Une maison en Seine-Saint-Denis est conserv\u00e9e par un ex-concubin. Un bien indivis dans les Hauts-de-Seine n&#8217;est ni vendu ni lou\u00e9 parce que l&#8217;un des propri\u00e9taires y vit seul. Dans ces dossiers, la question juridique devient tr\u00e8s concr\u00e8te : quel juge saisir en \u00cele-de-France, quelles preuves r\u00e9unir, et comment faire entrer l&#8217;indemnit\u00e9 d&#8217;occupation dans le partage ?<\/p>\n<p>Le cadre de fond est expos\u00e9 dans notre guide principal : <a href=\"https:\/\/kohenavocats.fr\/2026\/04\/24\/indemnite-occupation-indivision-calcul-remboursement-pret-recours\/\">Indemnit\u00e9 d&#8217;occupation en indivision : calcul, remboursement du pr\u00eat et recours<\/a>. La pr\u00e9sente page traite le versant local et proc\u00e9dural : ressort comp\u00e9tent, pi\u00e8ces utiles, strat\u00e9gie notaire \/ tribunal et articulation avec les dossiers de divorce, succession ou s\u00e9paration.<\/p>\n<h2>1. Le bon juge en fonction du contexte<\/h2>\n<p>L&#8217;indemnit\u00e9 d&#8217;occupation en indivision ne se traite pas toujours devant le m\u00eame juge. Le choix d\u00e9pend de l&#8217;origine de l&#8217;indivision.<\/p>\n<p>En succession, le dossier rel\u00e8ve du tribunal judiciaire du lieu d&#8217;ouverture de la succession ou du partage judiciaire, selon la demande form\u00e9e. Dans la pratique francilienne, les dossiers comportant un immeuble \u00e0 Paris, Boulogne-Billancourt, Montreuil, Cr\u00e9teil, Versailles ou Pontoise passent souvent par une phase notariale avant le contentieux. Si le notaire ne parvient pas \u00e0 arr\u00eater les comptes, un proc\u00e8s-verbal de difficult\u00e9s permet de saisir le tribunal.<\/p>\n<p>En divorce ou liquidation post-communautaire, le juge aux affaires familiales intervient selon le stade de la proc\u00e9dure. Pendant la proc\u00e9dure de divorce, il peut statuer sur la jouissance du logement et pr\u00e9ciser si elle est gratuite ou on\u00e9reuse. Apr\u00e8s le divorce, les comptes de liquidation et de partage peuvent int\u00e9grer l&#8217;indemnit\u00e9 d&#8217;occupation due par l&#8217;\u00e9poux qui a conserv\u00e9 la jouissance privative.<\/p>\n<p>Pour des concubins ou partenaires s\u00e9par\u00e9s, sans proc\u00e9dure familiale en cours, le tribunal judiciaire est g\u00e9n\u00e9ralement le juge du partage et des comptes. Il peut \u00eatre saisi pour sortir de l&#8217;indivision, ordonner une licitation si la vente amiable est bloqu\u00e9e, fixer ou faire fixer l&#8217;indemnit\u00e9 d&#8217;occupation et trancher les cr\u00e9ances r\u00e9ciproques.<\/p>\n<p>La r\u00e8gle territoriale doit \u00eatre v\u00e9rifi\u00e9e avec soin. En mati\u00e8re r\u00e9elle immobili\u00e8re, l&#8217;<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006410390\">article 44 du code de proc\u00e9dure civile<\/a> donne comp\u00e9tence \u00e0 la juridiction du lieu de situation de l&#8217;immeuble. En pratique, pour un immeuble \u00e0 Paris, le tribunal judiciaire de Paris est central. Pour les Hauts-de-Seine, Nanterre. Pour la Seine-Saint-Denis, Bobigny. Pour le Val-de-Marne, Cr\u00e9teil. Pour les Yvelines, Versailles. Pour l&#8217;Essonne, \u00c9vry-Courcouronnes. Pour le Val-d&#8217;Oise, Pontoise. Pour la Seine-et-Marne, Meaux ou Melun selon la localisation.