Le bailleur a engag\u00e9 une action en r\u00e9siliation du bail pour d\u00e9faut de paiement des loyers. Le locataire, non comparant, n&#8217;a pas contest\u00e9 les faits. Le juge a examin\u00e9 la recevabilit\u00e9 de l&#8217;action et les conditions d&#8217;acquisition de la clause r\u00e9solutoire. Il a accueilli la demande en r\u00e9siliation et condamn\u00e9 le locataire au paiement des sommes dues et \u00e0 la lib\u00e9ration des lieux.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale de l&#8217;action en r\u00e9siliation<\/p>\n<p>Le juge v\u00e9rifie scrupuleusement le respect des formalit\u00e9s pr\u00e9alables \u00e0 l&#8217;expulsion. La notification de l&#8217;assignation \u00e0 la pr\u00e9fecture est intervenue plus de six semaines avant l&#8217;audience. La saisine de la commission de coordination est intervenue deux mois avant la d\u00e9livrance de l&#8217;assignation. Ces actes respectent les d\u00e9lais l\u00e9gaux impos\u00e9s par la loi du 6 juillet 1989. Leur accomplissement par voie \u00e9lectronique est valid\u00e9 par le juge sans difficult\u00e9. L&#8217;action est donc d\u00e9clar\u00e9e recevable, ouvrant la voie \u00e0 l&#8217;examen du fond.<\/p>\n<p>La port\u00e9e de cette v\u00e9rification est essentielle pour la s\u00e9curit\u00e9 juridique. Elle garantit le respect des droits de la d\u00e9fense et des mesures de protection du locataire. Le non-respect de ces formalit\u00e9s entra\u00eenerait l&#8217;irrecevabilit\u00e9 de la demande. Cette rigueur proc\u00e9durale constitue un pr\u00e9alable incontournable \u00e0 toute action en expulsion. Elle illustre l&#8217;\u00e9quilibre recherch\u00e9 par le l\u00e9gislateur entre les int\u00e9r\u00eats des parties.<\/p>\n<p>L&#8217;acquisition irr\u00e9versible des effets de la clause r\u00e9solutoire<\/p>\n<p>Le juge constate la r\u00e9union des conditions l\u00e9gales pour l&#8217;activation de la clause. Un commandement de payer a \u00e9t\u00e9 signifi\u00e9 le 31 janvier 2025 pour un impay\u00e9 principal. Ce commandement est rest\u00e9 infructueux pendant le d\u00e9lai contractuel de six semaines. &#8220;de sorte qu\u2019il y a lieu de constater que les conditions d\u2019acquisition de la clause r\u00e9solutoire contenue dans le bail \u00e9taient r\u00e9unies \u00e0 la date du 14 mars 2025.&#8221; (Motifs, I). Le juge \u00e9carte ainsi toute possibilit\u00e9 de suspension ou de d\u00e9lais de gr\u00e2ce.<\/p>\n<p>La valeur de cette analyse r\u00e9side dans son caract\u00e8re d\u00e9finitif. Le locataire n&#8217;ayant pas r\u00e9gularis\u00e9 sa situation, la clause a produit son plein effet. La jurisprudence rappelle que &#8220;la clause r\u00e9solutoire \u00e9tait acquise au profit des bailleurs&#8221; d\u00e8s lors que les conditions sont remplies (Cour d&#8217;appel de Paris, le 21 novembre 2023, n\u00b021\/09604). Le juge ne peut accorder de d\u00e9lais de paiement en l&#8217;absence de demande et de reprise des paiements courants. La r\u00e9siliation de plein droit devient ainsi in\u00e9luctable.<\/p>\n<p>Les cons\u00e9quences p\u00e9cuniaires de la r\u00e9siliation du contrat<\/p>\n<p>Le juge liquide la cr\u00e9ance locative et ses accessoires jusqu&#8217;\u00e0 la lib\u00e9ration des lieux. Un d\u00e9compte d\u00e9taill\u00e9 produit par le bailleur est retenu \u00e0 titre provisionnel. Le locataire est condamn\u00e9 au paiement du principal, des int\u00e9r\u00eats l\u00e9gaux et d&#8217;une indemnit\u00e9 d&#8217;occupation. Cette indemnit\u00e9 court \u00e0 partir de la date d&#8217;acquisition de la clause r\u00e9solutoire. Elle est fix\u00e9e au montant du loyer et des charges qui auraient \u00e9t\u00e9 dus.<\/p>\n<p>La port\u00e9e de cette condamnation est \u00e0 la fois r\u00e9trospective et prospective. Elle couvre la dette ant\u00e9rieure \u00e0 la r\u00e9siliation et compense l&#8217;occupation sans titre. Le juge pr\u00e9cise les dates de d\u00e9part des int\u00e9r\u00eats pour chaque fraction de la cr\u00e9ance. Cette indemnit\u00e9 mensuelle perdurera jusqu&#8217;\u00e0 la restitution effective des cl\u00e9s. Elle constitue une mesure essentielle pour pr\u00e9venir l&#8217;enrichissement sans cause du locataire d\u00e9faillant.<\/p>\n<p>Le sort des demandes accessoires et l&#8217;ex\u00e9cution de la d\u00e9cision<\/p>\n<p>Le juge condamne le locataire, partie perdante, \u00e0 la charge int\u00e9grale des d\u00e9pens. Les frais de proc\u00e9dure incluent le commandement, la saisine de la commission et l&#8217;assignation. Une somme modeste est allou\u00e9e au bailleur au titre de l&#8217;article 700 du code de proc\u00e9dure civile. Le juge rappelle enfin que l&#8217;ex\u00e9cution provisoire de l&#8217;ordonnance est de droit. Cette ex\u00e9cution permet une lib\u00e9ration effective des lieux dans des d\u00e9lais encadr\u00e9s.<\/p>\n<p>La valeur de ces dispositions est d&#8217;assurer l&#8217;efficacit\u00e9 pratique de la d\u00e9cision. L&#8217;ex\u00e9cution provisoire \u00e9vite les man\u0153uvres dilatoires du locataire d\u00e9faillant. La condamnation aux d\u00e9pens compense partiellement les frais engag\u00e9s par le bailleur. L&#8217;ordonnance pr\u00e9voit un d\u00e9lai de deux mois apr\u00e8s un commandement de quitter pour proc\u00e9der \u00e0 l&#8217;expulsion.
