r\u00e9s en mati\u00e8re de clauses r\u00e9solutoires dans les baux commerciaux.<\/p>\n<p>La mise en \u0153uvre r\u00e9guli\u00e8re de la clause r\u00e9solutoire<\/p>\n<p>Le juge v\u00e9rifie scrupuleusement le respect des conditions l\u00e9gales et contractuelles. L&#8217;article L.145-41 du code de commerce impose qu&#8217;un commandement demeur\u00e9 infructueux pr\u00e9c\u00e8de de un mois l&#8217;effet de la clause. Le bailleur a fait d\u00e9livrer un tel commandement le 27 f\u00e9vrier 2024, rest\u00e9 sans effet. La clause contractuelle pr\u00e9voyait express\u00e9ment la r\u00e9siliation de plein droit un mois apr\u00e8s une mise en demeure infructueuse. Le juge rel\u00e8ve que les d\u00e9faillances du preneur &#8220;ne sont d\u00e8s lors pas s\u00e9rieusement contestables&#8221;. La r\u00e9siliation est donc acquise de plein droit \u00e0 la date du 28 mars 2024. Cette analyse confirme une application stricte du formalisme protecteur impos\u00e9 par la loi. La Cour d&#8217;appel de Versailles rappelle \u00e9galement que &#8220;toute clause ins\u00e9r\u00e9e dans le bail pr\u00e9voyant la r\u00e9siliation de plein droit ne produit effet qu&#8217;un mois apr\u00e8s un commandement demeur\u00e9 infructueux&#8221; (Cour d&#8217;appel de Versailles, le 4 avril 2024, n\u00b023\/03430). La port\u00e9e de ce contr\u00f4le est essentielle pour garantir la s\u00e9curit\u00e9 juridique des parties au contrat.<\/p>\n<p>Les pouvoirs du juge des r\u00e9f\u00e9r\u00e9s en cas de r\u00e9siliation acquise<\/p>\n<p>En pr\u00e9sence d&#8217;une clause r\u00e9guli\u00e8rement mise en \u0153uvre, le juge peut constater la r\u00e9siliation et ordonner l&#8217;expulsion. Le juge estime que l&#8217;obligation de lib\u00e9rer les lieux d\u00e9coulant de la r\u00e9siliation n&#8217;est pas s\u00e9rieusement contestable. Il fonde sa d\u00e9cision sur l&#8217;article 835 du code de proc\u00e9dure civile, permettant d&#8217;accorder une provision ou d&#8217;ordonner l&#8217;ex\u00e9cution d&#8217;une obligation dont l&#8217;existence n&#8217;est pas s\u00e9rieusement contestable. Il ordonne donc l&#8217;expulsion du preneur dans un d\u00e9lai d&#8217;un mois. Cette solution est conforme \u00e0 la jurisprudence des r\u00e9f\u00e9r\u00e9s qui admet de constater une r\u00e9siliation de plein droit en l&#8217;absence de contestation s\u00e9rieuse. Le Tribunal judiciaire de Paris a jug\u00e9 qu&#8217;il entre dans les pouvoirs du juge des r\u00e9f\u00e9r\u00e9s &#8220;de constater la r\u00e9siliation de plein droit d&#8217;un contrat de bail en application d&#8217;une clause r\u00e9solutoire lorsque celle-ci est mise en \u0153uvre r\u00e9guli\u00e8rement&#8221; (Tribunal judiciaire de Paris, le 16 mars 2026, n\u00b026\/50454). La valeur de cette d\u00e9cision r\u00e9side dans l&#8217;efficacit\u00e9 proc\u00e9durale qu&#8217;elle assure au bailleur l\u00e9s\u00e9.<\/p>\n<p>La condamnation \u00e0 des provisions sur les cr\u00e9ances liquides et exigibles<\/p>\n<p>Le juge accorde des provisions sur les sommes dont le principe n&#8217;est pas s\u00e9rieusement contestable. Il retient un arri\u00e9r\u00e9 de loyers et charges de 17 738,01 euros jusqu&#8217;\u00e0 la date de r\u00e9siliation, justifi\u00e9 par un d\u00e9compte d\u00e9taill\u00e9. Pour la p\u00e9riode post\u00e9rieure \u00e0 la r\u00e9siliation, il fixe une indemnit\u00e9 d&#8217;occupation provisionnelle mensuelle de 1 710,48 euros jusqu&#8217;\u00e0 la lib\u00e9ration des lieux. Le juge use ici de son pouvoir d&#8217;anticipation pour pr\u00e9server les int\u00e9r\u00eats du cr\u00e9ancier. Il pr\u00e9cise que les int\u00e9r\u00eats l\u00e9gaux ne courront qu&#8217;\u00e0 compter de l&#8217;ordonnance, limitant ainsi la condamnation. Cette mesure conservatoire permet d&#8217;\u00e9viter l&#8217;aggravation du pr\u00e9judice pendant la dur\u00e9e in\u00e9vitable de la proc\u00e9dure au fond. Sa port\u00e9e pratique est significative pour le tr\u00e9sor du bailleur confront\u00e9 \u00e0 un locataire d\u00e9faillant.<\/p>\n<p>La distinction nette entre loyers \u00e9chus et indemnit\u00e9 d&#8217;occupation<\/p>\n<p>Le juge op\u00e8re une distinction juridique cruciale entre les p\u00e9riodes avant et apr\u00e8s la r\u00e9siliation. Les sommes dues jusqu&#8217;au 28 mars 2024 sont qualifi\u00e9es de loyers et charges impay\u00e9s au titre du bail r\u00e9sili\u00e9. Les sommes dues \u00e0 compter du 28 mars 2024 sont qualifi\u00e9es d&#8217;indemnit\u00e9 d&#8217;occupation, fix\u00e9e au montant du dernier loyer. Cette distinction a une incidence sur la nature de la cr\u00e9ance et son r\u00e9gime juridique. Elle rappelle que l&#8217;occupation sans titre apr\u00e8s r\u00e9siliation g\u00e9n\u00e8re une obligation distincte de restitution. Le juge lie le montant de l&#8217;indemnit\u00e9 \u00e0 la demande du bailleur, conform\u00e9ment au principe dispositif.
