Le bailleur demandait le paiement de loyers impay\u00e9s par son locataire. La proc\u00e9dure \u00e9tait r\u00e9guli\u00e8re apr\u00e8s une tentative de conciliation. Le juge a condamn\u00e9 le locataire au paiement de la somme due. Il lui a \u00e9galement accord\u00e9 des d\u00e9lais de paiement \u00e9chelonn\u00e9s sur vingt-quatre mois. La d\u00e9cision articule ainsi l&#8217;exigence du paiement avec une mesure d&#8217;accompagnement social.<\/p>\n<p>La sanction du d\u00e9faut de paiement et son assise l\u00e9gale<\/p>\n<p>Le juge constate d&#8217;abord l&#8217;existence d&#8217;une cr\u00e9ance certaine et liquide. Les textes applicables imposent au preneur l&#8217;obligation de payer le loyer aux termes convenus. &#8220;Les articles 1728 du code civil et 7 a) de la loi du 6 juillet 1989 disposent que le locataire est tenu de payer le loyer et les charges r\u00e9cup\u00e9rables aux termes convenus&#8221; (Motifs). Le bailleur produit un d\u00e9compte actualis\u00e9 qui n&#8217;est pas contest\u00e9. La cr\u00e9ance est donc \u00e9tablie en fait comme en droit. Le d\u00e9biteur est condamn\u00e9 au paiement du principal et d&#8217;int\u00e9r\u00eats de retard. Cette solution rappelle le principe fondamental de l&#8217;ex\u00e9cution des obligations contractuelles. Elle garantit la s\u00e9curit\u00e9 juridique des cr\u00e9anciers dans les relations locatives.<\/p>\n<p>La r\u00e9gularit\u00e9 de l&#8217;action en justice est un pr\u00e9alable n\u00e9cessaire. La loi impose une tentative de conciliation pr\u00e9alable pour ce type de litige. &#8220;La demande en justice a \u00e9t\u00e9 pr\u00e9c\u00e9d\u00e9e, d&#8217;une tentative de conciliation men\u00e9e par un conciliateur de justice en date du 26 Mars 2025&#8221; (Motifs). Cette condition de recevabilit\u00e9 est strictement v\u00e9rifi\u00e9e. La jurisprudence admet l&#8217;\u00e9cartement de la fin de non-recevoir si la conciliation est impossible. &#8220;En l&#8217;esp\u00e8ce, les parties ont eu avant l&#8217;audience de nombreux \u00e9changes qui t\u00e9moignent de l&#8217;impossibilit\u00e9 du recours \u00e0 une conciliation&#8221; (Tribunal judiciaire de Versailles, le 6 f\u00e9vrier 2024, n\u00b023\/01361). La d\u00e9cision comment\u00e9e valide simplement l&#8217;aboutissement de la tentative. Elle confirme ainsi le r\u00f4le de filtre proc\u00e9dural de la conciliation obligatoire.<\/p>\n<p>L&#8217;am\u00e9nagement des cons\u00e9quences par l&#8217;octroi de d\u00e9lais de paiement<\/p>\n<p>Le juge use de son pouvoir d&#8217;am\u00e9nager les modalit\u00e9s d&#8217;ex\u00e9cution de la condamnation. Il appr\u00e9cie la situation personnelle et financi\u00e8re du d\u00e9biteur. &#8220;Il ressort des d\u00e9bats, que MONSIEUR [G] [B] est en situation de reprendre le paiement du loyer courant&#8221; (Motifs). L&#8217;espoir d&#8217;obtention d&#8217;aides au logement justifie l&#8217;octroi de d\u00e9lais. Le juge autorise un \u00e9chelonnement sur deux ans avec des mensualit\u00e9s modestes. Cette d\u00e9cision int\u00e8gre une dimension sociale dans le r\u00e8glement du contentieux. Elle \u00e9vite une expulsion qui serait disproportionn\u00e9e au regard des difficult\u00e9s passag\u00e8res. Le pouvoir d&#8217;adaptation du juge temp\u00e8re ainsi la rigueur de la condamnation au paiement.<\/p>\n<p>La mise en balance des int\u00e9r\u00eats des parties guide la d\u00e9cision finale. Le juge v\u00e9rifie que le plan de r\u00e8glement propos\u00e9 est r\u00e9aliste et suffisant. La jurisprudence exige une capacit\u00e9 certaine du d\u00e9biteur \u00e0 respecter les \u00e9ch\u00e9ances. &#8220;Il ressort de l&#8217;ensemble de ces \u00e9l\u00e9ments que M. [E] n&#8217;a pas la capacit\u00e9 de r\u00e9gler en plus de l&#8217;indemnit\u00e9 d&#8217;occupation courante la somme mensuelle de 100 euros qu&#8217;il propose&#8221; (Cour d&#8217;appel de Douai, le 19 juin 2025, n\u00b024\/03954). En l&#8217;esp\u00e8ce, le juge estime les propositions de r\u00e8glement acceptables. Il assortit toutefois le d\u00e9lai d&#8217;une clause d&#8217;exigibilit\u00e9 imm\u00e9diate en cas de d\u00e9faut. Cette mesure prot\u00e8ge le cr\u00e9ancier contre un nouveau risque d&#8217;impay\u00e9.
