Quel juge saisir \u00e0 Paris et en \u00cele-de-France ?<\/h2>\n<p>Pour un bail d&#8217;habitation, les litiges n\u00e9s du bail rel\u00e8vent en pratique du juge des contentieux de la protection. Lorsque le bailleur agit contre le locataire et sa caution pour loyers, charges, indemnit\u00e9 d&#8217;occupation ou r\u00e9parations locatives, il faut raisonner \u00e0 partir du logement lou\u00e9 et du ressort territorial comp\u00e9tent.<\/p>\n<p>\u00c0 Paris, le point d&#8217;entr\u00e9e est le tribunal judiciaire de Paris. Pour un logement situ\u00e9 dans les Hauts-de-Seine, la Seine-Saint-Denis, le Val-de-Marne, les Yvelines, le Val-d&#8217;Oise, l&#8217;Essonne ou la Seine-et-Marne, il faut identifier le tribunal judiciaire et, selon les communes, la chambre de proximit\u00e9 comp\u00e9tente.<\/p>\n<p>La r\u00e8gle territoriale g\u00e9n\u00e9rale de l&#8217;article 42 du code de proc\u00e9dure civile renvoie au lieu o\u00f9 demeure le d\u00e9fendeur. Mais les litiges locatifs appellent aussi une logique de proximit\u00e9 avec l&#8217;immeuble et avec le bail. Pour \u00e9viter une exception de comp\u00e9tence, la saisine doit \u00eatre pr\u00e9par\u00e9e \u00e0 partir de l&#8217;adresse du logement, de l&#8217;adresse du locataire, de l&#8217;adresse de la caution et de la nature exacte de la demande.<\/p>\n<h2>2. Les juridictions franciliennes \u00e0 v\u00e9rifier avant d&#8217;assigner<\/h2>\n<p>Quelques rep\u00e8res utiles :<\/p>\n<ul>\n<li>Paris : tribunal judiciaire de Paris.<\/li>\n<li>Hauts-de-Seine : tribunal judiciaire de Nanterre, avec chambres de proximit\u00e9 selon les communes.<\/li>\n<li>Seine-Saint-Denis : tribunal judiciaire de Bobigny, avec chambres de proximit\u00e9 selon les communes.<\/li>\n<li>Val-de-Marne : tribunal judiciaire de Cr\u00e9teil, avec chambres de proximit\u00e9 selon les communes.<\/li>\n<li>Yvelines : tribunal judiciaire de Versailles ou chambres de proximit\u00e9 selon la commune.<\/li>\n<li>Val-d&#8217;Oise : tribunal judiciaire de Pontoise ou chambres de proximit\u00e9.<\/li>\n<li>Essonne : tribunal judiciaire d&#8217;Evry-Courcouronnes ou chambres de proximit\u00e9.<\/li>\n<li>Seine-et-Marne : tribunaux judiciaires de Paris non comp\u00e9tents par d\u00e9faut ; il faut v\u00e9rifier Meaux, Melun ou Fontainebleau selon le lieu.<\/li>\n<\/ul>\n<p>Cette v\u00e9rification para\u00eet administrative. Elle est strat\u00e9gique. Une erreur de ressort peut retarder la proc\u00e9dure et donner \u00e0 la caution une premi\u00e8re ligne de d\u00e9fense.<\/p>\n<h2>3. Faut-il assigner le locataire et la caution ensemble ?<\/h2>\n<p>Souvent, oui.<\/p>\n<p>Lorsque le bailleur cherche un titre ex\u00e9cutoire sur une dette locative, il a int\u00e9r\u00eat \u00e0 pr\u00e9senter au juge une image compl\u00e8te : bail, impay\u00e9s, commandement \u00e9ventuel, d\u00e9compte, acte de cautionnement, plafond et dur\u00e9e de l&#8217;engagement.<\/p>\n<p>Assigner seulement le locataire peut cr\u00e9er un second temps contentieux contre le garant. Assigner le locataire et la caution permet de faire trancher imm\u00e9diatement la dette principale et l&#8217;\u00e9tendue de la garantie.