Le locataire, r\u00e9guli\u00e8rement assign\u00e9, ne compara\u00eet pas \u00e0 l\u2019audience. Le juge v\u00e9rifie la recevabilit\u00e9 de l\u2019assignation et le bien-fond\u00e9 des demandes. Il constate la r\u00e9siliation du bail mais accorde des d\u00e9lais de paiement, suspendant ainsi les effets de la <a href=\"https:\/\/kohenavocats.fr\/avocat-resiliation-bail-paris\/\" target=\"_blank\" title=\"clause r\u00e9solutoire\">clause r\u00e9solutoire<\/a> sous conditions.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale et le principe du contradictoire<\/p>\n<p>Le juge applique d\u2019abord les r\u00e8gles de proc\u00e9dure en cas de d\u00e9faut de comparution. Il rappelle que &#8220;lorsque le d\u00e9fendeur ne compara\u00eet pas, il est n\u00e9anmoins statu\u00e9 sur le fond&#8221; (article 472 du Code de Proc\u00e9dure Civile). La notification r\u00e9guli\u00e8re de l\u2019assignation par voie \u00e9lectronique est v\u00e9rifi\u00e9e conform\u00e9ment \u00e0 la loi du 6 juillet 1989. Cette application stricte garantit le respect des droits de la d\u00e9fense malgr\u00e9 l\u2019absence d\u2019une partie. La d\u00e9cision illustre ainsi l\u2019\u00e9quilibre entre c\u00e9l\u00e9rit\u00e9 proc\u00e9durale et protection des int\u00e9r\u00eats du d\u00e9fendeur d\u00fbment inform\u00e9. Le juge statue uniquement sur les demandes qu\u2019il estime fond\u00e9es, pr\u00e9servant l\u2019essence du proc\u00e8s \u00e9quitable.<\/p>\n<p>La mise en \u0153uvre conditionnelle de la r\u00e9siliation pour loyers impay\u00e9s<\/p>\n<p>Le juge constate ensuite le d\u00e9faut de paiement justifiant la r\u00e9siliation. Le bail contient une clause r\u00e9solutoire activ\u00e9e par un commandement demeur\u00e9 infructueux. Le juge rel\u00e8ve qu'&#8221;aucune r\u00e9gularisation totale n\u2019a eu lieu dans les six semaines suivant la d\u00e9livrance du commandement&#8221;. Il applique donc le r\u00e9gime l\u00e9gal de l\u2019article 24 de la loi de 1989. La r\u00e9siliation est ainsi prononc\u00e9e de plein droit, confirmant le caract\u00e8re d\u2019ordre public de ces dispositions protectrices. Le juge rappelle la r\u00e9partition de la charge de la preuve concernant l\u2019existence et l\u2019extinction de l\u2019obligation de payer.<\/p>\n<p>L\u2019am\u00e9nagement judiciaire par l\u2019octroi de d\u00e9lais de paiement<\/p>\n<p>Le juge use ensuite de son pouvoir d\u2019am\u00e9nager les cons\u00e9quences de l\u2019impay\u00e9. Sur accord du bailleur et constat de reprise des paiements courants, il accorde des d\u00e9lais. Il applique l\u2019article 24 VII de la loi de 1989, permettant de &#8220;suspendre les effets de la clause de r\u00e9siliation de plein droit pendant le cours des d\u00e9lais accord\u00e9s&#8221;. Cette suspension est conditionn\u00e9e au respect strict d\u2019un \u00e9ch\u00e9ancier et au paiement des loyers courants. Le juge op\u00e8re ainsi une conciliation entre le droit du bailleur au paiement et la protection du locataire contre l\u2019expulsion. Il offre une seconde chance au d\u00e9biteur tout en encadrant strictement son ex\u00e9cution.<\/p>\n<p>La port\u00e9e pr\u00e9ventive et les garanties d\u2019ex\u00e9cution<\/p>\n<p>La d\u00e9cision organise enfin les cons\u00e9quences du non-respect des d\u00e9lais accord\u00e9s. En cas de nouveau d\u00e9faut, &#8220;la clause r\u00e9solutoire retrouvera imm\u00e9diatement son plein effet&#8221;. Le juge autorise par avance l\u2019expulsion avec le concours de la force publique. Il fixe \u00e9galement le montant d\u2019une indemnit\u00e9 d\u2019occupation due en cas de maintien dans les lieux. Ces mesures assurent l\u2019effectivit\u00e9 de la d\u00e9cision et dissuadent les comportements dilatoires. Le juge rappelle parall\u00e8lement les recours possibles pour le locataire face \u00e0 une expulsion, comme la saisine de la commission du DALO.
