Une salari\u00e9e du secteur priv\u00e9 de la sant\u00e9 invoque les dispositions g\u00e9n\u00e9rales de sa convention collective. Son employeur lui oppose l&#8217;application d&#8217;une annexe sp\u00e9cifique aux \u00e9tablissements pour personnes \u00e2g\u00e9es. Les premiers juges avaient retenu le texte le plus favorable \u00e0 la salari\u00e9e. La cour d&#8217;appel doit d\u00e9terminer la clause applicable et proc\u00e9der au calcul du <a href=\"https:\/\/kohenavocats.com\/avocats-droit-social-paris\/avocats-heures-supplementaires-paris\/\" target=\"_blank\" title=\"rappel de salaire\">rappel de salaire<\/a>. Elle r\u00e9forme le jugement en appliquant l&#8217;annexe sp\u00e9cifique et d\u00e9boute la salari\u00e9e de sa demande principale.<\/p>\n<p>L&#8217;interpr\u00e9tation stricte de la clause de faveur conventionnelle<\/p>\n<p>La d\u00e9termination de la norme applicable ob\u00e9it \u00e0 un principe hi\u00e9rarchique. L&#8217;annexe du 10 d\u00e9cembre 2002 est sp\u00e9cifique aux \u00e9tablissements accueillant des personnes \u00e2g\u00e9es. Son article premier dispose que &#8220;les dispositions de la convention collective sont applicables \u00e0 l&#8217;exclusion notamment de celles d\u00e9coulant de l&#8217;article 84.1 relatif \u00e0 la pr\u00e9voyance&#8221;. La cour en d\u00e9duit la primaut\u00e9 de l&#8217;annexe sur le texte g\u00e9n\u00e9ral. Le champ d&#8217;application de la clause de faveur est ensuite interpr\u00e9t\u00e9 restrictivement. La mention &#8220;cette disposition ne remettant pas en cause les dispositions existantes lorsqu&#8217;elles sont plus favorables&#8221; ne concerne que le d\u00e9lai de carence. &#8220;La partie de la phrase cit\u00e9e par les premiers juges relative \u00e0 l&#8217;application de la disposition la plus favorable ne concerne que la question du d\u00e9lai de carence, et non celle relative \u00e0 l&#8217;assiette de calcul du maintien de salaire&#8221; (Motifs). La port\u00e9e de cette analyse est significative pour le droit conventionnel. Elle rappelle que le b\u00e9n\u00e9fice de la r\u00e8gle la plus favorable est une question d&#8217;interpr\u00e9tation stricte. La valeur de l&#8217;arr\u00eat r\u00e9side dans sa lecture litt\u00e9rale et contextualis\u00e9e des clauses.<\/p>\n<p>La mise en \u0153uvre du calcul conventionnel du maintien de salaire<\/p>\n<p>L&#8217;application de l&#8217;annexe conduit \u00e0 un calcul pr\u00e9cis de la cr\u00e9ance. L&#8217;article 84-1 bis pr\u00e9voit un maintien \u00e0 100% du net pendant quatre-vingt-dix jours. &#8220;Au-del\u00e0 de 90 jours, maintien en net de 80 % de la r\u00e9mun\u00e9ration brute sur la base de la moyenne des r\u00e9mun\u00e9rations des 6 derniers mois&#8221; (Motifs). La cour proc\u00e8de \u00e0 un r\u00e9examen d\u00e9taill\u00e9 des sommes per\u00e7ues. Elle int\u00e8gre les indemnit\u00e9s journali\u00e8res de s\u00e9curit\u00e9 sociale initialement omises. Le calcul rectifi\u00e9 \u00e9tablit un trop-per\u00e7u au b\u00e9n\u00e9fice de la salari\u00e9e. Celle-ci &#8220;a \u00e9t\u00e9 remplie de ses droits concernant la garantie de r\u00e9mun\u00e9ration qui lui \u00e9tait due&#8221; (Motifs). La m\u00e9thode de calcul a une port\u00e9e pratique certaine pour les gestionnaires. Elle confirme la n\u00e9cessit\u00e9 d&#8217;une d\u00e9duction int\u00e9grale des indemnit\u00e9s sociales. La valeur de cette analyse est de rappeler le caract\u00e8re subsidiaire de la garantie compl\u00e9mentaire de l&#8217;employeur. Le salari\u00e9 ne peut cumuler des revenus sup\u00e9rieurs \u00e0 son salaire net habituel.<\/p>\n<p>La sanction des obligations accessoires de l&#8217;employeur<\/p>\n<p>La demande indemnitaire pour remise tardive des bulletins est rejet\u00e9e. La salari\u00e9e invoquait un pr\u00e9judice li\u00e9 \u00e0 l&#8217;absence de vision globale sur ses indemnit\u00e9s. La cour rel\u00e8ve que les bulletins ont \u00e9t\u00e9 remis suite aux mises en demeure. Elle constate surtout que &#8220;la salari\u00e9e, qui reconnait avoir re\u00e7u ses bulletins de paie les 27 janvier et 3 d\u00e9cembre 2021, ne justifie pas de son pr\u00e9judice&#8221; (Motifs). Ce refus d&#8217;allouer des dommages-int\u00e9r\u00eats a une port\u00e9e incitative limit\u00e9e. Il exige une preuve concr\u00e8te du pr\u00e9judice subi du fait du retard. La valeur de cette solution est de maintenir une exigence de causalit\u00e9 et de pr\u00e9judice certain. Elle \u00e9vite une sanction automatique pour la seule violation d&#8217;une obligation formelle.