<\/p>\n<p>Il faut toutefois \u00e9viter une assignation m\u00e9canique. Si l&#8217;acte de caution est fragile, si la dur\u00e9e est discut\u00e9e, si le plafond est d\u00e9j\u00e0 d\u00e9pass\u00e9, ou si le bailleur avait une assurance <a href=\"https:\/\/kohenavocats.fr\/avocat-recouvrement-loyers-paris\/\" target=\"_blank\" title=\"loyers impay\u00e9s\">loyers impay\u00e9s<\/a> incompatible avec le cautionnement, il faut d&#8217;abord mesurer le risque. Une demande mal cadr\u00e9e contre le garant peut devenir un aveu de faiblesse sur tout le dossier.<\/p>\n<h2>4. Les pi\u00e8ces indispensables contre le garant<\/h2>\n<p>Un dossier francilien propre contient au minimum :<\/p>\n<ul>\n<li>le bail sign\u00e9 et ses annexes ;<\/li>\n<li>l&#8217;acte de cautionnement sign\u00e9 ;<\/li>\n<li>les justificatifs d&#8217;identit\u00e9 et de solvabilit\u00e9 remis par la caution ;<\/li>\n<li>le montant du loyer et les conditions de r\u00e9vision ;<\/li>\n<li>le plafond garanti en lettres et en chiffres ;<\/li>\n<li>la dur\u00e9e de l&#8217;engagement ;<\/li>\n<li>les relances et mises en demeure ;<\/li>\n<li>le commandement de payer, s&#8217;il existe ;<\/li>\n<li>la preuve de sa d\u00e9nonciation \u00e0 la caution lorsque l&#8217;article 24 est mobilis\u00e9 ;<\/li>\n<li>un d\u00e9compte mois par mois ;<\/li>\n<li>les justificatifs des charges et r\u00e9parations locatives ;<\/li>\n<li>les paiements d\u00e9j\u00e0 re\u00e7us ;<\/li>\n<li>le calcul du solde demand\u00e9 dans la limite du plafond.<\/li>\n<\/ul>\n<p>Ce dernier point est essentiel. Le juge ne condamne pas une caution sur une impression g\u00e9n\u00e9rale d&#8217;impay\u00e9. Il faut relier chaque poste \u00e0 un texte, au bail et \u00e0 l&#8217;acte de cautionnement.<\/p>\n<h2>5. Les erreurs qui fragilisent l&#8217;action \u00e0 Paris et en \u00cele-de-France<\/h2>\n<p>Premi\u00e8re erreur : poursuivre la caution sans v\u00e9rifier le cumul avec une garantie loyers impay\u00e9s. L&#8217;article 22-1 de la loi du 6 juillet 1989 interdit ce cumul, sauf exception notamment pour l&#8217;\u00e9tudiant ou l&#8217;apprenti.<\/p>\n<p>Deuxi\u00e8me erreur : produire un acte de cautionnement sans plafond lisible. L&#8217;article 2297 du code civil exige un montant maximal en principal et accessoires exprim\u00e9 en lettres et en chiffres.<\/p>\n<p>Troisi\u00e8me erreur : r\u00e9clamer des postes qui ne sont pas couverts. Si l&#8217;acte ne vise pas les r\u00e9parations locatives ou l&#8217;indemnit\u00e9 d&#8217;occupation, la demande doit \u00eatre prudente.<\/p>\n<p>Quatri\u00e8me erreur : oublier la dur\u00e9e. Un cautionnement \u00e0 dur\u00e9e d\u00e9termin\u00e9e ne couvre pas n\u00e9cessairement toute la vie du bail et de ses renouvellements. Un cautionnement \u00e0 dur\u00e9e ind\u00e9termin\u00e9e peut \u00eatre r\u00e9sili\u00e9, avec effet au terme du bail concern\u00e9.