Le point de d\u00e9part local : o\u00f9 se situe le logement ?<\/h2>\n<p>En mati\u00e8re locative, le dossier doit partir de l&#8217;adresse du logement. C&#8217;est elle qui permet d&#8217;identifier le tribunal judiciaire comp\u00e9tent et, selon les ressorts, la chambre de proximit\u00e9.<\/p>\n<p>La r\u00e8gle territoriale g\u00e9n\u00e9rale du code de proc\u00e9dure civile est utile, mais les litiges relatifs \u00e0 l&#8217;immeuble et au bail d&#8217;habitation imposent surtout de raisonner \u00e0 partir du lieu du logement. Pour un appartement situ\u00e9 \u00e0 Paris, le tribunal judiciaire de Paris est le point de rattachement naturel. Pour un logement situ\u00e9 dans les Hauts-de-Seine, le Val-de-Marne, la Seine-Saint-Denis, l&#8217;Essonne, les Yvelines, le Val-d&#8217;Oise ou la Seine-et-Marne, il faut v\u00e9rifier le tribunal judiciaire et la chambre de proximit\u00e9 du ressort.<\/p>\n<p>Quelques exemples franciliens :<\/p>\n<ul>\n<li>Paris : tribunal judiciaire de Paris ;<\/li>\n<li>Boulogne-Billancourt : tribunal judiciaire de Nanterre, chambre de proximit\u00e9 de Boulogne-Billancourt ;<\/li>\n<li>Saint-Denis : tribunal judiciaire de Bobigny, chambre de proximit\u00e9 de Saint-Denis ;<\/li>\n<li>Cr\u00e9teil : tribunal judiciaire de Cr\u00e9teil, chambre de proximit\u00e9 de Saint-Maur-des-Foss\u00e9s ;<\/li>\n<li>Versailles : tribunal judiciaire de Versailles ;<\/li>\n<li>Meaux : tribunal judiciaire de Meaux ;<\/li>\n<li>Evry-Courcouronnes : tribunal judiciaire d&#8217;Evry-Courcouronnes.<\/li>\n<\/ul>\n<p>Cette v\u00e9rification est importante parce qu&#8217;un dossier d&#8217;IRL mal orient\u00e9 perd du temps. Or, dans une contestation de loyer, le temps p\u00e8se vite : les paiements continuent, les relances s&#8217;accumulent, et un impay\u00e9 artificiel peut \u00eatre cr\u00e9\u00e9 si les parties ne s\u00e9parent pas le loyer d\u00fb du surplus contest\u00e9.<\/p>\n<h2>2. La comp\u00e9tence mat\u00e9rielle : le juge des contentieux de la protection<\/h2>\n<p>Les litiges de bail d&#8217;habitation rel\u00e8vent en pratique du juge des contentieux de la protection du tribunal judiciaire comp\u00e9tent. Le dossier peut porter sur la fixation du loyer r\u00e9vis\u00e9, la restitution d&#8217;un trop-per\u00e7u, la contestation d&#8217;arri\u00e9r\u00e9s d&#8217;indexation, ou l&#8217;articulation avec une proc\u00e9dure d&#8217;impay\u00e9.<\/p>\n<p>Le r\u00e9flexe n&#8217;est donc pas de saisir n&#8217;importe quelle juridiction au si\u00e8ge de l&#8217;agence ou au domicile du bailleur. Pour un bail d&#8217;habitation, il faut revenir au logement, au bail et au juge comp\u00e9tent pour le contentieux locatif.<\/p>\n<p>Dans beaucoup de dossiers, une phase amiable bien construite \u00e9vite l&#8217;audience. Mais lorsque le bailleur maintient un rappel abusif, ou lorsque le locataire refuse toute r\u00e9vision pourtant r\u00e9guli\u00e8re, il faut \u00eatre pr\u00eat \u00e0 produire un tableau clair devant le juge.<\/p>\n<h2>3. Les pi\u00e8ces \u00e0 pr\u00e9parer pour un dossier IRL francilien<\/h2>\n<p>Un dossier de r\u00e9vision IRL ne doit pas arriver chez l&#8217;avocat sous forme de captures dispers\u00e9es. Il faut pr\u00e9parer un lot simple.<\/p>\n<p>Les pi\u00e8ces essentielles sont :<\/p>\n<ul>\n<li>le bail sign\u00e9 et ses annexes ;<\/li>\n<li>la clause de r\u00e9vision du loyer ;<\/li>\n<li>les \u00e9ventuels avenants ;<\/li>\n<li>les courriers de demande de r\u00e9vision ;<\/li>\n<li>les quittances de loyer ;<\/li>\n<li>le tableau des loyers pay\u00e9s mois par mois ;<\/li>\n<li>le DPE en cours de validit\u00e9 ;<\/li>\n<li>les courriers de contestation ;<\/li>\n<li>les relances d&#8217;agence ;<\/li>\n<li>le d\u00e9compte des arri\u00e9r\u00e9s r\u00e9clam\u00e9s ;<\/li>\n<li>les justificatifs de paiement.