Le juge des contentieux de la protection avait statu\u00e9 au fond apr\u00e8s un renvoi prononc\u00e9 en r\u00e9f\u00e9r\u00e9. L&#8217;arr\u00eat interroge la possibilit\u00e9, pour la juridiction d&#8217;appel, de relever d&#8217;office la nullit\u00e9 du jugement pour exc\u00e8s de pouvoir, puis d\u2019\u00e9voquer et de statuer selon les r\u00e8gles du r\u00e9f\u00e9r\u00e9.<\/p>\n<p>Les faits tiennent \u00e0 un bail d\u2019habitation conclu en 2006, assorti d\u2019un loyer mensuel avec provision sur charges, et \u00e0 un commandement de payer du 3 mars 2021 visant la clause r\u00e9solutoire. L\u2019assignation a \u00e9t\u00e9 d\u00e9livr\u00e9e en r\u00e9f\u00e9r\u00e9 le 22 juillet 2021, aux fins de r\u00e9siliation, expulsion et condamnation au paiement. La locataire a contest\u00e9 la validit\u00e9 du commandement et le jeu de la clause.<\/p>\n<p>La proc\u00e9dure a connu plusieurs \u00e9tapes. Une ordonnance du 26 janvier 2022 a d\u00e9clin\u00e9 la comp\u00e9tence du juge des r\u00e9f\u00e9r\u00e9s, avec renvoi au juge des contentieux de la protection. Par jugement du 6 f\u00e9vrier 2023, ce juge a constat\u00e9 l\u2019acquisition de la clause \u00e0 la date du 4 mai 2021, condamn\u00e9 au paiement d\u2019un arri\u00e9r\u00e9, et accord\u00e9 des d\u00e9lais avec suspension des effets. Un arr\u00eat avant dire droit du 4 octobre 2024 a ensuite invit\u00e9 les parties \u00e0 conclure sur une \u00e9ventuelle nullit\u00e9 pour exc\u00e8s de pouvoir.<\/p>\n<p>La juridiction d\u2019appel annule finalement le jugement et \u00e9voque. Le dispositif retient notamment que \u00ab ANNULE d\u2019office le jugement entrepris \u00bb, puis, s\u2019agissant du fond, \u00ab DIT N\u2019Y AVOIR lieu \u00e0 r\u00e9f\u00e9r\u00e9 \u00bb. L\u2019examen porte alors sur l\u2019\u00e9tendue des pouvoirs du juge saisi, la passerelle proc\u00e9durale, l\u2019autorit\u00e9 de la chose jug\u00e9e de l\u2019ordonnance de r\u00e9f\u00e9r\u00e9, et la consistance de la dette all\u00e9gu\u00e9e.<\/p>\n<p>La question de droit principale concernait la facult\u00e9 de relever d\u2019office une nullit\u00e9 pour exc\u00e8s de pouvoir, en pr\u00e9sence d\u2019un juge statuant au fond alors qu\u2019il \u00e9tait saisi en r\u00e9f\u00e9r\u00e9 sans passerelle. La Cour y r\u00e9pond positivement et pr\u00e9cise que \u00ab Il a ainsi m\u00e9connu l\u2019\u00e9tendue des pouvoirs du juge des r\u00e9f\u00e9r\u00e9s en statuant au fond \u00bb. Elle ajoute, de mani\u00e8re d\u00e9cisive, que \u00ab Il convient donc d\u2019annuler d\u2019office le jugement entrepris, le juge des r\u00e9f\u00e9r\u00e9s ayant m\u00e9connu l\u2019\u00e9tendue de son pouvoir juridictionnel en statuant au fond \u00bb. Sur le terrain locatif, l\u2019arr\u00eat constate encore, au regard des justificatifs bancaires, que \u00ab Il r\u00e9sulte donc de ce d\u00e9compte que le commandement de payer a \u00e9t\u00e9 d\u00e9livr\u00e9 le 3 mars 2021 pour des loyers qui avaient \u00e9t\u00e9 r\u00e9gl\u00e9s \u00bb.