<\/p>\n<p>Cinqui\u00e8me erreur : confondre solidarit\u00e9 du colocataire et solidarit\u00e9 de la caution. En <a href=\"https:\/\/kohenavocats.fr\/avocat-colocation-paris-sous-location-bail-colocataires\/\" target=\"_blank\" title=\"colocation\">colocation<\/a>, l&#8217;article 8-1 de la loi du 6 juillet 1989 limite la solidarit\u00e9 du colocataire sortant et de sa caution, en particulier en cas d&#8217;arriv\u00e9e d&#8217;un nouveau colocataire ou \u00e0 l&#8217;issue d&#8217;un d\u00e9lai maximal de six mois apr\u00e8s le cong\u00e9.<\/p>\n<h2>6. Que peut faire la caution pour se d\u00e9fendre ?<\/h2>\n<p>La caution peut d&#8217;abord demander la communication compl\u00e8te du dossier. Elle doit obtenir le bail, l&#8217;acte sign\u00e9, le d\u00e9compte, les justificatifs de charges, les actes de proc\u00e9dure et la preuve des paiements imput\u00e9s.<\/p>\n<p>Elle peut ensuite v\u00e9rifier la validit\u00e9 de son engagement. Les moyens les plus utiles portent sur :<\/p>\n<ul>\n<li>le cumul interdit avec une assurance loyers impay\u00e9s ;<\/li>\n<li>l&#8217;absence ou l&#8217;impr\u00e9cision du montant maximal ;<\/li>\n<li>l&#8217;absence de renonciation claire au b\u00e9n\u00e9fice de discussion ou de division ;<\/li>\n<li>une dur\u00e9e expir\u00e9e ;<\/li>\n<li>une dette n\u00e9e hors p\u00e9riode garantie ;<\/li>\n<li>des charges ou r\u00e9parations non justifi\u00e9es ;<\/li>\n<li>une demande sup\u00e9rieure au plafond.<\/li>\n<\/ul>\n<p>Enfin, la caution peut discuter le calendrier. Si le bail est r\u00e9sili\u00e9 et que le locataire se maintient dans les lieux, il faut v\u00e9rifier si l&#8217;acte couvre l&#8217;indemnit\u00e9 d&#8217;occupation apr\u00e8s r\u00e9siliation, et jusqu&#8217;\u00e0 quelle limite.<\/p>\n<h2>7. Pourquoi le contexte local change la strat\u00e9gie<\/h2>\n<p>\u00c0 Paris, les dossiers locatifs sont souvent rapides \u00e0 documenter mais plus difficiles \u00e0 chiffrer proprement : loyers \u00e9lev\u00e9s, charges de <a href=\"https:\/\/kohenavocats.fr\/droit-de-la-copropriete\/\" target=\"_blank\" title=\"copropri\u00e9t\u00e9\">copropri\u00e9t\u00e9<\/a>, frais de proc\u00e9dure, indemnit\u00e9 d&#8217;occupation et r\u00e9parations locatives peuvent vite approcher le plafond du cautionnement.<\/p>\n<p>En petite couronne, la difficult\u00e9 tient souvent au ressort exact et aux chambres de proximit\u00e9. \u00c0 Nanterre, Bobigny, Cr\u00e9teil ou Versailles, le mauvais choix de juridiction peut provoquer une perte de temps. En grande couronne, la m\u00eame vigilance vaut pour Evry-Courcouronnes, Pontoise, Meaux, Melun, Fontainebleau ou leurs chambres de proximit\u00e9.<\/p>\n<p>Le dossier doit donc \u00eatre pr\u00e9par\u00e9 en deux tableaux :<\/p>\n<ul>\n<li>un tableau de comp\u00e9tence : logement, locataire, caution, juridiction ;<\/li>\n<li>un tableau de dette : loyers, charges, indemnit\u00e9, r\u00e9parations, paiements, plafond.<\/li>\n<\/ul>\n<p>Cette m\u00e9thode \u00e9vite une assignation confuse et permet d&#8217;anticiper les objections du garant.<\/p>\n<h2>8. Comment articuler le principal et le satellite<\/h2>\n<p>Le principal explique le r\u00e9gime g\u00e9n\u00e9ral : acte de cautionnement, montant, dur\u00e9e, cumul avec l&#8217;assurance loyers impay\u00e9s et validit\u00e9 de l&#8217;engagement.<\/p>\n<p>Cette page locale descend un cran plus bas.
