Le d\u00e9biteur oppose de multiples exceptions, notamment sur la comp\u00e9tence des juridictions fran\u00e7aises et la validit\u00e9 des titres ex\u00e9cutoires. Le juge rejette l\u2019ensemble des moyens soulev\u00e9s et autorise la vente amiable de l\u2019immeuble saisi, en fixant un prix plancher.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale de la saisie immobili\u00e8re<\/p>\n<p>Le contr\u00f4le des conditions l\u00e9gales de la saisie. Le juge de l\u2019ex\u00e9cution v\u00e9rifie scrupuleusement le respect des conditions l\u00e9gales pr\u00e9alables \u00e0 la poursuite de la proc\u00e9dure. Il constate que le cr\u00e9ancier est muni de titres ex\u00e9cutoires d\u00e9finitifs, constatant une cr\u00e9ance liquide et exigible. &#8220;Le cr\u00e9ancier poursuivant proc\u00e8de \u00e0 la saisie immobili\u00e8re en vertu de la copie ex\u00e9cutoire d&#8217;un acte re\u00e7u par [un notaire]&#8221; (Motifs, \u00a74). La d\u00e9cision rappelle que &#8220;tout cr\u00e9ancier muni d&#8217;un titre ex\u00e9cutoire constatant une cr\u00e9ance liquide et exigible peut proc\u00e9der \u00e0 une saisie immobili\u00e8re&#8221; (Motifs, \u00a74, citant l\u2019article L. 311-2 CPCE). Cette analyse confirme une application stricte des textes, sans possibilit\u00e9 de remettre en cause le bien-fond\u00e9 de la cr\u00e9ance d\u00e9j\u00e0 jug\u00e9e.<\/p>\n<p>La validation des actes de poursuite et le sort des incidents. Le juge examine la r\u00e9gularit\u00e9 formelle du commandement de payer valant saisie. Il estime que l\u2019acte satisfait aux exigences l\u00e9gales, notamment en contenant un d\u00e9compte suffisamment d\u00e9taill\u00e9. &#8220;Le commandement de payer satisfait au respect des dispositions pr\u00e9cit\u00e9es, en ce qui mentionne les sommes r\u00e9clam\u00e9es en principal, frais et int\u00e9r\u00eats \u00e9chus ainsi que l&#8217;indication du taux des int\u00e9r\u00eats moratoires&#8221; (Motifs, \u00a74, point 4). Concernant la mise en cause de l\u2019\u00e9pouse s\u00e9par\u00e9e de biens, le juge \u00e9carte le grief faute de d\u00e9nonciation du commandement. Cette approche consolide la s\u00e9curit\u00e9 juridique des actes de poursuite d\u00e8s lors qu\u2019ils sont conformes aux prescriptions l\u00e9gales.<\/p>\n<p>L\u2019encadrement des contestations substantielles par le juge de l\u2019ex\u00e9cution<\/p>\n<p>L\u2019irrecevabilit\u00e9 des demandes affectant le titre ex\u00e9cutoire. La d\u00e9cision op\u00e8re une distinction nette entre les contestations de la proc\u00e9dure et celles portant sur le fond du droit. Elle d\u00e9clare irrecevables les demandes visant \u00e0 contester la validit\u00e9 du contrat de pr\u00eat ou la comp\u00e9tence des juridictions fran\u00e7aises. &#8220;Les demandes formul\u00e9es devant toute autre juridiction que celle en charge de la liquidation judiciaire de la banque sont irrecevables&#8221; (Motifs, \u00a71). Le juge estime que ces questions rel\u00e8vent exclusivement du juge luxembourgeois, d\u00e9sign\u00e9 par clause contractuelle et comp\u00e9tent en raison de la liquidation. Cette position prot\u00e8ge l\u2019autorit\u00e9 de la chose jug\u00e9e \u00e0 l\u2019\u00e9tranger et le principe de suspension des poursuites individuelles en mati\u00e8re d\u2019insolvabilit\u00e9.<\/p>\n<p>Le contr\u00f4le limit\u00e9 du caract\u00e8re abusif des clauses contractuelles. Le juge accepte en principe d\u2019examiner le caract\u00e8re abusif des clauses mais en limite strictement la port\u00e9e. Il \u00e9carte l\u2019examen de la clause attributive de juridiction, jug\u00e9e sans lien avec l\u2019objet du litige. &#8220;Le juge de l&#8217;ex\u00e9cution ne saurait analyser cette clause d\u00e8s lors que &#8216;la clause attributive de comp\u00e9tence&#8230; est sans lien avec l&#8217;objet du litige'&#8221; (Motifs, \u00a72). Pour les autres clauses, il les estime non abusives au regard des informations fournies au d\u00e9biteur. Ce contr\u00f4le cibl\u00e9 pr\u00e9serve l\u2019efficacit\u00e9 de la proc\u00e9dure d\u2019ex\u00e9cution tout en offrant une protection minimale contre les d\u00e9s\u00e9quilibres contractuels flagrants.<\/p>\n<p>La port\u00e9e de la d\u00e9cision r\u00e9side dans son renforcement de l\u2019efficacit\u00e9 des proc\u00e9dures d\u2019ex\u00e9cution transnationales. Elle affirme la comp\u00e9tence exclusive du juge de l\u2019ex\u00e9cution pour les incidents de saisie, en isolant ces derniers des contestations sur le fond qui rel\u00e8vent d\u2019un autre juge. Elle consacre \u00e9galement l\u2019opposabilit\u00e9 en France des titres ex\u00e9cutoires \u00e9trangers r\u00e9guli\u00e8rement obtenus et la primaut\u00e9 des r\u00e8gles d\u2019insolvabilit\u00e9 de l\u2019\u00c9tat d\u2019origine.