<\/p>\n<p>I. L\u2019office du juge et l\u2019exc\u00e8s de pouvoir<\/p>\n<p>A. De la saisine en r\u00e9f\u00e9r\u00e9 \u00e0 la d\u00e9cision au fond<\/p>\n<p>Le point de d\u00e9part tient \u00e0 la nature d\u2019une d\u00e9cision de r\u00e9f\u00e9r\u00e9. L\u2019arr\u00eat rappelle le texte applicable, selon lequel \u00ab Aux termes de l\u2019article 484 du code de proc\u00e9dure civile, l\u2019ordonnance de r\u00e9f\u00e9r\u00e9 est une d\u00e9cision provisoire rendue \u00e0 la demande d\u2019une partie [\u2026] dans les cas o\u00f9 la loi conf\u00e8re \u00e0 un juge qui n\u2019est pas saisi du principal le pouvoir d\u2019ordonner imm\u00e9diatement les mesures n\u00e9cessaires \u00bb. Cette d\u00e9finition conditionne l\u2019\u00e9tendue de l\u2019office et interdit, sans passerelle, un jugement au fond.<\/p>\n<p>La port\u00e9e de l\u2019ordonnance de r\u00e9f\u00e9r\u00e9 ne saurait faire obstacle \u00e0 ce rappel. La Cour cite explicitement que \u00ab L\u2019ordonnance de r\u00e9f\u00e9r\u00e9 n\u2019a pas, au principal, l\u2019autorit\u00e9 de la chose jug\u00e9e \u00bb. La th\u00e8se fond\u00e9e sur l\u2019autorit\u00e9 des motifs n\u00e9cessaires de la comp\u00e9tence ne peut d\u00e8s lors convertir la saisine provisoire en saisine au principal. L\u2019exc\u00e8s de pouvoir est ainsi caract\u00e9ris\u00e9.<\/p>\n<p>La carence de passerelle confirme la m\u00e9connaissance de l\u2019office du juge. L\u2019arr\u00eat retient que \u00ab L\u2019ordonnance emporte saisine de la juridiction \u00bb \u00e0 propos de l\u2019article 837 du code de proc\u00e9dure civile, mais souligne l\u2019absence d\u2019une conversion de la proc\u00e9dure \u00e0 la demande d\u2019une partie. Cette condition non remplie rend in\u00e9vitable l\u2019annulation d\u2019office du jugement au fond.<\/p>\n<p>B. Le relev\u00e9 d\u2019office et la sanction de nullit\u00e9<\/p>\n<p>La juridiction d\u2019appel fonde sa d\u00e9marche sur le caract\u00e8re d\u2019ordre public de la r\u00e8gle m\u00e9connue. La motivation articule l\u2019article 125 du code de proc\u00e9dure civile, et \u00e9nonce qu\u2019il s\u2019agit d\u2019une \u00ab inobservation d\u2019une r\u00e8gle proc\u00e9durale d\u2019ordre public \u00bb. Il en r\u00e9sulte la l\u00e9gitimit\u00e9 du relev\u00e9 d\u2019office par la Cour, sans exc\u00e9der elle-m\u00eame son office ni d\u00e9naturer le litige.<\/p>\n<p>La sanction s\u2019impose ensuite avec une coh\u00e9rence remarquable. La Cour juge que \u00ab Compte tenu de la nullit\u00e9 du jugement, la cour est tenue d\u2019\u00e9voquer l\u2019affaire selon les prescriptions de la proc\u00e9dure de r\u00e9f\u00e9r\u00e9 \u00bb. Ce rappel structure la suite des d\u00e9bats, recentr\u00e9s sur le provisoire, l\u2019\u00e9vidence de l\u2019obligation et l\u2019examen des mesures imm\u00e9diatement n\u00e9cessaires, sans trancher le principal.<\/p>\n<p>Le raisonnement neutralise enfin l\u2019argument d\u2019autorit\u00e9 attach\u00e9 \u00e0 l\u2019ordonnance ayant d\u00e9clin\u00e9 la comp\u00e9tence. Il est \u00e9nonc\u00e9 que \u00ab Aucune autorit\u00e9 de la chose jug\u00e9e ne r\u00e9sulte de l\u2019ordonnance de la pr\u00e9sidente du tribunal judiciaire qui a seulement constat\u00e9 l\u2019incomp\u00e9tence d\u2019attribution [\u2026] sans modifier l\u2019objet du litige ni la nature de la proc\u00e9dure \u00bb. La solution verrouille la tentation d\u2019\u00e9largir la saisine au-del\u00e0 de la passerelle.