Le bailleur social a engag\u00e9 une action en constatation de r\u00e9siliation d\u2019un bail d\u2019habitation pour d\u00e9faut de paiement. Le locataire, b\u00e9n\u00e9ficiaire de minima sociaux, reconnaissait la dette. Le juge a constat\u00e9 la r\u00e9solution du bail tout en accordant des d\u00e9lais de paiement. Il a ainsi suspendu les effets de la clause r\u00e9solutoire et report\u00e9 l\u2019expulsion sous conditions.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale de la r\u00e9siliation pour d\u00e9faut de paiement<\/p>\n<p>Le respect des formalit\u00e9s pr\u00e9alables \u00e0 l\u2019action en justice. Le l\u00e9gislateur a encadr\u00e9 strictement la proc\u00e9dure de r\u00e9siliation pour impay\u00e9s. Le juge v\u00e9rifie syst\u00e9matiquement le respect des d\u00e9lais et des notifications obligatoires. En l\u2019esp\u00e8ce, la saisine de la commission de pr\u00e9vention des expulsions et la notification \u00e0 la pr\u00e9fecture sont r\u00e9guli\u00e8res. Ces formalit\u00e9s substantielles conditionnent la recevabilit\u00e9 de la demande du bailleur. Leur omission entra\u00eenerait l\u2019irrecevabilit\u00e9 de l\u2019action en constatation de r\u00e9siliation.<\/p>\n<p>La r\u00e9gularit\u00e9 substantielle du commandement pr\u00e9alable. Le commandement de payer est l\u2019acte fondateur de la proc\u00e9dure de r\u00e9siliation de plein droit. La loi exige qu\u2019il comporte des mentions obligatoires sous peine de nullit\u00e9. Le juge rel\u00e8ve que le commandement d\u00e9livr\u00e9 &#8220;comporte les mentions obligatoires prescrites \u00e0 peine de nullit\u00e9 \u00e0 l&#8217;article 24 I de la loi du 6 juillet 1989.&#8221; (Motifs de la d\u00e9cision). Ce formalisme prot\u00e8ge le locataire contre une expulsion brutale. Un commandement incomplet ou irr\u00e9gulier priverait la clause r\u00e9solutoire de tout effet. La jurisprudence rappelle cette exigence de pr\u00e9cision. &#8220;D\u00e8s lors, \u00e0 d\u00e9faut pour la demanderesse de justifier que le locataire a \u00e9t\u00e9 destinataire d&#8217;un commandement comportant le d\u00e9tail de la dette, il en r\u00e9sulte une contestation s\u00e9rieuse&#8221; (Cour d&#8217;appel de Douai, le 6 f\u00e9vrier 2025, n\u00b023\/05027). L\u2019exactitude du commandement est donc une condition de fond essentielle.<\/p>\n<p>L\u2019\u00e9quilibre entre sanction du d\u00e9faut de paiement et protection du locataire<\/p>\n<p>La constatation judiciaire de la r\u00e9solution du contrat. Lorsque les conditions l\u00e9gales sont r\u00e9unies, le juge constate l\u2019acquisition de la clause r\u00e9solutoire. Le d\u00e9faut de paiement dans le d\u00e9lai de six semaines apr\u00e8s commandement fait jouer la clause. Le juge note que le locataire n\u2019a pas r\u00e9gl\u00e9 &#8220;dans le d\u00e9lai l\u00e9gal de six semaines \u00e0 compter de la d\u00e9livrance du commandement&#8221;. (Motifs de la d\u00e9cision). Cette constatation est une simple d\u00e9claration d\u2019un \u00e9tat de droit. Elle n\u2019est pas une r\u00e9siliation judiciaire mais un constat de r\u00e9siliation de plein droit. Cette m\u00e9canique assure la s\u00e9curit\u00e9 juridique du bailleur face aux impay\u00e9s. Elle permet une ex\u00e9cution forc\u00e9e du contrat si le locataire ne se lib\u00e8re pas.<\/p>\n<p>Le pouvoir d\u2019am\u00e9nagement des cons\u00e9quences de la r\u00e9solution. Le juge dispose d\u2019un pouvoir discr\u00e9tionnaire pour accorder des d\u00e9lais de paiement. Ce pouvoir temp\u00e8re la rigueur de la r\u00e9solution de plein droit. L\u2019article 24 V de la loi de 1989 pr\u00e9voit cette possibilit\u00e9 &#8220;m\u00eame d&#8217;office&#8221;. Le juge l\u2019exerce en consid\u00e9ration de la situation sociale du locataire. Il souligne que celui-ci &#8220;est en situation de reprendre le paiement du loyer courant&#8221;. (Motifs de la d\u00e9cision). L\u2019octroi d\u2019un moratoire de trente-six mois suspend les effets de la clause. &#8220;Les effets de la clause r\u00e9solutoire \u00e9tant suspendus pendant le cours des d\u00e9lais ainsi accord\u00e9s&#8221; (Motifs de la d\u00e9cision). Cette suspension conditionnelle concilie le recouvrement de la cr\u00e9ance et le maintien dans les lieux. Elle illustre la fonction sociale du juge des contentieux de la protection. Le non-respect du plan de paiement entra\u00eene la reprise des poursuites. Le bailleur pourra alors obtenir l\u2019expulsion et une indemnit\u00e9 d\u2019occupation.
