Apr\u00e8s avoir constat\u00e9 la recevabilit\u00e9 de la requ\u00eate, il prononce la r\u00e9siliation et ordonne l&#8217;expulsion du locataire d\u00e9faillant. Il condamne \u00e9galement ce dernier au paiement de diverses sommes, en accordant l&#8217;ex\u00e9cution provisoire \u00e0 l&#8217;ordonnance.<\/p>\n<p>La r\u00e9gularit\u00e9 proc\u00e9durale de la demande en r\u00e9siliation<\/p>\n<p>Le respect des conditions pr\u00e9alables \u00e0 l&#8217;action. Le juge v\u00e9rifie scrupuleusement le respect des formalit\u00e9s impos\u00e9es par la loi du 6 juillet 1989 avant toute action en r\u00e9siliation. L&#8217;assignation n&#8217;est recevable qu&#8217;apr\u00e8s la saisine obligatoire de la commission de coordination et l&#8217;expiration d&#8217;un d\u00e9lai de deux mois. &#8220;En application de l&#8217;article 24 II de la loi du 6 juillet 1989, les bailleurs personnes morales [&#8230;] ne peuvent faire d\u00e9livrer, sous peine d&#8217;irrecevabilit\u00e9 de la demande, une assignation [&#8230;] avant l&#8217;expiration d&#8217;un d\u00e9lai de deux mois suivant la saisine de la commission&#8221; (Motifs). La d\u00e9cision consacre ainsi le caract\u00e8re d&#8217;ordre public de cette proc\u00e9dure protectrice, garantissant un d\u00e9lai de r\u00e9flexion et de m\u00e9diation.<\/p>\n<p>Le contr\u00f4le du juge en l&#8217;absence de comparution. Le d\u00e9fendeur ne comparaissant pas, le juge statue n\u00e9anmoins sur le fond en exer\u00e7ant un contr\u00f4le renforc\u00e9. &#8220;En application de l\u2019article 472 du code de proc\u00e9dure civile, si le d\u00e9fendeur ne compara\u00eet pas, il est n\u00e9anmoins statu\u00e9 sur le fond. Le juge ne fait droit \u00e0 la demande que dans la mesure o\u00f9 il l&#8217;estime r\u00e9guli\u00e8re, recevable et bien fond\u00e9e&#8221; (Motifs). Ce rappel souligne que l&#8217;absence de la partie d\u00e9fenderesse n&#8217;\u00e9quivaut pas \u00e0 un acquiescement automatique \u00e0 la demande. Le juge doit s&#8217;assurer du bien-fond\u00e9 de la requ\u00eate, pr\u00e9servant ainsi les droits de la partie absente. Cette approche est conforme \u00e0 une jurisprudence constante, comme le rappelle un tribunal judiciaire : &#8220;En application de l\u2019article 472 du code de proc\u00e9dure civile, si le d\u00e9fendeur ne compara\u00eet pas, il est n\u00e9anmoins statu\u00e9 sur le fond, le juge ne faisant alors droit \u00e0 la demande que dans la mesure o\u00f9 il l\u2019estime r\u00e9guli\u00e8re, recevable et bien fond\u00e9e&#8221; (Tribunal judiciaire, le 9 f\u00e9vrier 2026, n\u00b025\/01036).<\/p>\n<p>Les effets juridiques de la d\u00e9faillance du locataire<\/p>\n<p>La mise en \u0153uvre effective de la <a href=\"https:\/\/kohenavocats.fr\/avocat-resiliation-bail-paris\/\" target=\"_blank\" title=\"clause r\u00e9solutoire\">clause r\u00e9solutoire<\/a>. La d\u00e9cision op\u00e8re une application stricte des conditions de mise en \u0153uvre de la clause contractuelle. Elle exige un <a href=\"https:\/\/kohenavocats.fr\/avocat-recouvrement-loyers-paris\/\" target=\"_blank\" title=\"commandement de payer\">commandement de payer<\/a> pr\u00e9alable et un d\u00e9lai d&#8217;impay\u00e9 de deux mois apr\u00e8s ce commandement. &#8220;Un commandement de payer visant la clause r\u00e9solutoire [&#8230;] a \u00e9t\u00e9 signifi\u00e9 au locataire le 26 d\u00e9cembre 2024 [&#8230;] les causes de ce commandement de payer sont demeur\u00e9es impay\u00e9es pendant plus de deux mois&#8221; (Motifs). Cette solution rappelle que la clause r\u00e9solutoire de plein droit n&#8217;est pas automatique. Elle n\u00e9cessite une mise en demeure formelle et un d\u00e9lai de carence, prot\u00e9geant le locataire contre une r\u00e9siliation trop exp\u00e9ditive. Cette interpr\u00e9tation rejoint celle de la Cour d&#8217;appel qui pr\u00e9cise : &#8220;toute clause pr\u00e9voyant la r\u00e9siliation de plein droit du contrat de location pour d\u00e9faut de paiement [&#8230;] ne produit effet que deux mois apr\u00e8s un commandement de payer demeur\u00e9 infructueux&#8221; (Cour d&#8217;appel, le 9 janvier 2025, n\u00b023\/05089).<\/p>\n<p>La sanction financi\u00e8re du maintien dans les lieux. Apr\u00e8s la r\u00e9siliation, le juge proc\u00e8de \u00e0 une requalification des cr\u00e9ances et fixe une indemnit\u00e9 d&#8217;occupation. &#8220;Les sommes correspondant \u00e0 la p\u00e9riode suivant la r\u00e9siliation du bail doivent \u00eatre requalifi\u00e9es en indemnit\u00e9s d&#8217;occupation mensuelles&#8221; (Motifs). Cette indemnit\u00e9 est fix\u00e9e au montant du dernier loyer et charges, index\u00e9e selon les termes du bail r\u00e9sili\u00e9. Cette mesure vise \u00e0 compenser le pr\u00e9judice subi par le bailleur du fait de l&#8217;occupation sans titre, tout en \u00e9vitant une enrichissement sans cause.