<\/p>\n<h2>2. Les preuves qui font gagner du temps<\/h2>\n<p>Les dossiers franciliens se bloquent rarement sur le principe abstrait de l&#8217;article 815-9. Ils se bloquent sur la preuve.<\/p>\n<p>Premier bloc : la preuve de l&#8217;indivision. Il faut l&#8217;acte de propri\u00e9t\u00e9, l&#8217;attestation immobili\u00e8re, la d\u00e9claration de succession, le titre d&#8217;acquisition, les quotes-parts, les statuts de <a href=\"https:\/\/kohenavocats.fr\/elementor-60\/avocats-droit-immobilier-paris\/avocat-sci-paris\/\" target=\"_blank\" title=\"SCI\">SCI<\/a> si le bien est log\u00e9 dans une structure, ou la d\u00e9cision de divorce quand le bien d\u00e9pend d&#8217;une indivision post-communautaire.<\/p>\n<p>Deuxi\u00e8me bloc : la preuve de la jouissance privative. Le demandeur doit montrer que l&#8217;autre indivisaire occupe seul ou conserve seul l&#8217;usage r\u00e9el. Les pi\u00e8ces utiles sont les suivantes : justificatif de domicile, factures d&#8217;\u00e9lectricit\u00e9, taxe d&#8217;habitation si elle existe encore dans le cas concern\u00e9, assurance habitation, courriers refusant la remise des cl\u00e9s, \u00e9changes WhatsApp ou mails, attestations de voisins, constats de commissaire de justice, photographies des lieux, preuve que les autres indivisaires n&#8217;ont plus d&#8217;acc\u00e8s.<\/p>\n<p>Troisi\u00e8me bloc : la preuve de la valeur locative. \u00c0 Paris et en proche couronne, l&#8217;\u00e9cart entre deux arrondissements ou deux stations de transport peut changer fortement le calcul. Il faut donc \u00e9viter une estimation g\u00e9n\u00e9rale. Les avis de valeur doivent \u00eatre localis\u00e9s : surface, \u00e9tage, ascenseur, \u00e9tat, <a href=\"https:\/\/kohenavocats.fr\/droit-de-la-copropriete\/\" target=\"_blank\" title=\"copropri\u00e9t\u00e9\">copropri\u00e9t\u00e9<\/a>, meubl\u00e9 ou vide, quartier, proximit\u00e9 des transports. Pour un bien \u00e0 Paris, un appartement de 50 m2 dans le 11e ne se chiffre pas comme le m\u00eame bien dans le 16e ou \u00e0 Saint-Denis. Le juge a besoin de comparables cr\u00e9dibles.<\/p>\n<p>Quatri\u00e8me bloc : les d\u00e9penses pay\u00e9es par l&#8217;occupant. Celui qui demande \u00e0 compenser l&#8217;indemnit\u00e9 avec les mensualit\u00e9s de pr\u00eat, la taxe fonci\u00e8re ou des travaux doit produire des preuves bancaires. Un tableau suffit rarement sans relev\u00e9s. Il faut le tableau d&#8217;amortissement, les relev\u00e9s de paiement, les appels de charges de copropri\u00e9t\u00e9, les factures acquitt\u00e9es, les justificatifs de taxe fonci\u00e8re et les \u00e9ventuelles d\u00e9cisions d&#8217;<a href=\"https:\/\/kohenavocats.fr\/elementor-60\/avocats-droit-affaires-paris\/avocat-assemblees-generales-societe-paris-2\/\" target=\"_blank\" title=\"assembl\u00e9e g\u00e9n\u00e9rale\">assembl\u00e9e g\u00e9n\u00e9rale<\/a>.<\/p>\n<h2>3. Notaire d&#8217;abord ou tribunal directement ?