<\/p>\n<p>II. La rectitude de la solution et ses effets en mati\u00e8re locative<\/p>\n<p>A. Une solution conforme \u00e0 la logique du r\u00e9f\u00e9r\u00e9<\/p>\n<p>La solution adopt\u00e9e s\u2019inscrit dans la coh\u00e9rence du r\u00e9gime du r\u00e9f\u00e9r\u00e9. La Cour r\u00e9affirme que le renvoi ne vaut pas saisine au principal sans demande et garanties proc\u00e9durales, ce qu\u2019exige la passerelle de l\u2019article 837 du code de proc\u00e9dure civile. Cette exigence prot\u00e8ge les droits de la d\u00e9fense et la lisibilit\u00e9 des pouvoirs du juge, qui ne peut statuer ultra petita sur la nature de la proc\u00e9dure.<\/p>\n<p>L\u2019annulation d\u2019office s\u2019accorde avec la hi\u00e9rarchie des normes proc\u00e9durales. En pr\u00e9sence d\u2019une r\u00e8gle d\u2019ordre public viol\u00e9e, l\u2019intervention spontan\u00e9e du juge d\u2019appel pr\u00e9vient la consolidation d\u2019une d\u00e9cision entach\u00e9e d\u2019incomp\u00e9tence fonctionnelle. La formule \u00ab Il convient donc d\u2019annuler d\u2019office le jugement entrepris \u00bb manifeste la correction imm\u00e9diate de cette atteinte.<\/p>\n<p>Le rejet de l\u2019argument tir\u00e9 de l\u2019autorit\u00e9 de la chose jug\u00e9e pr\u00e9serve un \u00e9quilibre utile. En rappelant que \u00ab L\u2019ordonnance de r\u00e9f\u00e9r\u00e9 n\u2019a pas, au principal, l\u2019autorit\u00e9 de la chose jug\u00e9e \u00bb, l\u2019arr\u00eat \u00e9carte la confusion entre comp\u00e9tence et objet de la saisine, tout en \u00e9vitant que des motifs de comp\u00e9tence figent ind\u00fbment la nature de la proc\u00e9dure.<\/p>\n<p>B. Les cons\u00e9quences sur le commandement et la clause r\u00e9solutoire<\/p>\n<p>L\u2019\u00e9vocation en r\u00e9f\u00e9r\u00e9 recentre l\u2019examen sur l\u2019\u00e9vidence de l\u2019obligation all\u00e9gu\u00e9e et le jeu de la clause r\u00e9solutoire. S\u2019agissant du commandement, la Cour constate que \u00ab Il r\u00e9sulte donc de ce d\u00e9compte que le commandement de payer a \u00e9t\u00e9 d\u00e9livr\u00e9 le 3 mars 2021 pour des loyers qui avaient \u00e9t\u00e9 r\u00e9gl\u00e9s \u00bb. Cette donn\u00e9e factuelle interdit l\u2019acquisition de la clause fond\u00e9e sur un impay\u00e9 inexistant \u00e0 la date d\u00e9terminante.<\/p>\n<p>La solution en d\u00e9coule dans des termes sobres et fermes. La Cour juge qu\u2019\u00ab Il n\u2019y a donc pas lieu \u00e0 r\u00e9f\u00e9r\u00e9 \u00bb, ce qui exclut tant la r\u00e9siliation de plein droit que les mesures accessoires d\u2019expulsion ou d\u2019indemnit\u00e9 d\u2019occupation en l\u2019\u00e9tat du dossier soumis au provisoire. La clarification \u00e9vite une r\u00e9siliation automatique d\u00e9nu\u00e9e de cause.<\/p>\n<p>La logique du r\u00e9f\u00e9r\u00e9 commande enfin la prudence en mati\u00e8re de provision. \u00c0 d\u00e9faut d\u2019un d\u00e9compte probant \u00e9tabli par le bailleur, l\u2019\u00e9vidence de la dette fait d\u00e9faut. L\u2019arr\u00eat, laissant chaque partie supporter ses frais, r\u00e9affirme la finalit\u00e9 du provisoire et l\u2019importance d\u2019une preuve claire du montant exigible, d\u00e8s lors que la clause r\u00e9solutoire est priv\u00e9e d\u2019effet.<\/p>\n<p>I.
