He\u00a0was sentenced to\u00a0concurrent sentences on all counts, the longest being imposed on each of\u00a0the rape counts, namely an extended sentence of\u00a026\u00a0years and 8\u00a0months, comprising a\u00a0custodial term of 20\u00a0years and 8 months, and an extended licence period of\u00a06 years. 2 The applicant renews his applications for leave to appeal against conviction and leave to appeal against sentence following the refusal of\u00a0both by\u00a0the single judge. He\u00a0needs a\u00a0short extension of\u00a0time for both, which we grant. 3 We do not need to\u00a0set out the facts of\u00a0the case in this judgment because these are renewal applications and the case raises no questions of\u00a0principle which are of\u00a0relevance to\u00a0other cases. The facts are well known to the applicant and set out fully in the Criminal Appeal Office summary, the grounds of\u00a0appeal and the respondent&#039;s notice. Similarly, the applicant is well aware of the reasons which the single judge gave for refusing leave both in relation to conviction and sentence. 4 Miss\u00a0Davy has appeared with Miss\u00a0Baker pro bono before us and we are very grateful to\u00a0them for doing so. Despite the attractively presented submissions, we entirely agree with the remarks of\u00a0the single judge and the reasons which he\u00a0gave for refusing leave on each of\u00a0the four grounds advanced. Accordingly, dismiss the conviction application. 5 We also agree with the single judge that the length of\u00a0the custodial element of\u00a0the sentence was not manifestly excessive. The trial judge was entitled to\u00a0reach the conclusions which she reached on the evidence and she gave adequate weight to\u00a0the applicant&#039;s youth and his limited personal mitigation. 6 As\u00a0to\u00a0the sentence being an extended one, we had not understood from the grounds of\u00a0appeal that there was any challenge to\u00a0the finding of\u00a0dangerousness. Miss\u00a0Davy told us that she did wish to\u00a0make such a\u00a0challenge. In the circumstances of\u00a0the brutal sexual offending which took place in this case and the absence of\u00a0any remorse or insight, as\u00a0reflected in the Pre-sentence Report, the suggestion that there was any error by\u00a0the trial judge finding the applicant to\u00a0be\u00a0dangerous is one which is not merely ambitious but, in our view, hopeless. 7 A\u00a0further challenge was made to the imposition of\u00a0an\u00a0extended sentence both on the basis that a\u00a0determinate sentence would have been sufficient, given its length, or alternatively, that if an\u00a0extended licence was required, a\u00a0period of\u00a0six years was manifestly excessive. The difficulty with these submissions is that it\u00a0is clear from the Pre-sentence Report that the applicant was not prepared to\u00a0accept his guilt, maintained his innocence and was not interested in engaging with his offending behaviour. There therefore remains a\u00a0real risk that his dangerousness will remain at its current level at the end of\u00a0what is a\u00a0lengthy sentence. It\u00a0was necessary to\u00a0impose an\u00a0extended sentence with an\u00a0extended licence to\u00a0meet that risk upon his release. A\u00a0period of\u00a0six years might be regarded as\u00a0on the long side, but it\u00a0was well within the discretion properly available to\u00a0the judge and was not, in our view, a\u00a0manifestly excessive period given the nature of\u00a0the risk which is posed by\u00a0the applicant and the potential harm to\u00a0the public. 8 Accordingly, the sentence application is also dismissed. 9 We should finally mention the victim surcharge. The record of\u00a0the sentence includes a\u00a0victim surcharge in the sum of\u00a0\u00a3191. That is in error because no such surcharge was pronounced by\u00a0the judge and it\u00a0is the judgment pronounced in open court which is determinative, and accordingly, we make clear that the record should be amended to\u00a0remove the victim surcharge accordingly. __________ Epiq Europe Ltd hereby certify that the above is an accurate and complete record of the proceedings or part thereof.