<\/h2>\n<p>Dans beaucoup de dossiers, le notaire est le premier lieu utile. Il peut centraliser les documents, demander une estimation, proposer un compte d&#8217;indivision et faire appara\u00eetre les points d&#8217;accord et de d\u00e9saccord. Si l&#8217;indemnit\u00e9 d&#8217;occupation est accept\u00e9e dans son principe mais discut\u00e9e dans son montant, une expertise amiable ou une estimation contradictoire peut \u00e9viter une proc\u00e9dure longue.<\/p>\n<p>Mais le notaire ne tranche pas un conflit dur. Si l&#8217;occupant refuse toute indemnit\u00e9, ne communique pas les pi\u00e8ces ou bloque la vente, il faut pr\u00e9parer le contentieux. L&#8217;objectif n&#8217;est pas seulement de r\u00e9clamer une somme. Il peut \u00eatre de provoquer un partage, de demander la <a href=\"https:\/\/kohenavocats.fr\/elementor-60\/avocats-droit-immobilier-paris\/avocat-vente-encheres-immobilieres-paris\/\" target=\"_blank\" title=\"vente judiciaire\">vente judiciaire<\/a>, de faire d\u00e9signer un notaire, de fixer une p\u00e9riode d&#8217;occupation et d&#8217;obtenir une m\u00e9thode de calcul.<\/p>\n<p>\u00c0 Paris et en \u00cele-de-France, le temps judiciaire doit \u00eatre int\u00e9gr\u00e9 dans la strat\u00e9gie. Un dossier incomplet peut perdre plusieurs mois. \u00c0 l&#8217;inverse, une assignation structur\u00e9e avec un tableau de calcul, des estimations et les justificatifs de d\u00e9penses permet de cadrer le d\u00e9bat d\u00e8s la premi\u00e8re audience de mise en \u00e9tat.<\/p>\n<h2>4. Comment pr\u00e9senter le calcul au juge ?<\/h2>\n<p>Le calcul doit \u00eatre lisible. Le cabinet utilise g\u00e9n\u00e9ralement une grille en huit colonnes :<\/p>\n<ul>\n<li>p\u00e9riode d&#8217;occupation revendiqu\u00e9e ;<\/li>\n<li>preuve du d\u00e9but de p\u00e9riode ;<\/li>\n<li>preuve de fin ou situation en cours ;<\/li>\n<li>valeur locative mensuelle ;<\/li>\n<li>d\u00e9cote propos\u00e9e ou contest\u00e9e ;<\/li>\n<li>quote-parts indivises ;<\/li>\n<li>d\u00e9penses de conservation \u00e0 int\u00e9grer au compte ;<\/li>\n<li>solde demand\u00e9 ou contest\u00e9.<\/li>\n<\/ul>\n<p>Exemple simple : un bien \u00e0 Vincennes est d\u00e9tenu \u00e0 60 % par A et 40 % par B. B occupe seul le bien pendant 24 mois. La valeur locative cr\u00e9dible est de 1 800 euros par mois. La base brute d&#8217;occupation est de 43 200 euros. Comme A est priv\u00e9 de sa quote-part de jouissance \u00e0 60 %, l&#8217;effet \u00e9conomique principal est de 25 920 euros, avant discussion sur une d\u00e9cote et avant int\u00e9gration des d\u00e9penses pay\u00e9es par B pour le compte de l&#8217;indivision.<\/p>\n<p>Cet exemple montre pourquoi il faut \u00e9viter les calculs trop rapides. Si B a pay\u00e9 seul 18 000 euros de mensualit\u00e9s d&#8217;emprunt qui ont conserv\u00e9 le bien, il peut avoir une cr\u00e9ance \u00e0 faire valoir. Mais cette cr\u00e9ance ne fait pas dispara\u00eetre l&#8217;occupation privative. Elle entre dans les comptes.<\/p>\n<h2>5. Les erreurs fr\u00e9quentes dans les dossiers franciliens<\/h2>\n<p>Premi\u00e8re erreur : confondre indemnit\u00e9 d&#8217;occupation et loyer. L&#8217;indemnit\u00e9 n&#8217;est pas toujours un loyer payable chaque mois \u00e0 l&#8217;autre indivisaire. Elle est une cr\u00e9ance de l&#8217;indivision, souvent r\u00e9gl\u00e9e dans les comptes de partage.