Le salari\u00e9 contestait son licenciement intervenu sans notification \u00e9crite et pour un motif contest\u00e9. La juridiction a infirm\u00e9 le jugement de premi\u00e8re instance pour statuer sur la recevabilit\u00e9 et le fond. Elle a jug\u00e9 le licenciement d\u00e9nu\u00e9 de cause r\u00e9elle et s\u00e9rieuse et accord\u00e9 des indemnit\u00e9s. La d\u00e9cision pr\u00e9cise les conditions de la prescription et les cons\u00e9quences d&#8217;une rupture irr\u00e9guli\u00e8re.<\/p>\n<p>La prescription de l&#8217;action en contestation du licenciement<\/p>\n<p>Le point de d\u00e9part du d\u00e9lai de prescription<br \/>\nL&#8217;article L.1471-1 du code du travail fixe le d\u00e9lai pour agir suite \u00e0 une rupture. Le second alin\u00e9a dispose que &#8220;Toute action portant sur la rupture du contrat de travail se prescrit par douze mois \u00e0 compter de la notification de la rupture&#8221;. La cour en d\u00e9duit une r\u00e8gle essentielle pour le cas d&#8217;esp\u00e8ce. Elle affirme qu'&#8221;en l&#8217;absence de notification du licenciement, ce d\u00e9lai ne court pas&#8221;. Cette interpr\u00e9tation stricte prot\u00e8ge le salari\u00e9 priv\u00e9 de formalisme. Elle rappelle que la notification est une condition substantielle pour l&#8217;employeur. La prescription ne peut ainsi d\u00e9buter sans cet acte formel.<\/p>\n<p>La port\u00e9e de l&#8217;absence de notification<br \/>\nCette solution consacre une lecture protectrice des droits du salari\u00e9. Elle emp\u00eache l&#8217;employeur de se pr\u00e9valoir d&#8217;une prescription acquise par sa propre carence. La cour \u00e9carte toute autre date potentielle pour faire courir le d\u00e9lai. La jurisprudence ant\u00e9rieure confirme ce principe en des termes similaires. &#8220;Aux termes du deuxi\u00e8me de l&#8217;article L. 1471-1 du code du travail : &#8216;Toute action portant sur la rupture du contrat de travail se prescrit par douze mois \u00e0 compter de la notification de la rupture&#8217;.&#8221; (Cour d&#8217;appel de Versailles, le 6 novembre 2025, n\u00b023\/02808). L&#8217;action demeure donc perp\u00e9tuellement recevable tant que la rupture n&#8217;est pas notifi\u00e9e. Cette analyse renforce la s\u00e9curit\u00e9 juridique du salari\u00e9 face \u00e0 un licenciement informel.<\/p>\n<p>La qualification du licenciement et ses cons\u00e9quences indemnitaires<\/p>\n<p>Un licenciement d\u00e9nu\u00e9 de cause r\u00e9elle et s\u00e9rieuse<br \/>\nLa cour rel\u00e8ve l&#8217;absence totale de lettre de licenciement adress\u00e9e au salari\u00e9. Elle en tire une cons\u00e9quence imm\u00e9diate sur la qualification de la rupture. Le licenciement est d\u00e8s lors &#8220;r\u00e9put\u00e9 d\u00e9nu\u00e9 de cause r\u00e9elle et s\u00e9rieuse&#8221;. Le motif invoqu\u00e9 a posteriori est \u00e9galement inop\u00e9rant. La r\u00e9f\u00e9rence \u00e0 une &#8220;fin de chantier&#8221; est contredite par la nature du contrat. Le salari\u00e9 \u00e9tait affect\u00e9 de mani\u00e8re permanente sur un site sp\u00e9cifique. L&#8217;employeur ne d\u00e9montre pas la perte du march\u00e9 correspondant \u00e0 cette affectation. Ces \u00e9l\u00e9ments cumul\u00e9s justifient la requalification en licenciement sans cause valable.<\/p>\n<p>L&#8217;\u00e9valuation des indemnit\u00e9s dues<br \/>\nSur le fondement de l&#8217;article L.1235-3 du code du travail, la cour alloue des dommages et int\u00e9r\u00eats. Elle arbitre le montant \u00e0 la somme de mille euros pour ce pr\u00e9judice sp\u00e9cifique. En revanche, elle \u00e9carte l&#8217;indemnit\u00e9 pour vice de proc\u00e9dure pr\u00e9vue \u00e0 l&#8217;article L.1235-2. Le licenciement \u00e9tant sans cause, cette indemnit\u00e9 accessoire ne trouve pas \u00e0 s&#8217;appliquer. La cour recalcule aussi l&#8217;indemnit\u00e9 compensatrice de pr\u00e9avis selon la convention collective. Elle retient un d\u00e9lai-cong\u00e9 d&#8217;un jour ouvr\u00e9, soit 38,73 euros. Les demandes sur l&#8217;indemnit\u00e9 l\u00e9gale et les cong\u00e9s pay\u00e9s sont rejet\u00e9es pour d\u00e9faut d&#8217;anciennet\u00e9 requise. Enfin, elle refuse toute indemnisation pour pr\u00e9judice moral distinct ou absence de visite m\u00e9dicale. Le salari\u00e9 n&#8217;apportait pas la preuve d&#8217;un pr\u00e9judice sp\u00e9cifique d\u00e9coulant de ces manquements.<\/p>\n<p>Cette d\u00e9cision rappelle avec force l&#8217;importance du formalisme dans la rupture du contrat de travail. Elle ancre le point de d\u00e9part de la prescription \u00e0 la notification effective du licenciement. L&#8217;employeur ne peut se soustraire \u00e0 cette obligation essentielle. La cour sanctionne \u00e9galement s\u00e9v\u00e8rement l&#8217;absence de cause r\u00e9elle et s\u00e9rieuse. Elle op\u00e8re une distinction nette entre les diff\u00e9rents r\u00e9gimes indemnitaires. Le pr\u00e9judice li\u00e9 \u00e0 l&#8217;absence de cause est r\u00e9par\u00e9, mais les autres demandes n\u00e9cessitent une preuve propre. Cette jurisprudence renforce la protection du salari\u00e9 face aux pratiques irr\u00e9guli\u00e8res.