<\/li>\n<\/ul>\n<p>Pour le bailleur, il faut ajouter le calcul d\u00e9taill\u00e9 : loyer hors charges, ancien IRL, nouvel IRL, trimestre de r\u00e9f\u00e9rence, date de prise d&#8217;effet, et nouveau loyer. Pour le locataire, il faut pr\u00e9parer une version concurrente du calcul, en isolant ce qui est accept\u00e9 et ce qui est contest\u00e9.<\/p>\n<h2>4. Paris : attention \u00e0 l&#8217;encadrement des loyers et au DPE<\/h2>\n<p>\u00c0 Paris, la discussion IRL peut se superposer \u00e0 d&#8217;autres sujets : encadrement des loyers, compl\u00e9ment de loyer, DPE F\/G, logement meubl\u00e9, <a href=\"https:\/\/kohenavocats.fr\/avocat-colocation-paris-sous-location-bail-colocataires\/\" target=\"_blank\" title=\"colocation\">colocation<\/a>, bail mobilit\u00e9, ou renouvellement du bail.<\/p>\n<p>Il faut \u00e9viter un m\u00e9lange confus.<\/p>\n<p>L&#8217;IRL r\u00e9pond \u00e0 une question : le loyer en cours de bail peut-il \u00eatre r\u00e9vis\u00e9 selon l&#8217;indice pr\u00e9vu par la loi et le contrat ? L&#8217;encadrement des loyers r\u00e9pond \u00e0 une autre question : le loyer de base et, le cas \u00e9ch\u00e9ant, le compl\u00e9ment de loyer respectent-ils le plafond applicable au moment de la fixation ou du renouvellement ?<\/p>\n<p>Le DPE ajoute encore une couche. L&#8217;<a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/article_lc\/LEGIARTI000043977085\">article 17-1 de la loi du 6 juillet 1989<\/a> interdit la r\u00e9vision et la majoration dans les logements class\u00e9s F ou G, au sens de l&#8217;<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000043966496\">article L. 173-1-1 du code de la construction et de l&#8217;habitation<\/a>, lorsque la r\u00e8gle est applicable \u00e0 la situation du bail.<\/p>\n<p>Dans un dossier parisien, il faut donc poser les questions dans l&#8217;ordre :<\/p>\n<ol>\n<li>Le bail contient-il une clause de r\u00e9vision ?<\/li>\n<li>Quelle date annuelle est pr\u00e9vue ?<\/li>\n<li>Quel indice IRL doit \u00eatre utilis\u00e9 ?<\/li>\n<li>Le bailleur a-t-il demand\u00e9 la r\u00e9vision dans le d\u00e9lai d&#8217;un an ?<\/li>\n<li>Le logement est-il class\u00e9 F ou G ?<\/li>\n<li>Le montant global du loyer soul\u00e8ve-t-il aussi un probl\u00e8me d&#8217;encadrement ?<\/li>\n<\/ol>\n<h2>5. \u00cele-de-France : les erreurs fr\u00e9quentes des agences et des bailleurs<\/h2>\n<p>Les m\u00eames erreurs reviennent souvent.<\/p>\n<p>Premi\u00e8re erreur : int\u00e9grer les charges dans la base de calcul. La r\u00e9vision IRL porte sur le loyer, non sur les provisions r\u00e9cup\u00e9rables, m\u00eame si certains forfaits de charges en meubl\u00e9 doivent \u00eatre analys\u00e9s \u00e0 part.<\/p>\n<p>Deuxi\u00e8me erreur : utiliser le dernier indice publi\u00e9 au hasard, sans respecter le trimestre de r\u00e9f\u00e9rence pr\u00e9vu au bail ou celui applicable en l&#8217;absence de pr\u00e9cision.<\/p>\n<p>Troisi\u00e8me erreur : r\u00e9clamer plusieurs ann\u00e9es d&#8217;oubli comme si le bailleur n&#8217;avait jamais renonc\u00e9 aux r\u00e9visions pass\u00e9es. Or l&#8217;article 17-1 encadre pr\u00e9cis\u00e9ment le d\u00e9lai d&#8217;un an.<\/p>\n<p>Quatri\u00e8me erreur : ignorer le DPE. En \u00cele-de-France, de nombreux logements anciens sont concern\u00e9s par les classes \u00e9nerg\u00e9tiques basses. Une r\u00e9vision envoy\u00e9e sans v\u00e9rification pr\u00e9alable peut \u00eatre fragile.