<\/p>\n<p>Deuxi\u00e8me erreur : oublier la preuve d&#8217;exclusion. L&#8217;occupation seule ne suffit pas toujours si le bien restait r\u00e9ellement accessible aux autres indivisaires. Il faut d\u00e9montrer la jouissance privative.<\/p>\n<p>Troisi\u00e8me erreur : demander une indemnit\u00e9 depuis une date trop ancienne sans traiter la prescription. L&#8217;<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006432423\">article 815-10 du code civil<\/a> limite les recherches relatives aux fruits et revenus au-del\u00e0 de cinq ans.<\/p>\n<p>Quatri\u00e8me erreur : n\u00e9gliger les pr\u00eats et taxes. L&#8217;occupant peut \u00eatre d\u00e9biteur de l&#8217;indemnit\u00e9 mais cr\u00e9ancier au titre de certaines d\u00e9penses n\u00e9cessaires. Ne pas les int\u00e9grer expose \u00e0 un compte d\u00e9s\u00e9quilibr\u00e9.<\/p>\n<p>Cinqui\u00e8me erreur : saisir trop vite sans tableau. Une demande juridiquement fond\u00e9e mais mal chiffr\u00e9e se transforme en expertise ou en renvoi. Le temps perdu se paie cher lorsque l&#8217;occupation continue.<\/p>\n<h2>6. Pourquoi cet angle est distinct des autres contenus immobiliers du cabinet<\/h2>\n<p>Le cabinet a d\u00e9j\u00e0 publi\u00e9 des contenus sur l&#8217;occupant sans droit ni titre apr\u00e8s la fin du bail, l&#8217;indemnit\u00e9 d&#8217;occupation apr\u00e8s r\u00e9siliation d&#8217;un bail d&#8217;habitation, le <a href=\"https:\/\/kohenavocats.fr\/avocat-depot-garantie-paris\/\" target=\"_blank\" title=\"d\u00e9p\u00f4t de garantie\">d\u00e9p\u00f4t de garantie<\/a>, les <a href=\"https:\/\/kohenavocats.fr\/avocat-recouvrement-loyers-paris\/\" target=\"_blank\" title=\"loyers impay\u00e9s\">loyers impay\u00e9s<\/a> et l&#8217;expulsion. Ici, le sujet est diff\u00e9rent.<\/p>\n<p>Il ne s&#8217;agit pas d&#8217;un locataire qui reste apr\u00e8s la fin du bail. Il s&#8217;agit d&#8217;un propri\u00e9taire indivis qui occupe un bien commun. Le juge ne raisonne donc pas seulement en expulsion ou en loyer. Il raisonne en comptes d&#8217;indivision, valeur locative, quote-parts, d\u00e9penses de conservation, prescription et partage.<\/p>\n<p>Cette diff\u00e9rence change tout : la preuve, le calcul, la proc\u00e9dure et le bon interlocuteur. L&#8217;avocat doit pouvoir parler au notaire, pr\u00e9parer le tableau liquidatif et saisir le tribunal si le compte reste bloqu\u00e9.<\/p>\n<h2>Synth\u00e8se pratique<\/h2>\n<p>\u00c0 Paris et en \u00cele-de-France, un dossier d&#8217;indemnit\u00e9 d&#8217;occupation en indivision doit \u00eatre mont\u00e9 comme un dossier de compte patrimonial. Il faut \u00e9tablir le titre de propri\u00e9t\u00e9, prouver la jouissance privative, chiffrer la valeur locative locale, int\u00e9grer les mensualit\u00e9s de pr\u00eat et taxes, puis choisir le bon canal : notaire, juge aux affaires familiales ou tribunal judiciaire.<\/p>\n<p>Le bon r\u00e9flexe est de ne pas attendre le partage final pour collecter les preuves.