<\/p>\n<p>Cinqui\u00e8me erreur : transformer une contestation partielle en impay\u00e9 total. Si le locataire continue de payer le loyer non contest\u00e9, le bailleur doit isoler le surplus litigieux. \u00c0 l&#8217;inverse, le locataire qui cesse tout paiement cr\u00e9e un risque proc\u00e9dural \u00e9vitable.<\/p>\n<h2>6. Que faire d\u00e8s r\u00e9ception d&#8217;une hausse IRL contestable ?<\/h2>\n<p>Le locataire doit r\u00e9pondre vite, mais proprement.<\/p>\n<p>La r\u00e9ponse utile tient en cinq points :<\/p>\n<ul>\n<li>rappeler que la contestation porte sur le calcul ou le d\u00e9lai, pas sur le principe de payer le loyer ;<\/li>\n<li>demander la clause de r\u00e9vision et le d\u00e9tail des indices ;<\/li>\n<li>contester les arri\u00e9r\u00e9s si la r\u00e9vision est demand\u00e9e tardivement ;<\/li>\n<li>demander le DPE si le logement peut \u00eatre class\u00e9 F ou G ;<\/li>\n<li>annoncer le paiement du loyer non contest\u00e9.<\/li>\n<\/ul>\n<p>Cette m\u00e9thode \u00e9vite que le dossier soit pr\u00e9sent\u00e9 comme un refus de payer. Elle transforme la discussion en v\u00e9rification juridique et comptable.<\/p>\n<p>Le bailleur, de son c\u00f4t\u00e9, doit \u00e9viter les relances automatiques. S&#8217;il veut pr\u00e9server son dossier, il doit produire un calcul exploitable et r\u00e9pondre aux objections s\u00e9rieuses. Si la contestation est infond\u00e9e, il pourra ensuite le d\u00e9montrer beaucoup plus facilement.<\/p>\n<h2>7. Le bon tableau de calcul pour le juge<\/h2>\n<p>Devant le juge, le tableau doit \u00eatre lisible en moins d&#8217;une minute.<\/p>\n<p>Il peut comporter les colonnes suivantes :<\/p>\n<ul>\n<li>p\u00e9riode concern\u00e9e ;<\/li>\n<li>loyer hors charges avant r\u00e9vision ;<\/li>\n<li>date de r\u00e9vision pr\u00e9vue ;<\/li>\n<li>indice ancien ;<\/li>\n<li>indice nouveau ;<\/li>\n<li>loyer r\u00e9vis\u00e9 demand\u00e9 ;<\/li>\n<li>date de demande ;<\/li>\n<li>montant accept\u00e9 ;<\/li>\n<li>montant contest\u00e9 ;<\/li>\n<li>motif de contestation.<\/li>\n<\/ul>\n<p>Ce tableau est plus utile qu&#8217;un long courrier d&#8217;indignation. Il permet de voir imm\u00e9diatement si le bailleur a utilis\u00e9 le bon indice, si une ann\u00e9e est perdue, si le DPE bloque la hausse, ou si le locataire conteste sans base.<\/p>\n<h2>8. Delta concurrentiel identifi\u00e9 avant publication<\/h2>\n<p>Les contenus concurrents consult\u00e9s avant r\u00e9daction couvrent surtout la formule IRL et l&#8217;information g\u00e9n\u00e9rale.<\/p>\n<p>Service-Public expose correctement l&#8217;indice, la m\u00e9thode de calcul et les textes. ANIL d\u00e9taille le dernier indice, la demande de r\u00e9vision et l&#8217;oubli d&#8217;indexation. BailFacile pr\u00e9sente une logique pratique de gestion locative pour bailleur.<\/p>\n<p>Le manque identifi\u00e9 est diff\u00e9rent : aucun de ces contenus ne combine, dans un m\u00eame angle contentieux, la v\u00e9rification du d\u00e9lai d&#8217;un an, le refus des rattrapages abusifs, le DPE F\/G, la s\u00e9paration loyer d\u00fb \/ surplus contest\u00e9, puis la comp\u00e9tence Paris et \u00cele-de-France avec les pi\u00e8ces \u00e0 produire. Synth\u00e8se Paris \/ \u00cele-de-France<\/h2>\n<p>La r\u00e9vision IRL est rarement un gros proc\u00e8s en valeur absolue, mais elle peut d\u00e9clencher un contentieux locatif plus large si elle est mal trait\u00e9e.<\/p>\n<p>\u00c0 Paris et en \u00cele-de-France, il faut v\u00e9rifier le bail, la clause, le trimestre, le DPE, le d\u00e9lai d&#8217;un an et le tribunal comp\u00e9tent. Le propri\u00e9taire doit produire un calcul pr\u00e9cis. Le locataire doit contester sans cr\u00e9er un impay\u00e9 total.
